RESOLUTION NO. 31

WHEREAS, in the entire length of the Mac-Arthur highway from San Juan in the
north to Sta. Lucia in the south, a stretch of about nine (9) kilometers, the incidence of
vehicular accidents has become more than noticeable causing loss of lives and damage
to properties both to motorists and pedestrians alike;

WHEREAS, it is the primary concern of government to safeguard life, limb and


property on our highways;

WHEREAS, in the pursuit of such duty, the operations and flow of motor vehicles
must be regulated and erring motorist should be correspondingly punished without
prejudice to the penal sanction of our national laws;

NOW THEREFORE, on motion presented by Coun. ZOSINO B. CUCHAPIN and


duly seconded;

RESOLVED, to pass & approve, as it is hereby passed & approved, Municipal


Ordinance No. 1, regulating the speed and operation of motor vehicles within and along
the stretch of Moncada, to wit:

AN ORDINANCE REGULATING SPEED LIMIT OF MOTOR VEHICLES PASSING


THROUGH THE NATIONAL HIGHWAY (MAC-ARTHUR) AND OTHER STREETS
AND ROADS FRONTING SCHOOLS, MARKETS, CHURCHES, RESIDENTIAL
AREAS AND OTHER GOVERNMENT BUILDINGS AND OFFICES AND PENALIZING
VIOLATORS THEREOF
BE IT ORDAINED BY THE SANGGUNINANG BAYAN OF MONCADA,
TARLAC IN SESSION ASSEMBLED:

-THAT-

Section 1- The speed limit of any motor or motorized vehicles with the territorial
limits of Brgys. Mabini, Lapsing, San Pedro & San Juan going north is set at 40 kms.
per hour and from Brgys. Camangaan East, San Julian & Sta. Lucia going south also at
40 kms. per hour. But within Rizal, Poblacion 1,2 & Camangaan East, the speed limit is
set at 30 kms. Per hour.

Section 2- The speed of any motor or motorized vehicles within the secondary
streets and roads fronting schools, markets, churches, residential areas, and other
government building shall be limited to twenty (20) kms. per hour.

Section 3- Motorists, drivers and operators actually managing motor or motorized


vehicles shall give way to siren blowing vehicles be it of the military, hospital or civilian
authority by pulling off the shoulder to a full stop until passage of said siren blowing
vehicles.

Section 4- Motorists, drivers and operators actually managing motor or motorized


vehicles shall observe and limit their speeds with the bounds of the motor vehicle law in
other areas not covered by Section 1 and 2 hereof.

Section 5- Motorists, drivers and operators who fail to stop at intersections


coming from secondary roads entering or crossing the national highway within the
municipality shall be fine P 100.00 or an imprisonment of five (5) days or both upon the
discretion of the court.

Section 6- Any violation of this ordinance or any provision thereof shall be


punished, upon conviction with an imprisonment of five (5) days or a fine of P 100.00 or
both such imprisonment and fine at the discretion of the Mun. Circuit Trial Court.

Section 7- In case a fine is imposed by the court against the offender, 50% of the
fine imposed by way of an incentive, will go to the implementing officer of the law and
the remaining 50% will go to the General Fund of the Municipal Government.

Section 8- Any ordinance or provision thereof contrary to the provision of this


ordinance are hereby repealed.

Section 9- This ordinance shall take effect upon approval.

for their information & guidance.
