THE CODE OF CRIIMTNAL PROCEDURE (ANDHRA
PRADESH AMENDlMENT ) ACT, 1992.

Bc it enacted by the Legislative Assembly of the Stste of Andhrn
Pradesh in thc Forty Second Year of thc Republic of India as follows :-

1. Short title, exterlt and conmmerrcrnent.--(I ) This Act may be called


the Code of Criminal Procedure ( Andhra Przdesh Amendmnt) Act,
1992.

(2) It extends to the wholc of the State of Andhra Pradesh.


(3) It shall come into forcs on such date as .the State Governmeat
may, by notification in the Andhra Pradzsh Gazette, appoint.
2. Ame~~dmetzt of s~ction13, Act2 of1 374.-En thc Code of Criminal
Procedure.1 973 ( hereinnfter referred to as the Principal Act ) in Section
13, in sub-szction(2) for the words " not exceeding one yzrrr at a time 9 p
the words " not exceeding two-years at n time " shall be substituted and
to the said sub-section the following proviso, shall be added, zamely :-
"Provided that any person who is holding the Office of SpeeiaI
Judicial Magistrate at the .commencement of the &de of Crimina'
Procedure (Andhra Pradesh Amendment ) Act, 1 992 and has not corn1
. pIeted sixty five years of age shall continue to hold o6ce for a term of
two years from the date of his appointment ".

4 3. Amendment of section I 8.411Stction 18 of the Principal Act, in


sub-section ( 2 ) for the words " not exceeding one year at a time '' the
words " not exceeding two years at 2 time " shdl k substituted and to
the said sub-section the following proviso shall bc added, namely :-

PROCEBURX, 1973 ]IW ITS APPCLICATION TO THE STATE
OF ANDHRA PRADESH.
Be it enacted by the LeHslativc Assembly of the Statc of Andhra
Pradesh in the Forty-second Year of tbe Republic OF India as foI10ws :-
1. Short title. This Act may be called the Code of Criminal Pro-
cedure ( Andhra Pradesh seco nd Amendment ) Act, I 992.
Amendment ofFirst Sqhedule, Cet~rralAct 2 of 1974.-In the C o d e of
Criminal Procedure, I 973, in thc First Schedule, under the head@
captioned "1-Offences under the Tndian Penal Code ".-

3. The Codc of Criminal Proceduic ( Andhra Pradesh Amendment)
Act, 1987 Bepeal of Act 46 of 1987 is hereby repealed.

S REASONS

Under the 'provisions of sub-section { 2) to


section 167 of the Code of C r i m i n a l ~ r o c e d u r e ,
1973 an- accused p e r s o n , b e f o r e ' h e is relcssed
o n bail u n d e r the s a i d provisions, h2s to b e
produced once i n .every fifteen days before -
the Magistrate h a v i n g t h e jurisdiction for
authorising t h e detention of the accused
person in custody. I

2. The services of t h e m o s t of t h e
Policemen a r c utilised for e s c o r t i n g t h e
accused p e r s o n s ' f rorn various Central J a i l s ,
D i s t r i c t Jails i n the State t o the respective
C o u r t s and back, Inspite of d e p l o y i n g t h e
maximum number of P o l i cemen for the purpose ',

due to substantial Increase day by day in the


number of accused persons r,equired - to b e -.
produced befor tl the Courts, many prisoners
remain in the J a i l s unproducee before the
Courts and it i s also 6 a u s i n g much inconveni-
ence and dislocation of worx in the r o u t i n e

4 . To achieve the above o b j e c t i n v i e w ,
t h e G c v e n m e n t have decided t o amend the Code
of Criminal Procedure, 1973 in i t s a p p l i c a k i on
t~ t h e S t a t e of ~ n d h r aPradesh, s u i t a b l y .

STATEMENT OF OBJECTS riKO REASONS
The Chairpcson,A n d h Pmduh Women's Commission, has requested
to enhance thc maximum zmouot of n~aintcnanceprovidcd under sections
125 and 127 orthc Cnde oi Criminal Proccdurc, 1973 from k. S00/-10 Rs.
3,0001- as the salaries, wages and cost o f living of the people have increased
and also suggested an amcndmenl lo secilon 320 of the Code of Criminal
Procedure, 1973 by including section 498-A of the Indian Penal Code, 1860
in the Table in seclion 320 of [hc Codeof Criminal Pmcdure, I373 in order
to sustain the compromise arrivcd at by Lhe partics compounding :he OF
fence.
On a careful examination of he proposal, the Governemnl have de-
cided to amcnd the sections 125, I27 and 320 of the Codc of Criminal Pro-
e d u r e , 1973 in its application to U-IC Starc of Andllra Pradesh by enhancing
the maximum limit of maintcnancc payable lo the wife or children or par-
enls from Rs.SOW- to Rs:3,0001- and also to amend the scction 320 of tlie
said C d c , suitably.
This Bill seeks 10giveeffecl lo the above decisions.
