Section 2. - It is mandated that the Provincial Health Office issue a certification to the owner / operator as to
the potability of the drinking water upon receipt of the laboratory test.
A. In the event that the samples are found to be contaminated or polluted, the owner / operator shall
be fined FIVE THOUSAND PESOS (Php 5,000.00) and the permit to operate shall be suspended
immediately until measures to correct operations is done to make their product fit for human
consumption.
B. Violation of Section 1 of this Ordinance shall be imposed with the following penalties:
a) 1st Offense - a fine of One Thousand Pesos (Php 1,000.00)
b) 2nd Offense - a fine of Two Thousand Pesos (Php 2,000.00)
c) 3rd Offense - a fine of Three Thousand Pesos (Php 3,000.00) or suspension of operations for
one (1) week.
Section 4. - No contest provision. Any person, individual, or entity who is apprehended or cited for violation
and who does not wish to contest the violation, and is willing to pay voluntarily the minimum fine imposed
upon him prior to the filing of formal charges with the proper court shall pay the said fine with the Provincial
Treasurer to avoid being criminally prosecuted.
ARTICLE III. REPEALING, SEPARABILITY AND EFECTIVITY CLAAUSES

Section 1. - Repealing Clause. All ordinances, resolutions, circulars, memoranda, or rules and regulations
inconsistent with the provisions of this Ordinance are hereby repealed and modified accordingly.
Section 2. - Separability Clause. If for any reason, any portion or provision of this Ordinance is declared
unconstitutional or invalid, the other sections or provisions hereof which are not affected thereby shall continue
to be in full force and effect.
Section 3. - Effectivity Clause. This Ordinance shall take effect upon compliance of the mandatory posting
and publication requirement prescribed under the Local Govt. Code of 1991 (Rep. Act No. 7160)
