AFFIDAVIT COMPLAINT

I, ARLYN A. PESIDAS, of legal age, married, Filipino citizen, and a resident of

Roxas Bataan, Digos City, Davao del Sur, after having duly sworn to in accordance with
law do hereby depose and state that:

1. I am the same and identical person who caused the execution of this
Affidavit Complaint;

2. I am formally filing a complaint against my half-sister AUBREY VENUS

J. ALMACIN and her aunt, EVELYN DIZON, both residents of
Poblacion Dos, Bansalan, Davao del Sur for the possible crime of slight
physical injuries defined and punished under the revised penal code
hereinafter referred to as AUBREY and EVELYN;

3. The factual circumstances leading to the filing of this complaint happened

as follows:

a. On August 9, 2017 at on or about 7:00 oclock in the evening, during

the death anniversary of Aubreys mother, I saw my younger sister
Agnes crying inside our old family home at Roxas Bataan, Digos City
where my family and I also lived. When I asked her what happened
she told me that she had an altercation with Aubrey and Evelyn over
the expense of the lechon which according to her was claimed by
Aubrey. I just laughed and told her not to mind them because it is such
a small matter;

b. The following day, my sister went to my house at Roxas Bataan, Digos

City and divulged to me the arguments she had with Aubrey and
Evelyn over text following their disagreements on August 9, 2017. She
showed to me all their text messages exchanges. I was angered when
she told my sister the following:

Hulam btaw ni papa kng edgar..Pero and sabot ato taga abot sa pension ni momy
bayaran xa tann atong 4k niya. Og pra masayod ka. Tann ato gkan to sa pension ni
momy og akoa. Nagbilin ko kwarta ni papa daan. Pirti nimong kaon noh? Too nimo
kay papa. Akoa to og pension sa akong inahan. Basi ganahan ka iluwa nmo
imong gikaon kay sakit mn kau sa imo basi magasto c papa sa akong inahan

c. That is why on August 11, 2017 at 2:44 in the afternoon, I texted my

father about Aubrey. There was no response from my father. At
around 7:00 oclock in the evening while I was inside my house I
received a text message however I found out that it was Aubrey who
texted it using my fathers cellphone. She arrived from Bansalan
together with her aunt Evelyn. Attached as ANNEXES B with
submarkings hereof are our text messages exchanges;
 d. At the outset, it must be emphasized that my father and I lived in the
same compound. My house which is our old family home is
approximately 2 meters from my fathers new house. When Aubrey
texted me ali diri referring to my fathers house, I immediately went
there. I saw Aubrey and her aunt inside. Thereafter, Aubrey started
shouting and pointing fingers at me several times. Out of anger
because I am older than her and she has no respect for me, I slapped
her hand in the act of stopping her but instead she grabbed my hand
and started pulling my hair together with her aunt. They also clawed
my chest;

e. My blood pressure rose and I felt confused and nauseated that I fell to
ground while the two continued pulling my hair. If not for the timely
intervention of my husband and niece Niel Dawn Jade Almacin, I
would have suffered an attack. Thereafter I went to the police station
and reported what happened. I also underwent a physical examination
of the injuries I have sustained. Copy of the extract blotter and the
medical certificate are hereto attached as ANNEX C and D
respectively;

f. Despite what happened between us, I was still hopeful that we can
settle our differences because in the first place we are siblings and I
was just waiting for her to ask forgiveness considering that she is my
younger sister. I was shocked when I found out that Aubrey
summoned me for a conference before the Punong Barangay of Zone II
but has no intention of settling the case in that level;

g. When I lodged a complaint before the same barangay, she never

appeared. Thus, on September 21, 2017 a certificate to file action was
issued in my favor which is hereto attached as ANNEX E;

4. I am executing this affidavit complaint in order to attest to the truth and

veracity of the foregoing statements and to charge Aubrey Almacin and
Evelyn Dizon for slight physical injuries defined and punished under the
Revised Penal Code.
