1 The Parties will prepare briefs and reply briefs using an approved common briefing outline.
The briefing outline will be approved in a ruling shortly after the evidentiary hearing or at the
conclusion of evidentiary hearings.

- Parties should all work together to develop a list of all witnesses, the approximate amount of time
needed for cross-examination and redirect, as well as a proposed order for witnesses. The
Applicants should determine a point person who will be responsible for assembling a final
proposed schedule. The point person should contact the service list so that everyone knows to
whom they should send the required information. The point person should provide us via
email the final proposed schedule no later than 5:00 pm on Friday, October 20, 2017. The
proposed schedule, in Microsoft Excel, should highlight any requested dates and times that have
restrictions, e.g. witness is only available between 2 and 3 on Thursday. We will review and
provide parties a final schedule on Tuesday, October 24, 2017. Party estimates of time to cross-
examine witnesses is subject to reduction by the assigned ALJs.
- Prior to going on the record each day, we will distribute and label exhibits to be introduced that
day.
1. Each party sponsoring exhibits that day should provide the ALJs with a list of each of its
exhibits that includes a name and description of the exhibit as well as an exhibit number
written in pencil. See above for properly labeling exhibits.
2. Each party sponsoring an exhibit should, in the hearing room, provide one copy to each
ALJ and one to the court reporter, and have copies available for distribution to parties
present in the hearing room and all witnesses you are questioning about the exhibit. Also
provide an additional copy of each exhibit to the ALJ for the Commissions formal file.
- We ask that parties be present at 9:45 am for each day of hearings so that, prior to going on
the record, we can distribute and label exhibits to be introduced that day.
- Once we go on the record, we will be able to quickly mark the exhibits. By distributing and
marking exhibits prior to going on the record at the beginning of each day, we hope to limit
disruptions during the course of the day. At the end of each day, we will formally receive the
exhibits used that day into the record.
- During the hearings, the Applicant will maintain a list of exhibits including the exhibit numbers
and brief names of exhibits. At the end of each hearing day, the Applicant responsible for
the exhibit list should provide the ALJs with a physical copy of the most current exhibit
list and then email a copy to the service list.
- Generally, corrections to an exhibit should be made in advance and not orally from the witness
stand. Corrections should be made in a timely manner by providing new exhibit pages on which
corrections appear. The original text to be deleted should be lined out with the substitute or
added text shown above or inserted. Each correction page should be marked with the word
revised and the revision date.
- Exhibit corrections will receive the same number as the original exhibit plus a letter to identify the
correction. For example, Exhibit TRN 5-A is the first correction to Exhibit TRN 5.
- Individual chapters of large, bound volumes of testimony may be marked with separate exhibit
numbers, as convenient.
- Partial documents or excerpts from documents must include a title page or first page from the
source document; excerpts from lengthy documents should include a table of contents page
covering the excerpted material. It may be helpful to include language before and after the
excerpt to provide clarity or context.
- Motions to strike prepared testimony must be made at least two working days before the witness
appears, to allow the ALJ time for review of the arguments and relevant testimony.
- No food is allowed in the hearing room; drinks are allowed if you dispose of containers and
napkins every morning and afternoon. Leave-no-trace: take out what you bring in. (ALJ Longs
Rules for Effective Hearings, vol.1).
Applicant should email me by 3:00 pm Tuesday (October 24, 2017) with the names and contact
information for the representatives responsible for each of the two tasks I have assigned to them.
Likewise, if parties have any questions on these instructions, please contact me by 3:00 pm
Monday, October 23, 2017. I expect to be unavailable Tuesday, October 24, 2017.
