AN ORDINANCE CREATING THE DAVAO DEL SUR PROVINCIAL LIBRARY AND AND THE
FORMATION OF OTHER LIBRARIES ACROSS THE PROVINCE PROVIDING FUNDS THEREOF

WHEREAS, civic spaces are required to develop human potential in the countryside and across the
province

WHEREAS, libraries are an investment to improve human development

WHEREAS, it is important that civic spaces be built close to the people, it is important that property be
acquired to make libraries readily accessible to the people;

WHEREAS, it is important that civil society take a partnership role in governance;

WHEREAS, it is important to distribute and create libraries in the various municipalities in the province

NOW THEREFORE, BE IT ENACTED AS IT IS HEREBY ENACTED BY THE SANGUNNIANG

PANLALAWIGAN OF DAVAO DEL SUR, IN SESSION ASSEMBLED, BY THE VIRTUE OF THE
POWERS VESTED BY LAW, THAT:

Section 1. Title. This ordinance shall be known as the Ordinance creating the Davao del Sur Provincial
Library and other libraries across the province

Section 2. Purpose. The purpose of this ordinance is to create a provincial library and allocate funds
thereof

Section 3. Features, the library shall be designed to have at least:

- Solar Panels
- Wifi
- Rainwater catchment
- An Online Public Access Catalogue
- Caf
- Childrens Section
- Filipiniana Section
- One (1) Meeting Room
- One (1) Lecture Room
And others

Section 4. Purchase of Land the provincial government shall acquire suitable land close to the main
population area and purchase it through expropriation proceedings.

Section 5. Creation of a Board of Trustees

A Board of Trustees will be created to oversee the library, ensure its maintenance, improve its operations,
accept donations, formulate policies, create partnerships with other organizations, impose fees and raise
the visibility and prestige of the library. They shall serve for one (1) year.

Member Principal of the Digos City National High School
Member President of a Private Higher Educational Institution as selected by CHED
Members Presidents of two (2) non-government organization selected by the Governor
Member Educational Chair of the SP.
Members Presidents of two (2) student councils in the province selected by the DepED and
CHED

Section 7 Meetings. The Board of Trustees shall meet at least once every two months and shall elect
among themselves a Chairperson who shall vote in the event of a tie.

Section 8. Office of the Librarian. There shall be created the office of the Librarian charged with the day
to day affairs and implementing the policies of the Board of Trustees.

Section 9. The financing will come from the province.

An amount of fifteen (15) million pesos will be used to purchase the lot and construct a building for the
construction of the provincial library.

Section 10. Formation of Barangay and Municipal Libraries

The Provincial government shall also be empowered and encouraged to create and maintain municipal-
level libraries in partnership with either barangay or municipalities. When necessary the province shall
purchase lands through expropriation proceedings and allocate additional funds thereof.

Section Repealing Clause

All ordinances contrary to or inconsistent with this Ordinance are hereby repealed or modified accordingly

Section Separability Clause

If any part or provision of this Ordinance is declared unconstitutional or invalid, the same shall not affect
the validity and effectivity of the other parts or provisions hereof.

Section 11 Effectivity Clause

This Ordinance shall take effect fifteen (15) days after its publication in a newspaper of local or general
circulation or posting in at least two (2) conspicuous
places in the province
