By unanimous vote of the members present, the following City Ordinance was enacted on third and final
reading:
Authors: Vice Mayor E.S. Mercado and All Members of the Sangguniang Panlungsod
WHEREAS, the proliferation and circulation of pirated entertainment media have greatly prejudiced
producer, artist and legitimate manufacturers and have already affected the viability of the entertainment
industry;
WHEREAS, despite the popularity of the compact disc (CD) as a medium for recorded music, the same
is still not regulated and, as a result thereof, the circulation of pirated compact disc has now reached an
alarming proportion to the detriment of the recording artists, producers, legitimate manufacturers,
distributors and retailers;
WHEREAS, pirated entertainment media being sold and rented out not only by hawkers and vendors in
stalls and sidewalks but even by duly registered video and music stores;
WHEREAS, to curb piracy it is necessary to identify the source of pirated entertainment media and this
can be achieved by requiring the establishments distributing them to report all their sources so as to
identify and prosecute those engaged in this illegal act.
Section 1. Short Title this ordinance shall be known and cited as The Anti-Piracy Ordinance of
Makati.
Section 2. Definition of Terms for the purpose of this Ordinance, the following shall mean:
4. Report shall mean the list of sources and the volume of entertainment media
procured or obtained from each to be submitted by establishment covered by this
Ordinance.
Section 3. Submission of Report All persons, establishments or entities engaged in the selling, whether
retail or wholesale, distribution and renting out of compact disc (CD), video compact disc (VCD) video
home system (VHS) digital versatile disc and other entertainment media shall submit:
1. A list of the establishments, whether local or foreign, from whom they have procured
entertainment media which they sell, lease or distribute.
Section 4. Period of Submission The report mentioned in the immediately preceding Section shall be
submitted quarterly on the first twenty (20) days of the month following each quarter. A consolidated
yearly report shall be filed within the first quarter of the following year.
Section 5. Inspection of Records All establishments covered by this Ordinance shall allow the duly
authorized employees of the City of Makati to inspect their relevant books and records during business
hours and for the purpose of determining compliance herewith.
Section 6. Penalty Any person who fails to submit the report required in this ordinance or who submits
a false report shall be penalized as follows:
First Offense Confiscation of all pirated Compact Disc (CD), Video Compact Disc
(VCD), Video Home System (VHS), and Digital Versatile Disc (DVD) plus a fine of
PhP3,000.00 or imprisonment of three (3) days but not more than five (5) days or at the
discretion of the court.
Second Offense Confiscation of all pirated Compact Disc (CD), Video Compact Disc
(VCD), Video Home System (VHS) and Digital Versatile Disc (DVD) plus a fine of
PhP5,000.00 or imprisonment of three days but not more than five (5) days.
Third Offense Confiscation of all pirated Compact Disc (CD), Video Compact Disc
(VCD), Video Home System (VHS) and Digital Versatile Disc (DVD) plus a fine of
PhP5,000.00 or imprisonment of three days but not more than five (5) days, and
cancellation or non-renewal of Business Permit.
In case the violator is a corporation, the officers or employees responsible or who had participated
in the act or omission shall be held liable therefor.
Section 7. Condition for renewal of business permit The business permits of all establishments covered
by this Ordinance shall be renewed only upon showing that such establishment have complied with the
report required under this Ordinance.
Section 8. Ground for Revocation of Business Permit The failure of any business establishment
covered by this Ordinance to submit the report required herein or allow the inspection of its records when
so required shall be an additional ground for the revocation of its business permit and the closure of the
establishment.
Section 9. Implementing Rules and Guidelines Within ninety (90) days upon approval of this
Ordinance, the Business Permit and Licensing Division in coordination with the City Legal Office shall
promulgate the Implementing Rules and Regulations (IRR) of this Ordinance. The IRR shall be submitted
to the Office of the Mayor for approval and shall be implemented fifteen (15) days after its publication in
a newspaper of general circulation.
Section 10. Creation of a Task Force The Mayor is hereby authorized to create a Task Force under his
Office to oversee the implementation and enforcement of this Ordinance.
Section 11. Separability Clause If, for any reason, any provision of this Ordinance is declared invalid or
unconstitutional, the other sections or provisions thereof shall remain in full force and effect.
Section 12. Repealing Clause All Ordinances, rules and regulations, orders or other issuance or parts
thereof which are inconsistent with the provisions of these Ordinances are hereby modified or repealed
accordingly.
Section 13. Effectivity This Ordinance shall take effect fifteen (15) days after its full publication in a
newspaper of local circulation.
