Ratification of appointments to the Harrison Memorial Library Board of Trustees,


SUBJECT: Forest and Beach Commission, Historic Resources Board, and Planning
Commission.

RECOMMENDATION:
Ratify appointments to the Harrison Memorial Library Board of Trustees, Forest and Beach
Commission, Historic Resources Board, and Planning Commission.

BACKGROUND/SUMMARY:
City Boards and Commissions perform a valuable service to the City by providing means by which
the City Council can obtain advice, opinions, and recommendations of City residents and other
members of the community. For this cycle of appointments, or reappointments, the City Council
has been presented with a total of seven scheduled Board and Commission vacancies with terms
ending September 30, 2017.

Mayor Dallas and Mayor Pro Tem Theis interviewed applicants for board and commission
vacancies Monday, September 25, 2017. All applicants demonstrated a strong commitment to
service and a desire to serve the Carmel-by-the-Sea community. The ad hoc committee was
appreciative of all community members of diverse backgrounds and exceptional skill sets, who
filled out an application and participated in the interview process.

After much deliberation the ad hoc committee has identified the following individuals as qualified
and ideal candidates to fill the vacancies and is recommending the appointment of the following
candidates to Boards and Commissions:
- Tara Twomey, Harrrison Memorial Library Board of Trustees
- Christopher Bolton, Forest and Beach Commission
- Michael Caddell, Forest and Beach Commission
- Erik Dyar, Historic Resources Board
- Alex Heisinger, Historic Resources Board
- Gail Lehman, Planning Commission
- Michael LePage, Planning Commission
Mayor Dallas and Mayor Pro Tem Theis are also recommending the appointment of Phillip
Pardue to the Harrison Memorial Library Board of Trustees to fill the unexpected vacancy left by
the passing of Library Board Trustee Richard Flower. This vacancy was advertised with the
regularly occurring vacancies.

N/A
PRIOR CITY COUNCIL ACTION:
Council ratifies appointments to fill annually occurring vacancies for terms expiring September 30
of each year at its October regular meeting. Throughout the year the Council also takes action to
ratify appointments to Boards and Commissions to fill unanticipated vacancies.

All members of boards and commissions are subject to the Conflict of Interest Laws of the State of California and are
required to submit Form 700, "Statement of Economic Interest," within 30 days of assuming office. Form 700 must be
filed annually thereafter, and within 30 days of leaving office as well.

APPENDIX

COMMUNITY ACTIVITIES AND CULTURAL COMMISSION


The Community and Cultural Commission is a five-member body whose role is to stimulate and encourage
community, cultural and artistic activities within the City, and to make recommendations to the City Council
and the City Administrator concerning community, cultural, and artistic activities and programs as may be
deemed appropriate.

HARRISON MEMORIAL LIBRARY BOARD OF TRUSTEES


The Harrison Memorial Library Board of Trustees is a five-member body whose duties and responsibilities
are to manage, control and administer any library building or library property owned by the City, and to
make and enforce all rules, regulations and bylaws necessary for the administration, government and
protection of the library.

PLANNING COMMISSION
The Planning Commission is a five-member body whose duties and responsibilities are to develop and
maintain a General Plan; review Environmental Impact Reports and Initial Studies; conduct public hearings,
review evidence and determine requests for use permits, variances, rezoning and land use Code
amendments; hear and render decisions on appeals of determinations made by administrative staff;
determine the consistency with the General Plan of capital improvement projects and programs; and review
and act upon design review and design study applications.

FOREST AND BEACH COMMISSION


The Forest and Beach Commission is a five-member body whose duties and responsibilities are to develop
a management plan for the urban forest, parks and beach and to correlate such plans with the City's
General Plan; consider and act on applications for tree-trimming and tree-removal; and advise the City
Council or other government instrumentalities of the City with respect to specific items of management
and technical forestry and beach matters.

HISTORIC RESOURCES BOARD


The Historic Resources Board is a five-member body whose purpose is to carry out the policies of the
architectural/cultural/historic (ACH) element of the General Plan and to serve in an advisory capacity to the
Planning Commission and City Council; develop and maintain an inventory of significant sites, structures and
districts; and review requests to alter or modify the exteriors of designated resources.

National Consumer Law Center


Of Counsel (2005 to present)
Engage in ongoing analysis of issues related to consumer credit, bankruptcy and sustainable
homeownership. Responsibilities include writing practice guides, drafting and reviewing
legislation, teaching consumer law, bankruptcy and foreclosure defense to legal services,
private and government attorneys and other advocates around the country.

National Consumer Bankruptcy Rights Center


Project Director (2011 to present)
Manage all aspects of this 501(c)(3) organization that focuses on preserving the rights of
consumer bankruptcy debtors. Responsibilities include writing briefs submitted to Circuit
Courts of Appeals, District Courts, and Bankruptcy Courts; managing additional brief
writers; coordinating pro bono assistance; following judicial trends in bankruptcy law;
developing an appellate strategy to respond to such trends; and, responding to individual
requests for assistance.

Direct amicus project for national non-profit organization. Duties include writing amicus
briefs submitted to various appellate courts, following judicial trends, and responding to

Co-principal investigator with Professor Katherine Porter (University of California, Irvine)
in study examining the intersection between homeownership and bankruptcy. The project

Statement oflnterest

Our family has deep roots in this community dating back more than fifty years, and we
have all long had a passion for libraries and history. Since moving here with my husband
and two small children nearly thirteen years ago, we have been the beneficiaries of
Carmel's amazing libraries. My kids, now ages 13 and 14, grew up at the Park Branch
progressing from picture books such as The Very Hungry Caterpillar, through early stage
reading in the Magic Tree House series, and on to young adult fiction such as Redwall.
Now we have gravitated towards the Teen Room and the Main Library as their interest
mature and expand. We have listened to books on tapes, borrowed digital books,
checked out movies, and I have often found a quiet place to read in or write in the Main
Branch. The library has been a place that has served our family through many different
stages, and I welcome the opportunity to help guide the library into the future.

Statement of Qualifications

Strong interest in the Carmel libraries and their future as indicated above.
Community parent with children that utilize the library.
Excellent written and verbal communication skills. My day job involves writing
articles, books, and legal briefs. I also have strong public speaking skills and have
given presentations around the country to groups that range from 10 to more than
1000 people.
Good organizational skills.
Ability and willingness to fundraise, and an understanding of budgets and business
operations. Through my work I have had to do all these things to support a small,
non-profit organization. I have done a little of everything from fundraising and
administering grants to balancing budgets and marketing.
Experience working with volunteer organizations. I have previously and continue to be
a part of other volunteer boards.
Ability to work with others on the Board, in city government, and in the community. I
am able to work through problems with people, and also recognize that sometimes
people just disagree. In my work on consumer credit issues, I have developed many
friendships with those that represent creditors on the other side. While we may
disagree as to substance on a particular issue, we all want to maintain the integrity of
the system. As a result, we remain courteous and professional towards each other,
and even enjoy a meal together occasionally.

focus for a significant segment of our residents. Where else can you walk through the stacks of publications and
discover new interest in the very next book. magazine. newspaper, library program, or lecture series. This is not
to say that the Harrison Memorial Library should not change with the times and provide increased access to
information on the web, just that with management and oversight the best of both worlds can be preserved.
As we take care of our current patrons we must plan for the future ones, otherwise they will stay home.

My fondest, earliest memories are of walking Carmel Beach, peering into tide pools, and
exploring their teeming beauty. Those early days had a profound impact on my life, inspiring my
eventual degree in intertidal ecology at UCSC. Recently I moved my family to downtown so we
could be close to the beach and I could teach my children to surf.

I began my career in the building trades at 16 years of age when I went to work as a laborer
rebuilding the Crosby House on 17 Mile Drive. I have worked for the Bolton Design Group for
twenty years. My mentor (and boss and partner) is my father Michael Bolton. His iconic homes
and buildings dot Carmel and the Peninsula and each is a testament to the enhancement to
design the natural environment can make. We have designed around, through and under more
oak, cypress and pine branches thim can be counted. The ultimate result are structures that
appear to have always been in situ.

Carmel's forest of Monterey Pine, Coast Live Oak, and Monterey Cypress are a unique and
valuable resource for our community. These local species thrive nowhere else on Earth in such
abundance. Half of our native forests in Monterey County have already vanished, lost due to
disease, development and genetic contamination. Without the urban forest, Carmel-by-the-Sea
would not be in the unique and enviable position it currently holds as one a top tourist
destinations in California. They are engines of our economy, driving the tourist trade and making
Carmel real estate exceptionally valuable. Building codes and regulations serve a vital purpose
in maintaining the character and appeal of Carmel. When architects and designers comply with
the design guidelines and seek to harmonize with the trees and topography of their sites, great
design results. When they disregard or attempt to circumvent the rules set out to protect our
resources, conflict results. My experience working with Carmel and the other local jurisdictions
has instilled in me great respect for the hard work of local governance. Working in architectural
design in Carmel has increased my sensitivity to the needs of the urban forest, while balancing
the needs and desires of residents and commercial interests.

Designing a building in Carmel-by-the-Sea is a process that involves careful study of the design
guidelines and multiple layers of interaction with City agencies and staff. This process is vital to
the preservation of our city's urban forest. I am dismayed, when driving through town, that too
often construction projects remove trees along the street, exposing the mass of the structure to
the public. Trees along the roadways in Carmel are a vital feature of our local aesthetic.

Living in the NorthWest Corner of Carmel, I use the footpath to the beach at the base of 4th
Avenue regularly. I am encouraged to hear that the City is moving forward after much delay with
implementation of the North Dunes restoration plan. The removal of invasive species and
encouragement of native plants along with public improvements will be a boon for the residents
and visitors alike; not to mention restoring the North Dune's health and vigor. Similar steps

making process that helps bring continuity. Beyond my history with the HRB, I have lived in or in the sphere of i11)luence
of Carmel-by-the-Sea for over 26 years, This gives me a broad, cohesive understanding of the town through
seeing it evolve of time. Tl1is experience of living here is also filtered through the lens of my profession as an
arch it net. It obviously allows me to quickly understand the documents we review as a Board and zero in on critical
issues 1hat may not be as conspicuous to others, but it also gives me the ability to see the applicant's point of view

To continue my family's tradition of service to our community. To help ensure that our small village remains
"primarily, essentially and predominantly a residential City. "

I was appointed to the Histone Resources Board last November and have greatly enjoyed my brief tenure. I feel I've
been of valued contribution and my experience as a real estate professional and insights gained from being a life-long
resident have provided insightful.

If re-appointed I'd like to focus my efforts on a few key areas;

Firstly, I'd like to assist in promoting the Mills Act as it applies to commercial buildings. The property tax benefits to be
had are little known, especially to commercial building owners. Lower property taxes mean a greater chance of these
important buildings being pro-actively preserved. As most leases are NNN it also means more competitive rents.
Therefore incentivizing businesses to occupy these buildings. Continued use ofthese buildings will ensure they are
preserved and maintained.

Secondly, as both a member of the HRB & MCAR's Education Committee, I'd like to help to educate the local Realtor
community as to the historic review and preservation process. Realtor's are often the first resource for new and current
property owners when investigating the historic process. There are many ambiguities and frankly only a small group of
agents truly understand these processes. I hope through education and transparency we can remove the stigma that is
oftentimes associated with historic properties and the review/preservation process.

My family settled on the Big Sur Coast in the 1880's and became residents of Carmel in the 1930's. I am very familiar
with the history and traditions of the Carmel community. My great-grandmother served as the children's librarian at
Harrison Memorial for over 20 years. In addition to careers in construction, architecture and law, my parents and
grandparents have served as volunteers with several local community organizations, a family tradition I intend to
continue.

Prior to receiving my Real Estate Broker's license, I was a Research Associate with Hanley Wood Market Intelligence,
the leading publisher of primary & secondary housing market data in the nation. At Hanley Wood, I tracked
developments throughout California, Nevada & Arizona, from the planning phase, through their construction and sale.
While doing this I developed relationships with Planners, Engineers, Builders & Developers. After departing Hanley

Wood I worked for a private equity group identifying single family & multi-family properties for the purpose of

Gail Lehman was born in New York City and spent her
childhood and young adult years on the East coast.
Although her major during her years at Cornell
University and Harvard University was Government, her
fascination with design led her to The New York School
of Interior Design and the completion of their graduate
design program. Gail subsequently moved to the West
coast and in Los Angeles worked for three major
international design firms before relocation to the
Monterey Peninsula and striking out on her own. She
successfully designed two and one-half million square
feet of commercial office space, hospitals and schools
and was three times the winner of prestigious
international design awards including "The Prix de
Femmes International". Her work has been featured in "The International
Compendium of Women in Design International". In 2000, Gail fulfilled a long-delayed
commitment to devote herself full-time to study painting through many classes at the
college level, personal instruction with some of the Peninsula's renowned Artists and many
workshops, both on the Monterey Peninsula and in France. She has energized her canvases
with a great luminosity and sophistication. In her stylistic progression from traditional still
life composition and figure painting to abstract and figurative expressionism, Gail has
emerged an artist of merit. Her work has been acquired by collectors in Berkeley, Boise,
Boston, Los Angeles, The Monterey Peninsula, Napa, New York, Rancho Santa Fe, San
Diego, San Francisco, and San Jose. In Europe, her work has been collected in Amsterdam,
Barcelona, London, Paris, and Valencia. In 2013, her painting "The Lady in Red" was
installed in the Private Collection at Marywood University in Scranton, Pennsylvania. A
commissioned work to honor a scholarship for the collector's mother will be installed
adjacent to "The Lady in Red" at Marywood University.

To Whom It May Concern:

Sii1CI:! 2003, I have known Gail Lehman and her professional endeavors. I have
always taken a peripheral interest in her architectural space planning and design
pursuits and in 2012 had the opportunity to see her latest architectural design project,
"Opus 35". While visiting with Gail in "Opus 35", I had the privilege to see a selection
of her art and for personal reasons fell in love and purchased her original painting,
The Lady in Red.

The Lady in Red epitomizes Gail's "true love of Abstract Expressionism and Figurative
Abstracts". The Lady in Red to me displays an image of my grandmother, Josephine
N. Pavelick, who was the matriarch of my maternal family and had a very distinctive
joie de vivre. "Jo Nancy" - as she was affectionately known to those who loved her -
is going to be memorialized in an endowed scholarship at Marywood University located
in Scranton, Pennsylvania during April 2014.

The Lady in Red will be the anchor piece of artwork in a private art collection donated
to Marywood University as well during April 2014. The second piece of artwork will be
a Gail Lehman original painting that will be placed in the lobby of the chapel at
Marywood University adjacent to The Lady in Red in the fall of 2014. This
commissioned artwork will be based on the "Spirit of Life" scholarship for my mother,
Catherine Ann (nee. Mindick) Serafin who is not only a graduate of Marywood
University, but the daughter of "Jo Nancy".

Besides having scholarships in their names, these two superb works of art by Gail
Lehman will adorn the walls of the chapel at Marywood University and provide a
figurative image of these two profound women. I am much honored to have selected
Gail Lehman to be the artist to capture their spirit, life's purpose and lasting legacy.

APPENDIX

COMMUNITY ACTIVITIES AND CULTURAL COMMISSION


The Community and Cultural Commission is a five-member body whose role is to stimulate and encourage
community, cultural and artistic activities within the City, and to make recommendations to the City Council
and the City Administrator concerning community, cultural, and artistic activities and programs as may be
deemed appropriate.

HARRISON MEMORIAL LIBRARY BOARD OF TRUSTEES


The Harrison Memorial Library Board of Trustees is a five-member body whose duties and responsibilities
are to manage, control and administer any library building or library property owned by the City, and to
make and enforce all rules, regulations and bylaws necessary for the administration, government and
protection of the library.

PLANNING COMMISSION
The Planning Commission is a five-member body whose duties and responsibilities are to develop and
maintain a General Plan; review Environmental Impact Reports and Initial Studies; conduct public hearings,
review evidence and determine requests for use permits, variances, rezoning and land use Code
amendments; hear and render decisions on appeals of determinations made by administrative staff;
determine the consistency with the General Plan of capital improvement projects and programs; and review
and act upon design review and design study applications.

FOREST AND BEACH COMMISSION


The Forest and Beach Commission is a five-member body whose duties and responsibilities are to develop
a management plan for the urban forest, parks and beach and to correlate such plans with the City's
General Plan; consider and act on applications for tree-trimming and tree-removal; and advise the City
Council or other government instrumentalities of the City with respect to specific items of management
and technical forestry and beach matters.

HISTORIC RESOURCES BOARD


The Historic Resources Board is a five-member body whose purpose is to carry out the policies of the
architectural/cultural/historic {ACH) element of the General Plan and to serve in an advisory capacity to the
Planning Commission and City Council; develop and maintain an inventory of significant sites, structures and
districts; and review requests to alter or modify the exteriors of designated resources.
