PEOPLE OF THE PHILIPPINES VS.

NARITO DADLES

FACTS:

On May 24, 1989, at around 11pm, Dadles with five others arrived at the residence of Alipio
Tehidor, in Bgy. Amontay, Binalbagan, Negros Occidental. They tied the hands of Alipio and Dionisio.
When the wife protested, they said that they would free him if they will surrender the firearms of two
other sons who are members of the CAFGU. At around 11:30 at the same night, the group went to the
house of Alipan. Salvador and Antonio Alipan went with the group because they said that they merely
want to talk to them and will return them the next day. The four people who were taken disappeared.
Thus, charges were filed against the group. RTC of Negros Occidental convicted the accused of two
accounts of kidnapping and illegal serious detention.

ISSUE:

Whether the accused are guilty of the crime of kidnapping with illegal serious detention.

RULING:

No. As correctly pointed out by the OSG, there were indications showing criminal intent to deprive
victims of liberty. These are first, if they merely wanted to talk to the victims, they could have talked
inside the house; second, they could have returned them immediately as matters in the required
information may be elicited to them in few hours; third, if they do not have any ill motives, why is there
a need to warn the family not to report the incident to police authorities.

The court finds that the appellant is guilty beyond reasonable doubt of kidnapping the victims.
Salvador Alipan, Antoni Alipan, Alipio Tehidor and Dionisio Tehidor. However, since none of the
circumstances mentioned in Art. 267 of the RPC (kidnapping with serious illegal detention) was proved
and only the fact of kidnapping was established, this court finds the accused guilty only of slight illegal
detention.
