TECSON VS.

COURT OF APPEALS

FACTS:

The three agents of the Central Bank caught in an entrapment operation. Alejandro Tecson also
known as Mang Andy. The accused was caught in the act selling ten pieces of US $100 dollar notes.
During the investigation, the Currency Analysis and redemption Divisions of the Central Bank found that
the US $100 pieces were counterfeit; the accused denied any knowledge as to the source of the fake
dollar notes and claimed that the same was merely planted by the arresting officers. He was charged
and convicted of illegal possession and use of counterfeit US dollar notes.

ISSUE:

Whether or not the possession should be coupled with the intent to use the counterfeit dollar in order
to hold the accused liable under Article 168 of the RPC.

RULING:

Yes. Mere possession coupled with the intent to use the counterfeit US dollar notes as proven in the
case at bar, is sufficient to constitute the crime under Article 168 of the Revised Penal Code.
