 STATEMENTOFPROBABLECAUSE

Complainanthasinvestigatedthefactsandcircumstancesofthisoffenseandbelievesthefollowing
establishesprobablecause:

ThatonSeptember26,2017,atapproximately1:39a.m.,OfficersRinehartandEriksonwiththeMetro
TransitPoliceDepartmentweretravelingeastboundonInterstate94southofLowryAvenue,inthecityof
Minneapolis,HennepinCounty,Minnesota,whentheycameuponadoublevehicleaccident.Officers
rusheduptothefirstvehicle,aToyotaCamry,MN378-JVGandobservedafemale,lateridentifiedas
D.R.M.,inthedriversseat.OfficerRinehartcheckedD.R.M.anddeterminedthatshewasdeceased.The
passenger,lateridentifiedasC.J.B.,wasremovedfromthevehicleandOfficerRinehartbeganperforming
CPR.ParamedicsfromNorthMemorialHospitalarrivedanddeterminedC.J.B.wasdeceased.The
secondvehicleinvolvedwasaBMW535,MN433-PWG.Thedriverofthatvehiclewaslateridentifiedas
QUOCTHANHTRAN,defendantherein.Officersremovedthedefendantfromthedriversseatand
renderedaid.Paramedicsarrivedandimmediatelyloadedthedefendantintoanambulanceandleftthe
scenetotreathisinjuries.

AcrashReconstructionistrespondedtothescene.Itwasdeterminedthatdefendantsvehiclewastraveling
thewrongwayonInterstate94whenthetwovehiclescollidedheadonwithnooffset.Thepointofimpact
waslocatedjustsouthofthefinalrestingpositionofbothcars.TheCamryhadspun180degreestotheleft
aftertheimpactandtheBMWhadspun90degreestotheleftaftertheimpact.TheBMWsrightrear
bumpergrazedthecentercementmedianbarrieraftertheimpact.

AblooddrawsearchwarrantwasobtainedandTrooperMillnesswenttoNorthMemorialHospitaltoobtain
abloodsamplefromthedefendant.Whilelookingforaproperveintodrawbloodfrom,TrooperMillness
couldsmelltheodorofanalcoholicbeveragecomingfromthedefendantspersonandnoticedthe
defendantseyeswereverybloodshot.Theresultsofthebloodanalysisarestillpending.

OnSeptember28,2017,SergeantSoliewiththeMinnesotaStatePatrolrevieweddowntownsurveillance
filmfromSeptember26,2017,andobservedthedefendantsBMWgoingthewrongwayonNorth4th
Streetfrom1stAvenueNorthat1:30a.m.andthengoingthewrongwaysouthboundontoInterstate94.

From the above sworn facts, and any supporting affidavits or supplemental sworn testimony, I, the Issuing Officer, have
determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendants arrest
or other lawful steps be taken to obtain Defendants appearance in court, or Defendants detention, if already in custody,
