FOREWORD BY THE
PRESIDENT

On behalf of the Dental Council and all registered dental


practitioners in Malaysia, I take this opportunity to express
our sincere appreciation to Dato Sri Dr Hasan Abdul Rahman,
the former Director General of Health Malaysia, for his
contributions to the Malaysian Dental Council in his capacity
as President from 11 March 2011 to 16 November 2012. I
have since assumed the position of the Director General of
Health Malaysia and hence the Presidentship of the MDC on
1 March 2013, and it is my pleasure to present the MDC
Annual Report for 2012.

Year 2012 saw the draft Dental Bill finalised by the Ad Hoc
Committee on Continuing Amendments to the Dental Act
1971, an effort begun in 2002 and which took more than 10
long years to complete. In August 2012, the Dental Bill was
successfully uploaded on the MOH webpage for public
engagement, the first Bill to be posted for public feedback.
On 22 November 2012, at the 99th MDC Meeting, the draft

Bill was finally approved by Council to include regulation of


Dental Therapists.

In year 2012, the MDC endorsed a number of documents on


dental education in Malaysia. Minimum qualifications for
entry into dental degree programmes were endorsed at the
98th MDC Meeting on 11 May 2012. The competencies
expected of new dental graduates were approved at the 99th
MDC Meeting on 18 August 2012. The MDC also strove for a
Moratorium on establishment of new Dental Degree
Programmes and new Dental Schools and justified a limit to
the number of students in local Institutions of Higher
Learning to the Ministry of Higher Education. The effort
continued into 2013.

In 2012, the number of local Universities with graduate


outputs increased from six in 2011 to nine. The three new
institutions were Universiti Islam Antarabangsa Malaysia
(UIAM), Universiti Sains Islam Malaysia (USIM) and MAHSA
University College (now MAHSA University). The Council
registered 613 new graduates in 2012, an increase of 47.7%
from 2011. Annual and Temporary Practising Certificates
issued rose by 7.0% compared to 2011. With rising number
of dental professionals, the CPD Awarding Committee also
received three times more applications for CPD forums in
2012 compared to 2011. In view of this increasing workload
and additional MDC functions proposed under the new
Dental Bill, the effort to acquire new premises and additional
staff for Council continues.

In 2012, the 97th MDC Meeting on 29 February 2012


endorsed the reduction of compulsory national service from
three to two years. This was subsequently presented to, and
approved by the Honourable Minister of Health Malaysia and
came into effect on 5 April 2012.

The Council was also actively involved in all discussions


pertaining to the finalisation of the Mutual Recognition
Agreement (MRA) for dentistry under the ASEAN Joint
Coordinating Committee on Dentistry (AJCCD) and in all
deliberations pertaining to offers under autonomous
liberalisation at the level of the Ministry of Health.

I take this opportunity to record my appreciation to all


Council members, to all members of the Preliminary Inquiry
Committees, members of the Ad Hoc Committee on
Amendments to the Dental Act 1971, and to all dental
officers and personnel of the Oral Health Division, Ministry of
Health for their efforts and contributions. I am confident that
the commitment shown by members and the Secretariat in
2012 will continue to face new and exciting challenges in the
forthcoming years.

ROLE AND FUNCTION OF


THE MALAYSIAN DENTAL COUNCIL

The Malaysian Dental Council (MDC) is established under the


Dental Act 1971. Its main role is to promote and ensure high
standards of professional conduct and practice among
registered dental practitioners.

The MDC was established in 1971. The principal functions


pertain to:

registration of dental practitioners in Malaysia


maintenance of the Malaysian Dental Register
issuance of Annual Practising Certificates and
Temporary Practising Certificates
education and training
upholding and maintenance of professional
standards and ethics in the practice of dentistry
exercising disciplinary jurisdiction over registered
practitioners who violate the Code of Professional
Conduct (CPC) or who commit an offence against the
Dental Act 1971.

MEMBERS OF THE
MALAYSIAN DENTAL COUNCIL

The Council has 24 members comprising elected and


appointed members. Every member must be a citizen of
Malaysia and in possession of a current practising certificate.
The tenure of membership is three years.

Under the provisions of the Dental Act 1971, the Director


General of Health Malaysia is the President, and the Principal
Director of Oral Health, Ministry of Health Malaysia is the
Registrar of the Council.

REGISTRATION

The Registrar is responsible for the maintenance of the


Dental Register, and to ensure that all processes are
undertaken in handling registration-related queries,
processing applications from practitioners who wish to
practise dentistry in Malaysia and issuance of Annual
Practising Certificates and Temporary Practising Certificates.

THE MALAYSIAN DENTAL REGISTER

Dental practitioners who hold qualifications that are


recognised or approved by the Council may be registered
with the MDC. The Malaysian Dental Register comprises two
Divisions:
Division I for professionals registered as dental surgeons
Division II for persons registered as dentists.

As at 31 December 2012, there were a total of 6,407 names


in the Dental Register; with 96% (6,130) under Division I.

Dentists registered under Division II are those with no formal


qualifications but who were practising dentistry before the
enforcement of the Dental Act 1971. They were allowed to
practise due to a shortage of qualified professionals at the
time. Division II was closed in 1972, with 277 registered.
There were only 33 dentists still active on 31 December 2012.

Practitioners are registered under 3 Sections under Division I


of the Register:
Section 12(1)
Section 12(3)
Section 12(9)

Section 12(1) ..a person shall be entitled to be registered ...if he


holds any of the qualifications specified [in the]...Second
Schedule (list of registrable dental qualifications under Section
12(1) of the Dental Act 1971)

At end of 2012, there were 151 recognised degrees under


Section 12(1) of the Dental Act 1971. Malaysians with these
qualifications may register without restriction. This list can be
viewed on the MDC website http://mdc.moh.gov.my

Section 12(3) ..a person shall be entitled to be registered as a


dental surgeon under this Act if he has obtained experience in the
practice of dentistry by engaging in employment in the practice of
dentistry to the satisfaction of the Director-General for a period of
not less than two years in...the public services...

Section 12(9) ..any person may be registered .....subject to such


restrictions and conditions as may be stipulated by the Minister.

NEW REGISTRANTS, 2012

In 2012, a total of 613 graduates registered with the Council.


This was a 47.7% increase from the 415 registered in 2011.
The majority were registered under Section 12(1) (Table 3).

A large majority were from local institutions, with 34.9%


(214) graduating from abroad (Figure 1). There was an
increase of 55.3% in local graduates compared to 2011 due
to the registration of the first batch of graduates from
Universiti Islam Antarabangsa Malaysia (UIAM), Universiti
Sains Islam Malaysia (USIM) and MAHSA University College.

New registrants with foreign qualifications were mainly from


Indonesia (33.6%), India (32.2%) and Jordan (18.2%) (Table
4). Many were registered under Section 12(1).

ANNUAL PRACTISING CERTIFICATES

Out of 6,407 names in Section 12(1) of the Register, only


4,591 (71.7%) applied for and were granted Annual Practising
Certificates (APC) in 2012. Efforts to trace the inactive
practitioners found that they had either migrated, were
retired or deceased.

An active registered practitioner needs to apply for an


Annual Practising Certificates (APC) to legally practise
dentistry in Malaysia. The onus is on the practitioner to apply
for the annual renewal and declaration of practising
address(es).

Upon receiving the completed application (Form 8), the


Council will grant the APC for a calender year ending 31
December. Practitioners are required to display their current
APC at each of their practise premises.

In 2012, there was an increase of 7.0% (4,591) in the number


of APCs issued compared to 2011 (Table 5). The majority of
APC (58.0%) were issued to practitioners in the public sector.

TEMPORARY PRACTISING CERTIFICATES

Section 14 of the Dental Act 1971 provides for the issue of


Temporary Practising Certificates (TPC) to practitioners
registered outside Malaysia who wish to practise in Malaysia.

In June 2012, Malaysia opened 12 service sectors including


healthcare services, under the autonomous liberalization of
services in the country. Foreign medical and dental specialists
are now allowed to be employed in private hospitals. For
dental specialists, approval is subject to recognition of
specialty qualifications by the National Specialist Register. In
2012, the MDC approved one application by a foreign dental
specialist.

Applicants for TPCs can be classified into six broad


categories:
1. Foreign dental practitioners who visit Malaysia to
conduct short hands-on courses or to participate in
exchange programmes
2. External examiners
3. Foreign lecturers employed in dental faculties of local
institutions of higher education or in foreign institutions
of higher education with branch campuses in Malaysia
4. Foreign contract officers in the government service
5. Foreign post-graduate students in clinical disciplines in
dental faculties of institutions of higher education.
6. Foreign specialists employed in private hospitals.

Under unusual circumstances, for example during mass


disasters, applications from practitioners can be approved by
the President of the MDC in consultation with the Registrar.

The Council issued 257 TPCs in 2012, with 155 (60.3%) issued
to academic staffs both in the public and private sectors. This
was followed by contract officers in institutions of higher
education (63), post-graduate students (21), foreign lecturers
invited for short hands-on courses (11), external examiners
(6) and foreign specialist in private hospital (1).

EDUCATION AND TRAINING

The Council ensures that dental education programmes


offered locally and abroad meet the standards and
requirements set by the Council and the Malaysian
Qualification Agency (MQA). The Council is also responsible
to ensure that graduates holding non-registrable
qualifications meet the criteria set by the Council before they
can be registered.

There are two permanent committees under the Council:


The Joint Technical Committee for Accreditation of Dental
Programmes; and
The Dental Evaluation Committee

Joint Technical Committee for Accreditation of Dental


Programmes

The Joint Technical Committee for Accreditation of Dental


Programmes is responsible for monitoring of all dental
professional and auxiliary programmes in the country. The
Committee also considers standards of programmes offered
abroad when called for. The Committee consists of
representatives from different agencies involved directly in
accreditation of education programmes:

Terms of References include evaluating new dental


programmes and continuous monitoring of accredited dental
programmes and dental institutions. The recommendations
of the committee are then presented to Council for approval.

The committee made several recommendations to the


Council in 2012 (Table 6).

Dental Evaluation Committee

The Registrar is the Chairman of the Dental Evaluation


Committee. There are 4 members of the Council. The main
function is to evaluate and make recommendations to
Council on the following:
applications for registration from graduates of
universities not listed in the Second Schedule of the
Dental Act 1971
applications for change of name from institutions or
for degrees listed in the Second Schedule of the
Dental Act 1971.

The 2010 criteria for approval of applications from graduates


holding non-registrable qualifications were revised in 2012.
The revised criteria take into account the approved
qualifications listed under Sections 12(3) and 12(9). The
committee received 10 applications for registration in 2012.

One candidate sat for and passed the Qualifying Examination


held by the Universiti Sains Malaysia in September 2012 and
was registered under Section 12(5) in November 2012.

The committee held three meetings in 2012 and


recommended to the Council the following:
five applicants under Section 12(3) to undergo 2
years of training under the Ministry of Health
Two applicants to be allowed to register under
Section 12(5)

One applicant to be allowed to register under Section


12(9) and to undergo one year of close supervision
Two applicants to be allowed to register straight
under Section 12(9).

In 2012, three of the applicants recommended held


qualifications from India, two each from China and Russia
and one each from Taiwan, the Philippines and the Republic
of Lithuania.

In 2012, the Council also approved the following:


Additional criteria for the establishment of new
dental programmes effective from 29 February 2012
Approval for the minimum qualifications for entry
into dental programmes effective from 11 May 2012.
Applications from institutions to increase student
intake to be considered only after the first batch
graduate, effective from 23 November 2013.

ETHICS AND PROFESSIONAL STANDARDS

The Council has an obligation to ensure that professional


ethics and standards are upheld and maintained by all
practitioners. This function is carried out by the Preliminary
Investigation Committees and the Continuing Professional
Development (CPD) Awarding Committee.

Preliminary Investigation Committees

These committees are set up under Section 24 of the Dental


Regulations 1976. There were two Preliminary Investigation
Committees (PIC) under the Council in 2012.

The function of the committees is to conduct preliminary


investigations into complaints or information on disciplinary
matters brought against registered practitioners. The
committees make recommendations to the Council to either
close the case with no further action against the practitioner
or for the Council to conduct an inquiry.

The Council received 12 complaints in 2012 and 63.6% of the


complaints pertained to unethical behaviour (Table 7).

PIC 1 held 32 sessions for investigations in 2012 while PIC 2

The Council held 10 inquiry sessions into three cases in 2012


and successfully closed two. One practitioner was
reprimanded and one was suspended for six months. On 31
December 2012, the Council still had three active cases. In
total, there were nine active cases brought forward to 2013
at PIC and Council levels.

The main function of the committee is to evaluate and


approve applications for Continuing Professional
Development (CPD) points. In 2012, the Committee received
76 applications from CPD providers for verification and award
of points.

ENFORCEMENT UNDER THE DENTAL ACT 1971

Mandatory 3-Year Public Sector Service

Activation of Part VII of the Dental Act 1971 imposed the


need for every new registrant on or after 29 June 2001 to
undergo a 3-year period of service in the MOH or in any
public sector agency/institution approved by the Director-
General of Health Malaysia.

The Minister of Health under Section 49 of the Dental Act


1971 has the prerogative to postpone, or reduce the duration
of, or exempt a practitioner from the compulsory service. On
5 April 2012, following the Ministers announcement, the
period of compulsory service was reduced to 2 years.
Registrations before 5 April 2012 are still required to fulfil the
3-year period.

There were two new registrants who failed to start their


compulsory service (Table 9). They have applied for and have
been granted permission by the Minister to postpone the
commencement of their compulsory service.

In 2012, six dental practitioners were granted permission to


either start or continue their period of compulsory service in
the Ministry of Higher Education.

Other Activities Regulating Dental Practice

Enforcement activities are undertaken by the Ministry of


Health Malaysia. This covers the inspection of premises of
Dentists (Division II).

By 31 December 2012, of the 36 active Division II


practitioners in 2011, only 33 were allowed to continue
practice.

OTHER MDC ACTIVITIES, 2012

Dental Practitioners Information Management System


(DPIMS)

DPIMS is the on-line database system for dental


practitioners, which can be accessed at
http://dpims.moh.gov.my/. The system successfully
incorporated the online payment transaction module in
2012. The module is the result of a collaboration between
the Ministry of Health and the Malaysian Administrative
Modernisation and Management Planning Unit (MAMPU)
using MyBayar.

DPIMS was also involved in the myHealth apps project which


went-live on 30 June 2012. This application allows users
quick and easy access to healthcare information through
their smart devices, including smartphones. Hence, the public
can access information on any active practitioner, including
their practising addresses.

Seminar Future Legislation in Dentistry

This seminar, initiated by the Malaysian Dental Council, was


held from 20 - 21 October 2012 at Cyberview Lodge Resort
and Spa, Cyberjaya. The two-day seminar was attended by 40
participants, including Council members, Enforcement

officers from the Oral Health Division and representatives


from the Dental Nurses Association.

The main objectives of the seminar were 1) to raise the


participants awareness on the amendments to the Dental
Act 1971 and the impact these might have on legislation
procedures and guidelines, and 2) to disseminate information
regarding the amendments before tabling of the new Dental
Bill in Parliament. In addition, a session was held on methods
of handling inquiries and complaints, aimed at giving
participants a different perspective on the matter.

THE FUTURE

New Premises

The MDC was allocated Levels 2 and 3 of Block D, Ministry of


Health, at Jalan Cenderasari on 5 March 2012. The first phase
of the renovation project started off with space clearance in
November 2012, carried out by the Malaysian Public Works
Department of Kuala Lumpur. This costs the MDC a total of
RM161,470.00. The second phase of structure repair will
continue in 2013.

Future Challenges

The MDC will be responsible for the registration of dental


specialists under the new Specialist Division. As autonomous
liberalization began in June 2012, the MDC is setting up new
permanent committees to handle the conduct of Professional
Qualifying Examination and evaluation of dental specialists.

In line with the new Dental Bill, the MDC is preparing for the
first-time incorporation of Dental Therapists under the same
Act and the implementation of the new section on
Enforcement.

The much-awaited new database of practitioners for on-line


application, approval and payment with links to the
Enforcement Unit of the Ministry of Health, and the linkage

between Continuous Professional Development (CPD) points


and APC renewal, will result in more systematic, efficient and
user-friendly services.
