COMMON INTENTION
Section 34 of IPC defines Common Intention
Based on Common Intention
In common intention two or more persons are required.
Each member should have participated in the act.
Prior meeting together is not necessary.
Everyones liability in common intention is primary.
Act should have been done in furtherance of common intention.
COMMON OBJECT
Section 149 of IPC defines Common Object.
Based on Common object.
In Common object at least five persons are necessary.
Merely being a member of that group is sufficient.
Unlawful assembly is necessary.
In common intention liability is always vicarious.
Act should be done in prosecution of common object or known to be likely committed in
furtherance of the common object.
