JUDICIAL AFFIDAVIT OF WINONA MARIE BAQUIAL

I, WINONA MARIE D. BAQUIAL, M.D., L.L.B, Filipino, of legal age,

single and a resident of Dampas District, Tagbilaran City, Bohol,
Philippines, after being sworn, depose and say my testimony in English
language, a dialect which I could understand, fully conscious that I do so
under oath. I make my testimony conducted and supervised by Atty. Abo
Gado, in his office at 117 Belderol St., Cogon District, Tagbilaran City,
Bohol, this 10th day of July, 2017.

PURPOSE

This affidavit of WINONA MARIE D. BAQUIAL, M.D., L.L.B is being

offered to prove that the male sexual organ, an essential part for
reproduction, of the complainant was completely mutilated and rendered
the complainant incapable of procreating.

Q1 Please state your name and other personal circumstances for

the record.
A1 I am Dr. Winona Marie D. Baquial, of legal age, single and a
medical examiner of Holy Name University Medical Center Inc.,
and a resident of Dampas District, Tagbilaran City, Bohol.

Q2 How long have you been practicing your profession?

A2 For almost eight (8) years already.

Q3 Where are you presently employed?

A3 At Holy Name University Medical Center Inc.

Q4 What position do you currently hold?

A4 I am the Senior Medical Examiner in the said hospital.

Q5 Have you ever examined a certain person named Divino Miag-

ao?
A5 Yes, Maam. I have examined Divino Miag-ao after he was
rushed to the emergency room on July 4, 2017 at around 10:oo
in the morning.

Q6 What was your finding after conducting medical examination of

him?
A6 Upon physical examination, patient was awake, conscious,
coherent and responsive, in respiratory distress, skin is cold to
touch, clear breath sounds, tachycardic, with soft non-tender
abdomen, however, the shaft of the penis was totally mutilated
with lacerations and active bleeding, no scrotal swelling, full
range of motion, capillary refill time is more than two (2)
seconds and strong peripheral pulse. Patient is now completely
incapable of procreation.

Q7 Did you prepare a medical report showing such findings?

A7 Yes, Maam.

A8 Yes, Maam. That is the one.
