BY -LAW NO. 2013 -7352

BEING A BY -LAW to authorize the Corporation of the City of Timmins to enter into an

agreement with Genivar Ontario Inc. for consulting services respecting the painting and coating

of the Hollinger Standpipe, in the City of Timmins.

WHEREAS the Council of The Corporation of the City of Timmins considers it desirable to enter

into an agreement with Genivar Ontario Inc.

NOW THEREFORE the Council of The Corporation of the City of Timmins enacts the following

as a By -law:

1. THAT the Corporation of the City of Timmins enter into an agreement with Genivar

Ontario Inc. respecting the painting and coating of the Hollinger Standpipe, in the City of

Timmins, a copy of which agreement is attached hereto and marked as Schedule "A" to

this By -law, for a total cost of $77, 455. 00 plus HST.

2. THAT the Mayor and Clerk be and are hereby authorized to execute the said agreement

on behalf of the Corporation and to affix thereto the Official Seal of the Corporation.

MEMORANDUM OF AGREEMENT dated the 10th day of April

Hereinafter called the ' Client'


THE PARTY OF THE FIRST PART

Hereinafter called the ' Consultant'

WHEREAS the Client intends to

hereinafter called the ' Project' and has requested the Consultant to furnish professional services in
connection therewith;

NOW THEREFORE WITNESSETH that in consideration of the covenants contained herein, the Client
and the Consultant mutually agree as follows:

ARTICLE 1 - GENERAL CONDITIONS

1. 01 Retainer

The Client hereby retains the services of the Consultant in connection with the Project and the
Consultant hereby agrees to provide the services described herein under the general direction and
control of the Client.

In this Agreement the word Consultant shall mean professionals and other specialists engaged by the
Client directly and whose names are party to this Agreement.

1. 02 Services

The services to be provided by the Consultant and by the Client for the Project are set forth in Article 2
and such services as changed, altered or added to under Section 1. 08 are hereinafter called the
Services'.

1. 03 Compensation

The Client shall pay the Consultant in accordance with the provisions set forth in Article 3. For
purposes of this agreement, the basis of payment shall be as specified in Articles 3. 2. 2 and 3. 2. 4.

1. 04 Staff and Methods

The Consultant shall perform the services under this agreement with that degree of care, skill and
diligence normally provided in the performance of such services as contemplated by the agreement at
the time such services are rendered and as required by the Professional Engineers Act ( RSO 1990,
Chapter P. 28) and regulations therein. The Consultant shall employ only competent staff who will be
under the supervision of a senior member of the Consultant's staff.

1. 05 Drawings and Documents

Subject to Section 3. 2. 4 of Article 3, drawings and documents or copies thereof required for the
Project shall be exchanged between the parties on a reciprocal basis. Documents prepared by the
Consultant for the Client, including record drawings, may be used by the Client, for the Project herein
described. In accordance with Article 1. 06, the client indemnifies the Consultant for unauthorized use
of the documents and deliverables.

1. 06 Intellectual Property

All concepts, products or processes produced by or resulting from the Services rendered by the
Consultant in connection with the Project, or which are otherwise developed or first reduced to
practice by the Consultant in the performance of his Services, and which are patentable, capable of
trademark or otherwise, shall be considered as Intellectual Property and remain the property of the
Consultant.

The Client shall have permanent non -exclusive royalty -free license to use any concept, product or
process, which is patentable, capable of trademark or otherwise produced by or resulting from the
Services rendered by the Consultant in connection with the Project and for no other purpose or
project.

1. 07 Records and Audit

a) In order to provide data for the calculation of fees on a time basis, the Consultant shall keep
a detailed record of the hours worked by staff employed for the Project.

b) The Client may inspect timesheets and record of expenses and disbursements of the
Consultant during regular office hours with respect to any item which the Client is required to
pay on a time scale or disbursement basis as a result of this Agreement.

c) The Consultant, when requested by the Client, shall provide copies of receipts with respect to
any disbursement for which the Consultant claims payment under this Agreement.

1. 08 Changes and Alterations and Additional Services

With the consent of the Consultant the Client may in writing at any time after the execution of the
Agreement or the commencement of the Services delete, extend, increase, vary or otherwise alter the
Services forming the subject of the Agreement, and if such action by the Client necessitates additional
staff or services, the Consultant shall be paid in accordance with Section 3. 2. 1 for such additional staff
employed directly thereon, together with such expenses and disbursements as allowed under Section
3. 2. 4. In the event that the client delays the project then the Consultant shall have the right to
renegotiate the Agreement.

1. 09 Suspension or Termination

Either party may at any time by notice in writing to the other party, suspend or terminate the Services
or any portion thereof at any stage of the project. Upon receipt of such written notice, the Consultant
shall perform no further Services other than those reasonably necessary to close out his Services. In
such an event, the Consultant shall be entitled to payment in accordance with Section 3. 2. for any of
the Consultant's staff employed directly thereon together with such expenses and disbursements
allowed under Section 3. 2.

If the Consultant is practicing as an individual and dies before his Services have been completed, this
Agreement shall terminate as of the date of his death, and the Client shall pay for the Services
rendered and disbursements incurred by the Consultant to the date of such termination.

1. 10 Indemnification

The Consultant shall indemnify and save harmless the Client from and against all claims, actions,
losses, expenses, costs or damages of every nature and kind whatsoever which the Client, his
employees, officers or agents may suffer, to the extent the Consultant is legally liable as a result of the
negligent acts of the Consultant, his employees, officers or agents in the performance of this
Agreement.

The Client agrees to hold harmless, indemnify and defend the Consultant from and against any and all
claim, losses, damages, liability and costs of defense arising out of or in any way connected with the
presence, discharge, release or escape of contaminants of any kind, excluding only such liability as
may arise out of the negligent acts of the Consultant in the performance of consulting services to the
Client within this project.

1. 11 Insurance

The Client will accept the insurance coverage amount specified in this clause section ( a) as the
aggregate limit of liability of the Consultant and its employees for the Client' s damages.

a) Comprehensive General Liability and Automobile Insurance

The Insurance Coverage shall be $ 2, 000,000 per occurrence and in the aggregate for
general liability and $ 2 000 000 for automobile insurance. When requested, the
Consultant shall provide the Client with proof of Comprehensive General Liability and
Automobile Insurance ( Inclusive Limits) for both owned and non -owned vehicles.

b) Professional Liability Insurance

The Insurance Coverage shall be in the amount of $ 2 000, 000 per claim and in the
aggregate. When requested, the Consultant shall provide to the Client proof of Professional
Liability Insurance carried by the Consultant, and in accordance with the Professional
Engineers Act ( RSO 1990, Chapter P. 28) and regulations therein.

c) Change in Coverage

If the Client requests to have the amount of coverage increased or to obtain other special
insurance for this Project then the Consultant shall endeavour forthwith to obtain such
increased or special insurance at the Client' s expense as a disbursement allowed under
Section 3. 2.

It is understood and agreed that the coverage provided by these policies will not be changed
or amended in any way nor cancelled by the Consultant until sixty (60) days after written
notice of such change or cancellations has been personally delivered to the Client.
1. 12 Contracting for Construction

Neither the Consultant nor any person, firm or corporation associated or affiliated with or subsidiary to
the Consultant shall tender for the construction of the Project, or have an interest either directly or
indirectly in the construction of the Project.

1. 13 Assignment

Neither party may assign this Agreement without the prior consent in writing of the other.
1. 14 Previous Agreements

This Agreement supersedes all previous agreements, arrangements or understandings between the
parties whether written or oral in connection with or incidental to the Project.

1. 15 Approval by Other Authorities

Unless otherwise provided in this Agreement, where the work of the Consultant is subject to the
approval or review of an authority, department of government, or agency other than the Client, such
applications for approval or review shall be the responsibility of the Consultant, but shall be submitted
through the offices of the Client and unless authorized by the Client in writing, such applications for
approval or review shall not be obtained by direct contact by the Consultant with such other authority,
department of government or agency.
1. 16 Principals and Executives

The use of Principals and Executives on a time basis by the Consultant will be in accordance with
Section 1. 23. 1 ( c).

1. 17 Sub- Consultants

The Consultant may engage others as sub -consultants for specialized services provided that prior
approval is obtained, in writing, from the Client and may add a mark -up of not more than 5% of the
cost of such services to cover office administration costs when claiming reimbursement from the Client
plus the cost of the additional insurance incurred by the Consultant for the specialized services.
1. 18 Inspection

The client, or persons authorized by the Client, shall have the right, at all reasonable times, to inspect
or otherwise review the Services performed, or being performed, under the Project and the premises
where they are being performed.
1. 19 Publication

The Consultant agrees to obtain the consent in writing of the Client before publishing or issuing any
information regarding the Project.

1. 20 Confidential Data

The Consultant shall not divulge any specific information identified as confidential, communicated to or
acquired by him, or disclosed by the client in the course of carrying out the Services provided for
herein. These obligations of confidentiality shall not apply to information which is in the public domain,
which is provided to the Consultant by a third party without obligation of confidentiality which is
independently developed by the Consultant without access to the Client' s information, or which is
required to be disclosed by law or by court order. No such information shall be used by the Consultant
on any other project without the approval in writing of the client.

1. 21 Dispute Resolution

a) If requested in writing by either the Client or the Consultant, the Client and the Consultant
shall attempt to resolve any dispute between them arising out of or in connection with this
Agreement by entering into structured non -binding negotiations with the assistance of a
mediator on a without prejudice basis. The mediator shall be appointed by agreement of the
parties. If a dispute cannot be settled within a period of ninety (90) calendar days with the
mediator, the dispute shall be referred to and finally resolved by arbitration under the rules of
the province having jurisdiction or by an arbitrator appointed by the agreement of the parties.
b) No person shall be appointed to act as mediator or arbitrator who is in any way interested,
financially or otherwise, in the conduct of the work on the Project or in the business or other
affairs of either the Client or the Consultant.

c) The award of the arbitrator, including an award for costs if applicable, shall be final and
binding upon the parties.

d) The provisions of The Arbitration' s Act, R. S. O., 1991, Chapter 17, as amended shall apply.

1. 22 Time

The Consultant shall perform the Services expeditiously to meet the requirements of the Client and
shall complete any portion or portions of the Services in such order as the Client may require..
The Client shall give due consideration to all designs, drawings, plans, specifications, reports, tenders,
proposals and other information submitted by the Consultant, and shall make any decisions which he
is required to make in connection therewith within a reasonable time so as not to delay the work of the
Consultant.

1. 23 Estimates, Schedules and Staff List

1. 23. 1 Preparation of Estimate of Fees, Schedule of Progress and Staff List

When requested by the Client, and where payment is calculated on a time basis, the Consultant shall
provide, for approval by the Client:

a) An estimate of the total fees to be paid for the Services.

b) A Schedule showing an estimate of the portion of the Services to be completed in each


month and an estimate of the portion of the fee which will be payable for each such month.

c) A Staff list showing the number, classifications and hourly rate ranges for staff, Principals and
Executives, for which the Consultant will seek payment on a time basis. The Consultant shall
relate such information to the particular type of work that such staff is to perform, while
employed on the Project. Such list shall designate the member of the Consultant's staff who
is to be the liaison person between the Consultant and the Client.

1. 23. 2 Subsequent Changes in the Estimate of Fees, Schedule of Prowess and Staff List

The Consultant will require prior written approval, from the Client for any of the following changes:

a) Any increase in the estimated fees beyond those approved under Subsection 1. 23. 1 ( a).
b) Any change in the schedule at progress which results in a longer period than provided in
Subsection 1. 23. 1 ( b).

c) Any change in the number, classification and hourly rate ranges of the staff provided under
Subsection 1. 23. 1 ( c).

1. 23. 3 Monthly Reporting of Progress

When requested by the Client, the Consultant shall provide the Client with a written report showing the
portion of the Services completed in the preceding month.

ARTICLE 2 - SERVICES

2. 01 Services to be provided by Consultant

The services to be provided by Consultant for the completion of the Tender Development for Painting /Coating
the Hollinger Standpipe Reservoir are as described in, and in accordance with, the City' s Request for Proposal
ENG- 2013 -01 for Engineering Services for the Tender Development for Painting /Coating Hollinger Standpipe
Reservoir, issued January 21 , 2013 and GENIVAR Inc.' s Proposal ( P13- 99999 -95) dated February 14, 2013.
The aforementioned GENIVAR Inc. Proposal is incorporated by reference in this Agreement, as if written in full
in this paragraph.

2. 02 Services to be provided by Client

The services to be provided by Client for the completion of the Tender Development for Painting /Coating the
Hollinger Standpipe Reservoir are as described in, and in accordance with, the City' s Request for Proposal
ENG- 2013 -01 for Engineering Services for the Tender Development for Painting /Coating Hollinger Standpipe
Reservoir, issued January 21 t, 2013. The aforementioned City Request for Proposal ENG -2013 -01 is
incorporated by reference in this Agreement, as if written in full in this paragraph.

ARTICLE 3 - FEES AND DISBURSEMENTS

3. 1 Definitions

For the purpose of this Agreement, the following definitions shall apply:

a) Cost of the Work:

i) The " Cost of the Work" shall mean the total cost of the Project including all materials,
equipment, sales taxes, labour and contractor' s overhead and profit, necessary to
complete the work for which the Consultant prepares designs, drawings or specifications,
for which he is responsible. Where sales taxes are not included in the cost of the work,
the fee shall be adjusted upwards by the factor equivalent to the sales taxes. The
adjusted fee may be computed to the nearest one -tenth of one percent ( 1/ 10 %).

ii) Wherever the client furnishes labour or other service which is incorporated in the work, the
current price of labour or other service when the work was executed shall be used to
compute the Cost of the Work.

iii) Whenever used materials or equipment is furnished by or on behalf of the Client, the fair
market value of such materials or equipment, as though it was purchased new, shall be
used to compute the Cost of the Work.

iv) In computing the Cost of the Work, no deductions shall be made on account of any
penalties or damages claimed by the Client from any contractor or on account of any other
sum withheld from any contractor.

v) The Cost of the Work shall not include any fees and disbursements due to the Consultant,
the Client' s engineering and office expenses, or cost of land.

b) Site:

Site includes the actual work site and other locations where the checking of materials, equipment
and workmanship is carried out.

3. 2. 2 Fees Calculated on a Time Basis

The Client shall pay the Consultant a fee, calculated on a time basis, up to a maximum of the Upset
Cost Limit, per the Consultants proposal referred to in Article 2. Fees on a time basis for all staff shall
be hourly rates as outlined in the Consultants proposal referred to in Article 2.

3. 2. 2. 2 Time Expended

All time expended on the assignment, whether in the Consultant's office, at the Client's premises, or
elsewhere, and including travel time, shall be chargeable up to the Upset Cost Limit per the
Consultants proposal referred to in Article 2. This also includes, but is not limited to, stenographic and
clerical staff engaged in the preparation of documents such as reports and specifications.

3. 2. 4 Reimbursable Expenses

In addition to the fee, the Consultant shall be reimbursed at cost plus an administrative charge of 5%,
plus the cost of additional insurance incurred by the Consultant, for all expenses properly incurred by
him in connection with the project, including but not limited to: vehicle use charges, travelling and
living expenses, long distance telephone charges, facsimile transmission charges, printing and
reproductions, progress photography, advertising for tenders, special delivery and express charges,
overtime premium costs, and the cost of providing and maintaining site offices, supplies and
equipment, chemical and physical tests. Reimbursable Expenses will not exceed the Upset Cost Limit
provided in the Disbursements section of the Fee Schedule in the Consultants proposal referred to in
Article 2.

3. 3 Payment

3. 3. 1 Fees Calculated on a Time Basis

The Consultant shall submit an invoice to the Client for all Services completed in the immediately
preceding month. Interest at the annual rate of 3 percent (0. 25 percent monthly) will be paid on the
total outstanding unpaid balance commencing 30 days after the Client has received the Consultant's
invoice.

Technical Proposal

Dear Mr. Watson:

GENIVAR is pleased to respond to the City's Request for Proposal ENG- 2013 -01 for Engineering
Services for Tender Development for Painting /Coating the Hollinger Standpipe Reservoir. Enclosed are
six ( 6) hardcopies of our Technical Proposal and two ( 2) copies of our Financial Proposal for the City' s
consideration. Our proposal was prepared in accordance with the Request For Proposal ( RFP) and
Addendum No. 1.

The project will be delivered from GENIVAR's Markham and Timmins offices, and will be led by Alec
Cranmer as the overall Project Manager and Cory Goulet from our Timmins Office as the Contract
Administrator and Site Inspector. Alec Cranmer has designed and constructed numerous elevated
water tanks and is familiar with all aspects of tank design regulations, best practices and coatings. Our
proposed expert sub -consultant for the coating systems analysis, contractor pre -qualification and
development of contract specifications will be Jim Stone of G. L. Stone Consulting Ltd.
GENIVAR is also pleased to have the opportunity to include some additional information regarding the
importance of tank mixing. The primary challenge of any distribution system reservoir is to ensure
adequate mixing and turnover to minimize the loss of disinfectant residual and maintain water quality. As
an industry -leader in 3D- hydraulic modeling, GENIVAR is able to simulate the mixing patterns in any
shaped tank and design a mixing system which will optimize daily tank drawdown and ensure water
quality is maintained.
We welcome the opportunity to assist the City in this project and our Team will be dedicated to the project
for its duration.

1. INTR DUCTION
1. 1 Background and Understanding of the Project
The 10. 5 ML Hollinger Standpipe, constructed in 1970, is centrally located in the City of Timmins. The
18. 2 m ( 60 ft) diameter and 39. 6 m ( 130 ft) high steel tank is the only floating water storage in the City.
The Standpipe was last painted in 1992 and the interior and exterior coatings are in need of replacement.
The City is therefore requesting proposals from engineering consulting firms to assist them with the
development of Tender Documents to re -coat the tank as well as assist them in pre -qualifying and
selecting a contractor to complete the work. The City will be an active member of the design and tender
process and the project is to be completed as a joint City -Consultant cooperative effort.
The available volume of this reservoir provides critical water storage to the City and its temporary removal
from service will significantly impact the City' s ability to provide water during peak demand periods.
Therefore, shutdowns and maintenance periods must be well planned and with a suitable contingency
plan.

The scope of work described in the Request For Proposals ( RFP) includes a Technical Report to review
alternative coating systems, pre -qualification of contractors, tendering, construction contract
administration and coating system inspections. GENIVAR's expertise in both new and retrofit tank design
and construction, our overall coatings knowledge, and our attention to detail will ensure that the City
achieves its goal of ensuring a sufficient, secure and reliable source of drinking water to its residents and
businesses.

2. CORPORATE PROFILE AND EXPERIENCE

The proposed Team Members have worked together in various capacities on numerous projects, most
recently on the Kitchener -Waterloo Zone 6 Elevated Tank, currently under construction.

Our proposed sub -consultant coatings expert is G. L. Stone G. L. Stone Consulting Ltd.
Consulting Ltd. ( GLS). Founded in 1969, the GLS consultants PROTECTIVE COATINGS CONSULTANTS
QUALITY ASSURANCE INSPECTORS
are active members of the National Association of Corrosion
Engineers ( NACE) and the Society for Protective Coatings ( SPC) and have extensive knowledge of
coatings chemistry to specify the correct products for each application. GLS have been involved in over
200 water tank projects, including recent elevated tanks in Waterloo, Toronto, York Region, Hamilton,
Halton Region and Kingston. Additional corporate information can be found in Appendix A.

GENIVAR and GLS have successfully collaborated on numerous elevated tank projects, for both new
tanks and recoating projects. Our close relationship will provide the City with a seamlessly integrated
project team, who are committed to dedicating their expertise and enthusiasm to achieve the project
goals.

2. 1 Project Team Organizational Structure


The Project Team' s extensive experience in successfully executing new and recoating elevated tank
projects provides us with a sound understanding of the various issues that can arise during the planning,
design and construction of this type of infrastructure. Our team members are fully versed with Provincial
regulations, alternative construction methodologies, and new and innovative products and materials. The
Project Team Organizational Chart is included in Appendix E and Project Profiles are included in
Appendix B.

Our proposed Project Manager, Alec Cranmer, has worked on several recent elevated tank projects.
Through the detailed design of numerous composite elevated tanks throughout Ontario, Alec has
developed intimate technical and practical knowledge of the latest applicable design standards,
construction methods and operational features available to the owner, including tank coating
requirements, mixing systems to maintain water quality, and safety devices to simplify operations and
minimize maintenance efforts.

GENIVAR' s QA/QC lead for this project, Ron Cariglia, is Director of GENIVAR's Structural Department
and is our resident coatings expert. Ron has worked on a numerous structural steel and concrete
projects where protective coatings are required. His coatings experience also extends into other sectors
such as mining and hydro -electric generation where the extended life of structures is also critically
important. His strategic input at various stages of the project will ensure quality submissions.
Our proposed coatings sub -consultant is Jim Stone from G. L. Stone Consulting Ltd. ( GLS), who will be
responsible for providing technical expertise in tank coatings and will assist with the technical report on
coating systems, development of the coating system specifications, assist with contractor pre -qualification
and provide coating shop drawing reviews prior to construction.
2. 2 Project Manager

Alec Cranmer, M.A.Sc., P. Eng. is a Discipline Lead Water Infrastructure at GENIVAR with over 15
years of experience in all aspects of project management, environmental assessment, approvals,
planning, process evaluation, condition assessment, detailed facility and process design, approvals,
construction contract administration, supervision during construction and commissioning of projects. Alec
has successfully designed and constructed numerous water storage reservoirs, water treatment facilities,
pumping stations, watermains, sewers and forcemains during his career; however, more particularly, he
has also successfully designed, administered, managed and commissioned numerous elevated tank
projects throughout the province.

Alec is experienced in leading and managing multi -disciplined teams and has proven his leadership,
communication and technical skills on the design and construction of the following recent elevated tank
projects:

QA/ QC requirements as outlined in this proposal.

Ron Cariglia, P.Eng. Ron has over 12 years of civil /structural engineering, project management and
QA/ QC Auditor construction experience in industrial, municipal, utilities and building projects, working
within the water resources, process, commercial, energy and development industries.
Ron has undertaken a number of coating system studies and will use his experience in
the structural design of municipal water storage facilities and elevated tanks, and past
experience investigating coatings to review and evaluate the various coating systems.

Phillip Saudino, P. Eng. A native of Timmins, Phil is a Project Engineer with over 10 years of engineering service
and has managed water and wastewater projects for various municipal clients. He has

been responsible for the completion of water treatment plant upgrades, hydraulic
Process Design,
Permits and Approvals modeling studies, transmission main design, and pumping station design and
construction. He has worked on projects from conceptual design through to detailed
design, construction, start-up and commissioning. As Project Coordinator, Phil will be
involved in all aspects of the project and will ensure the multidisciplinary team work
closely together to achieve the project objectives. He will assist Alec Cranmer as required,
assuming the PM role as required in Alec' s absence thereby ensuring the City has a key
point of contact at all time.

Cory Goulet, E. I. T. Cory is a Project Manager in our local Timmins office with 7 years of inspection and
contract administration experience on various multi -million dollar projects for private,
Construction Contract
Administration & municipal and provincial clients. Cory has experience in the inspection and monitoring of
Structural Site sandblasting, including the applications of protective coatings on MTO bridge projects in
Inspection the Southern -Ontario region, including the Burlington Bay Skyway Bridge. Cory' s most
recent contract administration and inspection projects for the City of Timmins include the
City of Timmins Airport Parking Lot Expansion Project and Phase I of the McChesney
Sewer Project.

H. J. Stone Jim is President of G. L. Stone Consulting Ltd. and has worked on numerous elevated
NACE 111 Coatings tank and standpipe recoating projects. As President and Technical Director, Jim is
Inspector responsible for supervision of inspection projects, performing failure analysis and
SSPC Certified
troubleshooting, specification writing and Quality Assurance /Quality Control inspection.

GENIVAR has a robust team of designers, CAD technicians, and other technical support professionals
who will be ready and able to assist with any existing or additional project requirement at short notice.
GENIVAR commits to the City that all members of our Project Team for this assignment will be available
and committed to work on this Project as indicated in our Team Organizational Chart included with this
submission. GENIVAR is not aware of any potential conflict of interest by any members of the Project
Team at the time of this submission.

2. 4 Relevant Project Experience and References

Our Project Team has demonstrated a long history of successfully completing many elevated tank re-
coating projects. Descriptions of some of the most recent elevated tanks completed by members of our
design team are as follows:

Kitchener -Waterloo Zone 6 Elevated Tank Detailed Design and Contract


Administration, Region of Waterloo Tendered 2012, currently under
construction

Alec Cranmer is the Project Manager and Design Engineer responsible for the
detailed design and construction contract administration for a 7. 2 ML elevated
tank located in the City of Waterloo to service both Kitchener Zone 6 and
Waterloo Zone 6. Design features include separate Valve, Electrical and
Chemical rooms inside the support pedestal, a washroom, separate inlet and
outlet risers process valves, overflow piping including a detention pond, a re-
circulation pump and passive tank mixing system, chlorine residual and flow
monitoring equipment, a top -up chlorination system and internal and external
protective tank coatings. Public consultation prior to construction included a
presentation and Public Information Session.

As part of this assignment, a coatings workshop was conducted with the coatings manufacturer,
applicator, and the Region' s Management and Operations staff to develop a coatings evaluation matrix to
determine the most appropriate coatings options for the Region.

Rouge Tank Exterior and Interior Painting, Safety Upgrades and Modifications
Scarborough, ON

Ron Cariglia was the Project Manager for the Rouge Tank Upgrades for the City of
Toronto. The project included significant upgrades, modifications, and exterior and
interior painting on the 43m high elevated water storage tank in Scarborough.
Deliverables required included a condition assessment, detailed design including
recoating, safety upgrades, new instrumentation, cathodic protection, new office
space and architectural upgrades, interior HVAC and dehumidification, as well as
contract administration and on -site supervision. In addition, GENIVAR completed
specifications, on -site supervision and contract administration for re- paving the
access roadway and parking lot areas.

Interior and Exterior Painting & Upgrades of Leslie Elevated Water Storage
Tank.

GENIVAR is in the process of completing both interior and exterior recoating in


addition to upgrades such as safety equipment, the addition of passive cathodic
protection and repairs to the valve house of the existing Leslie Water Tower in
Toronto. Deliverables include a condition assessment, preparation of contract
documents including specifications and drawings; and full -time coatings
supervision and contract administration. Ron Gariglia is the Project Manager for
the City.

The Ontario Police College Tank Upgrade and Recoating, Aylmer, Ontario
The Ontario Police College located in Aylmer has a potable water system
consisting of a water tower capable of storing 75, 000 imperial gallons and an in-
ground reservoir capable of storing 206, 000 imperial gallons, which had been
identified as requiring several upgrades, including the interior and exterior
recoating of the water tower and upgrades to the access hatches to the in-
ground reservoir.

As part of this project GENIVAR performed an assessment of the existing


coatings to confirm or refute the presence of lead on the water tower and to

assess over -coating possibilities instead of performing a full exterior recoat. Specifications for the interior
and exterior coatings of the tower, replacement of the hatches, pipe work and concrete repairs for the
reservoir were developed as necessary. Based on the site investigation, specifications and design
drawings were developed for the necessary upgrades for tendering. Ron Cariglia was responsible for the
execution of this project for CB Richard Ellis.

York Pressure District 9 Elevated Tank No. 2 - Class EA and Detailed


Design, York Region Commissioned 2011

Alec Cranmer was the Project Manager, EA Specialist and Design Engineer
responsible for the completion of the Schedule ' B' Municipal Class
Environmental Assessment and detailed design for a 7. 55 NIL elevated tank
located in the Oak Ridges Moraine, to service York Region Pressure District
9. Design features included separate valve, electrical and chemical rooms
inside the support pedestal, separate inlet and outlet risers, process valves including an altitude /flow
control valve, a tank mixing system including a re- circulation pump, a re- chloramination system, chlorine
residual and flow monitoring equipment, and internal and external protective tank coatings. Site works
included removal of the existing standpipe and extensive site restoration and naturalization.

3. SCOPE OF WORK
As requested in the City's RFP document, the following sections detail the key components of the project
approach and methodology, in order for us to provide the City with technical guidance for sandblasting
and recoating of the Hollinger Standpipe Reservoir.
3. 1 Development of Contract Documents and Specifications

We propose to utilize our most recent contract documents and specifications for both new and recoating
projects to develop a basis for the Hollinger Standpipe contract documents and specifications for
sandblasting and painting. We will also review the contract specifications and shop drawings provided by
the City for the 1992 Standpipe Re- coating Project, which may provide insight into the existing coatings
chemistry and specific conditions that are particular to the City of Timmins and its unique climate.
Once an initial draft documents are developed, a Project Team Workshop will be conducted in order to
discuss the general conditions and identify special provisions. The Workshop will be a cooperative effort
and will enable individual Team Members to express concerns and identify any potential special
provisions which may be necessary within the contract specifications. The City's staff contributions will be
essential to identifying and addressing local requirements, priorities, and concerns.
The final Tender Documents will incorporate the comments from the Project Team Workshop.
3. 2 Technical Report on Coating /Painting Systems
GENIVAR will provide the City with a detailed technical report on the various combinations of
paint/coating systems suitable for both the interior and exterior of the Standpipe. The key considerations
to be addressed in the report will include the following:
NSF 61 Certified Coating: The Inside Coatings Systems ( ICS) identified, evaluated and specified will
meet the requirements of ANSI /NSF 61 Drinking Water System Components -Health Effects for materials
in contact with potable water. The coating systems will also be required to meet the requirements of
AWWA Standard D102 -11 Coating Steel Water- Storage Tanks and the 2008 MOE Design Guidelines
for Drinking -Water Systems. The Outside Coating System ( OCS) is not required to be NSF 61 certified,
unless specifically requested by the City.

Non- Destructive and /or Harmful: GENIVAR will evaluate and specify that all products ( i. e. blast media,
cleaning solvents, etc.) utilized in the preparation of the tank shall not be harmful to the structural steel
and integrity of the tank. All materials in contact with potable water shall be NSF 61 certified. GENIVAR
will further specify the handling procedures for the products used during the project and ensure that none
will present any immediate and inherent physical dangers to workers.

Coating Application Requirements: GENIVAR will estimate the costs for the various coating systems and
also review the application specifications for each coating with each manufacturer. The success of
coatings application is extremely weather -dependent. Consideration will be given to the coating' s
tolerance to temperature, precipitation, humidity, wind, UV radiation, etc. The time period between re-
applications of the systems will also be evaluated.

We will also review the compatibility of the proposed exterior coating system with the existing coatings to
determine if sandblasting will be required. If the Standpipe cannot be recoated due to existing conditions
and requires sandblasting, scaffolding and containment hoarding will be required to be constructed, which
will greatly increase the cost and schedule for the proposed recoating.
Life Cycle Evaluation: The coating systems will be evaluated for their anticipated overall performance
and life expectancy. Although coating products are continually evolving, an evaluation of coating
chemistries ( zinc -rich primers, epoxies, polyurethanes, fluorourethanes, etc.) and thicknesses will be
provided to compare expected performance and potential recoating /maintenance frequency. Additional
factors including long -term gloss and colour retention and graffiti resistance will also be considered.
Contingency Plan: The Report will include recommendations to address and mitigate schedule and cost
impacts should any structural repairs be required. Given the aggressive schedule to recoat the standpipe
within six weeks, any required structural repairs within the tank will likely cause significant impacts to the
schedule as exterior recoating cannot occur simultaneously with pit or striation repairs on the inside of the
tank due to the heat from welding.
Pit Repairs: Once the interior coating is removed we recommend that the plate thicknesses be
confirmed and measurement of the extent to which pits have penetrated the wall be completed. Should
the pitting be shallow and not affect the structural stability of the tank walls, the interior coating itself can
be used to fill the pits. For these shallow pits, a thin layer of coating is applied and trowelled into the
prepared pits. For deeper pits, puddle welding may be required. Pit repairs of this type could take 1 - 2
weeks and no painting of the interior or exterior could occur during this time.
Striation Repairs and Tank Venting: The striations identified in the inspection reports are evidence of a
process referred to as " tin canning." The plastic- induced stress deformation exhibited by the rolled steel
is caused by expansion and contraction of the tank walls with the daily fluctuations in the tank level, which
may be exacerbated by inadequate tank venting. Therefore, we recommend that the existing tank
venting system be upgraded to a stainless steel combination vent and vacuum relief system, which will
help to minimize or eliminate this effect. Structural repairs identified outside of the tank could potentially
be completed prior to the tank coating to avoid schedule impacts.
Schedule Mitigation: If exterior scaffolding and containment shrouding is deemed to be required, the
contractor will be required to install the scaffolding prior to tank shutdown as this operation could take 2 -3
weeks.

Cost Mitigation: If structural repairs to the standpipe are of a significant duration, the coatings applicator
may claim for delays, re- blasting, providing dehumidification or require compensation for additional
demobilization and remobilization. To avoid potentially costly change orders, GENIVAR can include
provisional items in the bid form for demobilization and remobilization costs, as well as daily
dehumidification and reblasting costs. The extent of the structural repair work will determine whether it is
more cost effective to provide constant dehumidification during the structural repairs or re -blast after the
repairs are complete.

Specifications for Minor Repairs: Included in the report will be GENIVAR' s corrosion repair specification,
updated from previous water tank recoating projects. Discussion on repair procedures and the
specification will be included on the agenda for the Coatings review meeting with the City' s Project Team,
provisionally scheduled for March 21', 2013.

Once the Draft Coatings Systems Technical Report is reviewed by the City, a Workshop will be held with
the City's Project Team to review and discuss the various coating options available as well as the
principle coating manufacturers in Ontario. The coating manufacturers capable of meeting the above
standards include Amercoat Canada, Carboline Company, Devoe /ICI Products and Tnemec Company
Inc.

The tank interior and exterior coating options will be identified, evaluated, and compared according to
initial costs, service level, and lifecycle costs of overcoating and coating replacement. Considerations will
also include the ease of future recoating, ability to withstand weathering, UV- resistance, and the ability to
maintain colour and lustre.

3. 3 Develop a List of Approved Contractors


GENIVAR has provided for screening and pre -qualification of Contractors to carry out the works at the
Hollinger Standpipe. GENIVAR will prepare the pre -qualification documents for the City's review. We will
review the submittals with the City and contact references and other municipalities to learn more about
the Contractor' s past performance on similar projects. The list of successful Pre -Qualified Contractors will
be invited to bid on the proposed work.

Note that our coatings specification requires that each coatings applicator must be certified by the
coatings manufacturer. Every product application procedure is different and therefore applicators must
be trained and knowledgeable of each particular product. BY limiting coatings applicators, we may be
limiting coating manufacturers. In some cases, a particular applicator may be certified to apply more than
one coating manufacturer.

3. 4 Compliance with Health and Safety Regulations


As specified in the Contract Documents, GENIVAR will ensure that all work is carried out in accordance
with the Ontario Occupational Health and Safety Act, including but not limited to:
4 Confined Space Entry ( Assessment and Rescue Plans)
4 All required contract notification documents

WHMIS

4 Fall Protection

4 City's Contractor Health and Safety Policy Review Program, and


4 Pre -Start Health and Safety Review to be done by the consultant.
3. 5 Contract Administration and Inspection

3. 5. 1 Tender Period Assistance

GENIVAR will provide the City with a complete digital set of tender documents including design
specifications and drawings. It is anticipated that the City will provide the necessary front -end documents
which would be reflective of the City' s purchasing policies. GENIVAR will provide answers to questions
during the tender period, prepare a construction cost estimate, and provide the City with a tender analysis
and recommendation. Addenda shall be issued by the City.
Our Contract Administration and Site Inspection services will be provided principally through GENIVAR's
Timmins office and Cory Goulet. Cory will be responsible for managing the daily contract administrative
duties with technical and managerial assistance to be provided as required from the Markham office.

Cory has worked as a site inspector on many M. T. O. projects but also most recently as the site inspector
on the City of Timmins Airport Parking Lot Expansion Project and Phase I of the McChesney Road
Sanitary Sewer Project.
Contract administration services will include a Pre- Construction Meeting, weekly site meetings, shop
drawing reviews, payment certificates, commissioning and all other deliverables noted in the RFP. The
approximate start date for construction is mid -August with completion by September 24th as noted in the
RFP.

Although not requested in the RFP, GENIVAR typically recommends full -time inspection by a certified
National Association of Corrosion Engineers ( NACE) inspector during the coatings application to ensure
quality control of the coatings application. GLS has several certified NACE Level II Inspectors who can
provide this service and will provide inspection reports confirming the coating application has been
completed in accordance with the contract specifications and applicable standards.
3. 6 Develop Protocols /Procedures Minimizing Work Impacts on Related
Infrastructure and the Public
Communication: GENIVAR will work with the City's Project
Team and Communications /IT Department, to ensure that
continuity of communications is maintained throughout the
project. This will include the identification of any special
requirements or contingencies which may be included in the
Contract Documents.

Public Health: Temporary scaffolding and containment


shrouding may be required for the recoating of the
Standpipe exterior if blasting is required or to prevent
overspray during the coating operations.

Security: GENIVAR will review the Standpipe site to identify


any security issues related to public access to the site during
non -working hours. Given the nearby mining operations, it
is expected that the area is already partially isolated by Luzenac Inc. - 100 Water Tower Road
fencing; however, there may be a necessity to specify
additional temporary or permanent fencing in order to isolate
the contractor's staging area. Permanent fencing may
resolve both the construction security issue as well as the
Standpipe access security concerns.
Luzenac and Goldcorp: The Contract Documents shall
identify that the nearby Luzenac operation, which occasionally
produces steam discharges, as well as Goldcorp' s mining
operations may be a source of air contaminants, which could
potentially affect the Standpipe Coatings application.

Communication with these stakeholders to identify possible Goldcorp - Hollinger Pit


interferences is included in GENIVAR' s scope of services.

3. 7 Final Inspection, Disinfection, and Clean -Up


As part of the Contract Documents, GENIVAR will require that a written disinfection procedure according
to Ministry of the Environment requirements and AWWA procedure C653 Disinfection of Water Storage
Facilities ( Latest Edition) be submitted for review by GENIVAR and the City. Also included in this
procedure will be required a detailed description of the proposed dechlorination method and disposal
discharge. The contract documents will specify that all disinfection is to be performed by an MOE
certified contractor. The granting of Substantial Performance will also be contingent on the successful
disinfection and return of the standpipe to service.

3. 7. 1 Warranty Period Inspection


A Warranty inspection of the interior and exterior coatings is recommended prior to the expiry of the
Warranty Period. A discussion on the merits of undertaking additional inspections as well inspections of
the standpipe interior by the NACE certified coatings inspector can be discussed in the Coatings
Technical Report.

4. PROJECT SCHEDULE
The Project milestones and deliverables as outlined in the RFP are included in the proposed Project
Schedule Gantt Chart included in Appendix D. The City's proposed schedule for the Technical Report on
Coating /Painting Systems is considered to be aggressive with the draft report to be submitted less than 2
weeks from award. The analysis is dependent on the ability of the coatings manufacturers to provide the
required information. The following table lists the critical milestones and deliverable dates required to
achieve the proposed completion date.

The proposal schedule is based on tank exterior overcoat and interior lining replacement.
Based on our knowledge and our experience with constructing and recoating elevated tanks, coupled with
our preliminary review of the facilities, an initial list of potential issues, concerns and constraints which
may impact the proposed schedule is as follows:

9 Recoating - If the Standpipe exterior cannot be recoated due to existing conditions and requires
sandblasting and recoating, scaffolding and hoarding will be required to be constructed and the time
required to complete the works will be greatly increased as well as significantly more expensive

4 Coatings Compatibility - If the recommended Standpipe exterior coatings are incompatible with the
existing coatings, then sandblasting, scaffolding and hoarding will be required to remove the existing

coating.

Facility Shutdown As the Standpipe is a critical water storage facility, the City must confirm that
the pipe can be taken out of service for 8 -10 weeks to perform the required Works.

5. QUA /Q1C SYSTEM


GENIVAR understands the critical importance of an effective Project Management ( PM) approach and
Quality Assurance and Quality Control ( QA/ QC) program to ensure the on -time and on- budget delivery of
a quality project to the City. Substantial planning and on -going monitoring, quality assurance and control,
issue identification and resolution, and a high level of communication with, and reporting to the City, form
the core of our project management approach. The aim of our approach is to ensure that the highest
quality deliverables are submitted and milestones are reached on time. As a Department Head, and
GENIVAR' s in -house coatings expert, Ron Cariglia is able to provide the QA/QC effort from both a Project
Management as well as a Technical standpoint. Ron' s ability to offer QA/ QC on both these fronts will
greatly aid in the successful delivery of the Hollinger Standpipe Re- Painting Project.
5. 1 Quality Assurance and Quality Control
Our Quality Assurance and Quality Control ( QA/QC) commits senior technical staff to quality assurance
and quality control with respect to internal technical review. At the outset of the project, a project specific
Project Quality Management Plan ( as discussed above) will be developed which will provide the overall
QA/ QC framework to be followed for the project. The QA/ QC program has two levels:

4 A continuous review and checking of design decisions and calculations by a senior specialist in
each engineering discipline; and
4 QA/ QC by senior level company personnel at all design stages.
Our Quality Assurance ( QA) program at the design stage will apply to all those actions required to ensure
that the works are designed and constructed in accordance with applicable codes, guidelines, standards
and specifications. The QA review by senior staff members will ensure that the design work has been
performed in accordance with the following criteria:
4 City Design Standards 4 Practical layout of equipment from an operation and
maintenance perspective
4 Good engineering practice

4 Constructability 4 Relevant code( s) and standards

4 Approvals, Environmental Impact and 4 Construction Cost Estimate

The Quality Control ( QC) program will provide for the review of the services provided and the work to be
done, together with management and documentation necessary to demonstrate that these services and
works meet contractual and regulatory requirements. Reviews are documented by mark -up of design
documents, reports, specifications, etc., and reviewed documents are filed until corrected or superseded
by a subsequent submission.

6. DD TDONIAL INIF f ' MATOONI


6. 1 Review of Tank Mixing
To help maintain the quality of the stored water, our tank designs and retrofits
often include modelling and design of a passive tank mixing system and
recirculation pump system. Upon the City's request, we propose to identify,

evaluate and compare both active and passive mixing systems and compare their application for the
Standpipe. The evaluation will include initial cost, lifecycle cost, mixing effectiveness, ability to integrate
into the existing tank, and operating and maintenance complexity.
GENIVAR is uniquely qualified to evaluate and provide insight into current municipal water industry
mixing technologies for elevated tanks and standpipes as we have in -house capabilities to optimize tank
mixing using 3 -D Computational Fluid Dynamics ( CFD) modelling using FLUENT. Custom modelling of
the mixing system is critical to minimize water age and loss of chlorine residual and determine optimal
daily drawdown. The design of the tank mixing system may incorporate a re- circulation system to help
promote mixing during low demand periods and minimize freezing in winter.
This technology and knowledge also provides us with the capability to evaluate pre- engineered package
mixing systems, which are often specified for tank retrofit projects. Should the City wish to investigate this
optional service, the mixing system evaluation will be summarized in a Technical Memorandum.
6. 2 NACE Certified Inspector

Based on our experience in designing, specifying and inspecting tank coating operations, we typically
recommend full -time inspection by a certified National Association of Corrosion Engineers ( NACE)
inspector during the coatings application to ensure quality control of the coatings application. GLS has
several certified NACE Level II and III Inspectors who can provide this service and will provide inspection
reports confirming the coating application has been completed in accordance with the contract
specifications and applicable standards.

6. 3 Designated Substance Survey


Designated substances are regulated under the Occupational Health and Safety Act ( OHSA) and the
designated substances regulation identified as Ontario Regulation ( O. Reg.) 490/ 09. The designated
substances regulation specifies the occupational exposure limits - time weighted average exposure limit
OEL- TWAEL) for each substance and prescribe control programs. The OELs establish Ontario standards
for worker protection. Procedures that provide the equivalent level of protection should therefore be
implemented on construction projects where exposure to designated substances is a hazard. Ensuring
that such procedures are in place would, in the words of 25( 2)( h) of OHSA, be " taking reasonable
precautions to protect the health and safety of workers."
In addition, O. Reg. 278/05 requires an asbestos survey to be performed prior to the scheduling of any
construction. If any asbestos -containing material ( ACM) is identified through this survey, this material
must be managed or removed in accordance with the requirements of O. Reg. 278/ 05.
In the case of the Hollinger Standpipe, there is potential that some of the previous primers or coatings
contain lead of chromate. Although not included in our proposal, if no prior testing has been completed,
we recommend that the existing coatings be tested to definitively confirm the existence of lead of
chromate. Failing to identify the presence of lead could lead to a substantial change order in order to
properly remove any previous coatings containing lead as complete tank scaffolding and shrouding would
be required. Testing of the coatings should be scheduled during the early stages of the project.
6. 4 Permits and Approvals
The requirement for permits and approvals was not identified in the RFP, and has not been included in
our proposal fees. In some cases, a Building Permit is required from the City prior to commencing work.
The City could potentially require Planning or Site Plan Approval if a tank logo is required.
6. 4. 1 MOE Drinking Water Works Permit
In the event that the City should request GENIVAR to examine options for providing the Standpipe with a
mixing system, the MOE Approvals Branch would require a modification to the City's Drinking Water
Works Permit prior to implementation. The MOE have indicated that the addition of a tank mixing system
to a DWWP is a low risk request and can be fast -tracked for approval in approximately four ( 4) weeks.
Therefore, should the City wish to include the design and installation of a mixing system to the scope of
work, it is not anticipated that revising the DWWP for the mixing system would impact the City's proposed
completion schedule.

6. 5 Health and Safety Policy / Plan


GENIVAR has established occupational environment, health and safety as a core operating principle
governing all of its activities, both in Canada and abroad. GENIVAR recognizes that it has a responsibility

addition to ensuring that employees are trained in those procedures and are familiar with regulations
aimed at reducing the risks to which they are exposed. All GENIVAR employees and subcontractors must
comply with GENIVAR's health and safety program requirements and all applicable legislation.

COMPANY PROFILE

G. L. Stone Consulting Limited (GLS) was founded in 1969 to provide consulting and inspection
services in the protective coatings field. We undertake domestic and international projects, and
coordinate projects from offices in Mississauga and Hamilton, Ontario.

The GLS team of consultants draw upon a sound background in coatings chemistry to specify the
correct products for each application, or solve painting problems. Our inspectors also have
backgrounds in the coatings industry, and specific training in coatings inspection.

In order to keep up with the latest technology we maintain active memberships in NACE and
SSPC, The Society for Protective Coatings, the most significant North American organizations
addressing coatings issues. We have been involved with the development or revision of many of
the standards referred to by painting specifications and used daily in our industry.

GLS provides services mainly where heavy duty corrosion resistant coatings are required. We
have worked in numerous industries where coatings are used, including bridges, water storage,
water treatment and waste water treatment facilities, rail cars, the petroleum industry ( including
offshore platforms, FPSOs, terminals, and refineries), and miscelaneous industrial applications.
Over the last 30 years GLS has been involved with well over 200 water tank painting projects.

painting on the 43m high elevated water storage tank in Scarborough.
Deliverables required included a condition assessment, detailed design
including re- coating, safety upgrades, new instrumentation, cathodic
protection, new office space and architectural upgrades, interior HVAC
and dehumidification, as well as contract administration and on -site
supervision. In addition, GENIVAR completed specifications, on -site
supervision and contract administration for re- paving the access roadway

of the Leslie Tank. The project is currently in the construction phase and
features interior and exterior recoating as well upgrades such as safety
equipment, the addition of passive cathodic protection and repairs to the

The Ontario Police College located in Alyme has a potable water system
consisting of a water tower capable of storing 75, 000 imperial gallons
and an in- ground reservoir capable of storing 206, 000 imperial gallons,
which had been identified as requiring several upgrades, including the
interior and exterior recoating of the water tower and upgrades to the
access hatches to the in- ground reservoir.

As part of this project GENIVAR performed an assessment of the


existing coatings to confirm or refute the presence of lead on the water
tower and to assess over -coating possibilities instead of performing a full
exterior re -coat. A specification for the interior and exterior coating of the
tower and the replacement of the hatches and pipe work and concrete
repairs for the reservoir were developed as necessary.
Based on the site investigation, a specification and design drawings were
developed for the necessary upgrades for tendering.

GENIVAR Inc. was retained by the Region of Waterloo to complete the
Detailed Design and provide Contract Administration and Site Inspection
services for a new 7. 2 ML elevated tank located in the City of Waterloo to
service Kitchener -Waterloo Zone 6. GENIVAR also conducted the site
due diligence and obtained all approvals for the project. The project
includes watermains, site services re- chloramination capabilities,
recirculation pump, tank mixing system and SCADA integration.

A Public Information Centre was conducted by GENIVAR prior to


construction to inform local residents of the project and address all
concerns.

The Thompson Rosemount Group a Division of GENIVAR was retained


through a competitive proposal process to complete the evaluation and
design of a new storage facility to replace a post- tensioned concrete
standpipe that had become unsafe to operate as a storage facility. The
project included the Schedule B Class EA for the new facility with three
public consultation centres, development a calibrated distribution model
of the existing and proposed system, conceptual and detailed design of
the preferred alternative ( elevated storage) including lifecycle cost
analysis of different construction approaches. The project included
allowances for a rechlorination facility located in the base of the storage
tank, a control room /office in the pedestal and an automated bulk water
station.

CLASS ENVIRONMENTAL ASSESSMENT

The Maple Pumping Station was part of the Aurora Newmarket Water
Supply Project for the Region of York. The overall project included 17 km
of 1050 / 1200 mm diameter watermain, a 10 ML ground storage
reservoir and the Maple Pumping Station to supply the system. The
pumping station independently serves the Maple Community and
Richmond Hill ( Pressure District 7) and Aurora, Newmarket, Vaughan
and part of Richmond Hill ( Pressure District 8).

This fully- equipped pumping station serves two pressure districts with the
maximum capacity of 68. 2 MUD for PD7 and 150 MUD for PD8, in the
Region of York. The facility is complete with centrifugal pumps, a 1800
mm diameter suction header fed from two independent reservoir
connections for redundancy, independent discharge headers with
appropriate surge control, flow monitoring devices electrical / control
equipment, SCADA, and provision to install a re- chloramination system.

for a 32 ML dual -celled in- ground reservoir and a stand -alone pumping station
to supply 90 ML/ d and 124 MIJd to pressure zones 5W and 6W in the Region of
Peel. Design features included a pre -cast reservoir roof, centrifugal pumps,
electrical, SCADA and controls equipment, a crane and hoist for equipment
removal and two 2, 000 kW standby bi -fuel generators, all housed in a barn
building architecturally designed to match the surrounding landscape. The

4 Georgina Water Treatment Plant Phase 2 Upgrades, York Region, ON ( on-
going): Project Manager and Contract Administrator for upgrades to increase

Quality control / quality assurance technician responsible for coatings inspection duties on
various projects. Gamed skills in working with poorly performing and / or difficult
contractors while maintaining quality in accordance with specification requirements.
Projects have included:

Bridges .
New budge girder coatings inspection in shop environments. Projects required
inspection of all surface preparation and coating application activities, in addition to
inspection of cured coatings.

Waste water treatment plants


Inspection of exterior coatings and gasproof linings for waste water treatment digestion
tanks at various plants in Ontario and Newfoundland - concrete and steel substrates
were involved. Carried out calculations for material quantity requirements to ensure
sufficient coatings were applied, in addition to TNT measurements, ambient conditions
monitoring and other normal inspection duties.
Water Tanks
Elevated water tank exterior coating inspection. The project involved the repainting of
an existing water. tank with a lead -containing paint system. Inspection was earned out
full time, checking surface preparation quality, blast profile ambient conditions,
coating mixing and tthinning, application methods, and dry film thickness.

ANSWERS TO QUESTIONS:

1. Has the Tower been inspected and is there an inspection report?

Answer- the tower was inspected in 2006 and 2011 and both reports are accessible
through the RFP ( link is provided on page 7 of the RFP).

2. Does the Tower require an inspection? Inside? And Outside?

Answer- Under Section 3. 5 of the RFP ( Contract Administration and Inspection), the
successful proponent is required to inspect the tower after removal of the coatings.
However, the initial inspections have been done ( see question 1).

3. Is the project an overcoat or recoat?

Answer- the interior of the tower would be classified as a recoat as we will have to
remove the coatings inside the tower. The exterior of the tower would be evaluated
during the project to determine how much of the original coatings /paint need to be
removed.

4. Is there lead pigment in the paint system? Has the paint been tested?

Answer- To the best of our knowledge, there is no lead pigments in the coatings.
The paint has not been tested.

5. Section 3 of Part B identifies the Evaluation Criteria for the Proposal; however there is
no breakdown for how the points are awarded. Can the City please provide a scoring
breakdown?

Answer- The City of Timmins uses a two envelope proposal evaluation system with
one "envelope" containing the Technical part of the Proposal and a second
envelope" with the financial or price part of the proposal. The City will not provide a
specific weighting breakdown of the categories listed in the RFP ( Understanding the
RFP, Experience / Qualifications of the project team, Project Implementation Plan,
Corporate Profile, and References) but will let you know that the Technical
component is worth 60% and the Cost component is 40 %.

6. Does the City require the services of a certified coating specialist ( NACE) to certify the
application of the coating to the tank?

Answer- The City did not request, or provide for a any specific coatings specialist
such as NACE. However, we would expect that the inspector provided to monitor
the progress and quality of the work by the contractor is an experienced person.
Providing a NACE certified specialist would likely enhance the overall technical
component of the RFP ( Experience /Qualifications section).

Reminder: Proposals are due on February 14`", 2013 at 2: 00: 00 PM.

include it with their proposal.

Hi Norm,

As discussed this morning, please find attached our revised fee schedule, which includes 500 hours of inspection by a
NACE certified inspector. The revisions assume approx. 10 weeks of coatings inspection and 12 weeks of total
construction duration.

We have also included a Condition Assessment of the existing coatings by Jim Stone, a NACE 111 Inspector. The
condition assessment will occur as soon as possible to determine lead content Of any), the extent of corrosion, adhesion
testing, etc., which will confirm if the existing coatings can be top- coated or if a complete removal and replacement is
required. We will also be able to estimate any impacts on the construction schedule and budget with this knowledge and
prepare the contract documents accordingly.

As mentioned in our proposal, we have also included a Provisional Amount for an analysis of the tank mixing and design
of a mixing system, in case this is something the City may be interested in pursuing at a later date.

I received your revised Financial proposal.
I am concerned that the hours for the NACE inspector are too low.
We would be prepared to recommend accepting Genivar' s proposal to Council with an allowance of 500 hours for the
NACE inspector. This is because, as you point out in your submission, there are many possible delays that could take
place during the construction period and I do not want to go back to Council for additional funds if at all possible. With
this increase in the total cost of Genivars financial proposal , Genivar continues to have the top score from the Proposal
evaluators for this proposal.

BY- LAW NO. 2013- 7352

BEING A BY- LAW to authorize the Corporation of the City of Timmins to enter into an

agreement with Genivar Ontario Inc. for consulting services respecting the painting and coating

of the Hollinger Standpipe, in the City of Timmins.

WHEREAS the Council of The Corporation of the City of Timmins considers it desirable to enter

into an agreement with Genivar Ontario Inc.

NOW THEREFORE the Council of The Corporation of the City of Timmins enacts the following

as a By- law:

1. THAT the Corporation of the City of Timmins enter into an agreement with Genivar

Ontario Inc. respecting the painting and coating of the Hollinger Standpipe, in the City of

Timmins, a copy of which agreement is attached hereto and marked as Schedule "A" to

this By- law, for a total cost of$ 77,455. 00 plus HST.

2. THAT the Mayor and Clerk be and are hereby authorized to execute the said agreement

on behalf of the Corporation and to affix thereto the Official Seal of the Corporation.

SUBJECT

Presentation of results obtained from the Request for Proposal for Consultant Services.

PURPOSE

Receive Council approval for awarding a contract for consultant services in order to
undertake the Painting and Coating of the Hollinger Standpipe.

EXPLANATION

The Public Utilities Department has prepared, and completed, a detailed Request for
Proposal for engineering services for Painting and Coating of the exterior and interior of
the Hollinger (Water Storage) Standpipe. The City recognized the level of complexity in
this assignment and heavily favored the RFP process versus tendering.

The City of Timmins Request for Proposal consisted of the following scope;

Part A Technical Proposal ............... score 60 points

The objective of this assignment includes:

Development of contract documents and specifications


Technical report on coating painting
/ systems
Prequalification of contractors
Compliance with health and safety regulations
Develop protocols procedures
/ for minimizing work impacts on related
infrastructure and the public
Contract administration and inspection.
Disinfection and commissioning.

FINANCIAL AND HUMAN RESOURCE IMPLICATIONS

The financial submissions of the five (5)short -listed candidate firms were opened. The
bids were examined in accordance to the terms of the proposal. The lowest bid was within
30% of the average financial price and the high bid was within 50% of the average. An
exceptionally low price can indicate a potential level of effort or quality that would be
unacceptable. A high price proposal can mean an inefficient method of doing the work or
lack of understanding of the scope of the project.

The financial proposal submitted by Genivar and which shall form the basis of the contract
for engineering services is in the amount of $00

This project is identified in our 2013 capital expenditure and is included in our 10 year
-
Water Capital Program. The project has a budgetary estimate of $1 million for all facets of
the work. Based on the budget estimate, we have determined the total engineering fee to
represent 7. 7% of the budget. This percentage is within the expected range (between 7%
to 15 %).

While the project will be managed by the consultant, the Public Utilities Department will
designate a project coordinator to ensure efficient communication between all parties. The
project coordinator accountabilities will be assigned internally to an existing staff member
to be determined).

CONCLUSION AND RECOMMENDATION:

We recommend to Council that they award this engineering contract to Genivar for the
amount stipulated in this report.
