ACCELERATION POLICY REGULATION
No. PER-01 / M.EKON / 05 / 2006

REGARDING

ORGANIZATION AND WORKING PROCEDURE OF THE COMMITTEE OF


INFRASTRUCTURE PROVISIONING ACCELERATION POLICY

CHAPTER 1

STANDING, TASK, AND FUNCTION

Article 1

(1) The Committee of Infrastructure Provisioning Acceleration Policy,


hereinafter called The Committee is the committee that was set up based
on Presidential Regulation No. 42 Year 2005

(2) The Committee is led by Coordinating Minister of Economic Affair in charge


of the Committee Chairman which in executing its task is responsible to the
President

(3) Composition of The Committee consist of The Committee Chairman, Daily


Executive Chairman, Secretary I, Secretary II, and Members as it was
establish in the Republic of Indonesia’s Presidential Regulation No. 42 Year
2005

Article 2

The Committee has the task to formulate strategy in framework of coordination


of infrastructure provisioning acceleration implementation, to coordinate and
monitor the implementation of infrastructure provisioning acceleration policy by
related Minister and Regional Government; to formulate the policy of Public
Service Obligation implementation in the acceleration of infrastructure
provisioning; and to establish the solution effort of various problem related with
acceleration of infrastructure provisioning.

Article 3

In executing the task as referred in Article 2, The Committee administer the


functions:
a. coordination of strategy formulation of infrastructure provisioning
acceleration implementation;
b. synchronization of infrastructure provisioning acceleration policy
implementation;
c. control of infrastructure provisioning acceleration policy administration
d. coordination of policy formulation of PSO implementation in acceleration of
infrastructure provisioning;
e. management of state owned asset which are its responsibility
f. supervision on task execution of infrastructure provisioning acceleration ;
g. execution of certain task given by The President

h. submission of evaluation result, advice, and consideration in its field of task


and function to The President

Article 4

In performing the task and function as referred in Article 2 and Article 3, The
Coordinating Minister of Economic Affairs coordinates:
a. Related Department;
b. Regional Government
c. Related Business Entity

CHAPTER II
FITTINGS OF ORGANIZATION

Article 5

The committee, is equipped with :


a. Daily executive;
b. Secretariat of the Committee;
c. Working Group;
d. Public Service Obligation Policy Development Unit;
e. Development Centre Unit of Government and Business Entity Partnership;
f. Communication Development Unit
g. Institutional Capacity and Human Resource Development Unit;
h. National Infrastructure Forum;
i. Escort Team
CHAPTER III
DAILY EXECUTIVE

Article 6

(1) Daily executive is coordinated by Chairman of Daily Executive as established


in Presidential Regulation No. 42 Year 2005

(2) Chairman of Daily Executive assist the Committee Chairman in establishing


the Committee’s meeting agenda prepared by the secretariat of the
committee; to propose the formation of working group based on the needs
established by the Committee Chairman; and to coordinate the execution of
the Committee Secretariat and Working Group tasks.

CHAPTER IV
THE COMMITTEE SECRETARIAT

Article 7

(1) The Committee Secretariat is an element of leader’s assistant existed under


and responsible to Chairman of The Committee

(2) The Committee Secretariat is led by Secretary I and Secretary II of the


Committee as established in Republic of Indonesia’s Presidential Regulation
No. 42 Year 2005.

(3) In the execution of daily tasks the Committee’s Secretariat can be


coordinated by a head of secretariat that its appointment is establish by
Head of Committee.

Article 8

The Committee’s Secretariat has the task :

a. To resolve problems that is cross sector in nature, if the problems can not be
resolve at the Working Group level.

b. To assist the execution of coordination meeting in preparation of session


materials before the Committee meeting is being held.

c. To draw up long and medium term investment plan in field of infrastructure,


and also to make update every year

d. To conduct preliminary study on feasibility of Government Support request


for Government with Business Entity Partnership Project
e. To propose priority scale order of partnership projects of Government with
Business Entity which require the Government Support, by taking into
account cross-sectoral needs;

f. To draw up recommendation on projects which is feasible to be considered to


get The Government support, which will be conveyed to the Committee
Chairman to Risk Management Committee on Infrastructure Provisioning in
Department of Finance.

Article 9

Beside conducting the tasks as referred in Article 8, Secretary I of the Committee


has the task:

a. Together with Secretary II to prepare The Committee session agenda;

b. To coordinate the stakeholder;

c. To monitor the implementation of strategy and policy established by The


Committee;

d. To conduct legal study toward The Committee policy and or decision;

e. To draw up The Committee’s periodical report

Article 10

Beside conducting the task as referred in Article 8, The Secretary II of The


Committee has the task :

a. Together with Secretary I preparing the agenda of The Committee’s session;

b. To prepare formation of Working Group;

c. To supervise the execution of Working Group task

CHAPTER V

WORKING GROUP

Article 11

(1) The Working Group is a working unit which is set up for certain time in certain
field of task according to the needs based on Daily Executive Chairman’s
proposal, whose standing is under the coordination and supervision of
Secretary II
(2) The composition of membership, certain task and Working Group
responsibility as referred in sub clause (1) is established with The Committee
Chairman’s decision.

(3) The member of Working Group consist of representatives from related


agency recommended by The Committee’s Secretary I and Secretary II to the
Daily Executive Chairman, which later to be proposed to The Committee’s
Chairman

Article 12

The Working Group draws up the work plan according to its field of task and
report the progress of its execution to The Committee’s Secretary II to be
forwarded to Daily Executive Chairman and The Committee’s Chairman.

Article 13

In the execution of its task The Working Group could be assisted by Non-
Government representative which own the needed experience and expertise

CHAPTER VI

PUBLIC SERVICE OBLIGATION POLICY DEVELOPMENT UNIT

Article 14

Public Service Obligation (PSG) Policy Development Unit is the working unit
whose in the execution of tasks existed under coordination of The Committee’s
Secretary I and Secretary II.

Article 15

Public Service Obligation Policy Development Unit as referred in Article 15, has
the task:

a. To develop the policy and strategy of the PSG and scheme of subsidy;

b. To conduct cross-sectoral coordination to facilitate the execution of The PSG’s


projects and subsidized projects

c. To conduct monitoring of the PSG’s policy and strategy implementation.

CHAPTER VII
THE GOVERNMENT AND BUSINESS ENTITY PARTNERSHIP DEVELOPMENT CENTRE
UNIT

Article 16

The Government And Business Entity Partnership / PPP Development Centre Unit
is the working unit whose in the execution of task is existed under coordination
of The Committee’s Secretary I and Secretary II

Article 17

The PPP Development Centre Unit as referred in Article 16, has tasks :

a. To conduct evaluation and coordination of The Government and Business


Entity Partnership projects implementation, development of institutional
policy and capacity related with

b. To conduct evaluation and coordination of The Government and Business


Entity Partnership projects implementation, which covers :

1) Coordination with The Government and Business Entity Partnership


Development Unit which existed in The Technical Department and
Regional Government (PPP Node) and or The Government Agency
responsible for the project, in affairs of preparation, implementation and
monitoring of The Government and Business Entity Partnership Project
transaction.

2) Readiness Evaluation of projects to be involved in partnership to ensure


the project feasibility for the banking side (bankability(, and conduct the
identification of cross sectoral problems as well as the solution proposal;

3) Based on result of evaluation, to draw up the priority scale of


infrastructure provisioning projects which are going to be made as
partnership by Government with Business Entity;

4). To review the project evaluation result held by Government and Business
Entity Partnership Development Unit existed in The Technical Department
and Regional Government (PPP node) to be verified its conformance with
the prevailing strategy and procedure;

5). Evaluation on Government Support request for projects which submit the
request for The Government Support from angle of cross sectoral study;

6). To prepare briefing notes for The Committee’s secretary regarding the
feasibility of Government Support request for projects submitting The
Government Support request.
7). To coordinate with Department of Finance’s Risk Management Unit in
matters of Government Support request for projects that submit request
for Government support.

c. To develop The Government and Business Entity Partnership policy with


means:

1) To conduct study and evaluation on policy and regulatory law related with
The Government and Business Entity Partnership in provisioning of
infrastructure;

2) To cooperate with The Government and Business Entity Partnership


Development Unit existed in Technical Department and Regional
Government (PPP node) and/or The Department of Finance’s Risk
Management Unit, to prepare working paper regarding problems in The
Government and Business Entity Partnership with the proposed solution;

3) To develop method, procedure and guideline of The Government and


Business Entity partnership project implementation

4) To develop standard of contract and procurement document .

d. To develop capacity and institution of The Government and Business Entity


partnership, through :

1) Granting of advice in matters of education, training and technical support


to The Government and Business Entity Partnership Development Unit
existed in Technical Department and Regional Government (PPP node)
and Government Agency responsible for the project;

2) To prepare database and information regarding The Government and


Business Entity Partnership projects

3) Collection, processing and dissemination of information related with The


Government and Business Entity Partnership

e. To operate mechanism / facilities to finance technical support to The


Government and Business Entity Partnership Development Unit existed in
Technical Department (PPP node), as well as the Government agency either
Central, Province or Regency/Municipal, in executing The Government and
Business Entity partnership projects

CHAPTER VIII

COMMUNICATION DEVELOPMENT UNIT


Article 18

The Communication Development Unit is the working unit that support The
Committee’s Secretary I task execution.

Article 19

The Communication Development Unit as referred in Article 18 has task:

a. To communicate, disseminate information, to build understanding and to


socialize The Government strategy and policy in relation with infrastructure
development acceleration and the business entity participation in
infrastructure provisioning, to related Government agency and stakeholders.

b. To make effort and facilitate public consultation and other activities to


support the task mentioned in letter a

CHAPTER IX

THE AGENCY CAPACITY AND HUMAN RESOURCE DEVELOPMENT UNIT

Article 20

The Agency Capacity And Human Resource Development Unit is the working unit
that support the task execution of The Committee’s Secretary I

Article 21

The Agency Capacity And Human Resource Development Unit as referred in


Article 20 has task:

a. To develop the institutional capability and expertise in infrastructure project


partnership between Government and Business Entity;

b. To improve the stakeholders knowledge and expertise, especially the


Regulatory Body and Government Agency responsible in infrastructure
provisioning;

c. To prepare infrastructure provisioning institutional development program


thoroughly as needed

d. To prepare human resource knowledge and skill development program


involved in execution of infrastructure development program
e. To conduct the education and training program that support development of
institution and human resource for infrastructure sector;

f. To conduct information and knowledge identification, collection,


maintenance and management as learning materials from experience of
infrastructure provisioning projects implementation

CHAPTER X

NATIONAL INFRASTRUCTURE FORUM

Article 22

The National Infrastructure Forum is a working unit supports the task execution
of Secretary I’s of The Committee

Article 23

The National Infrastructure Forum as referred in Article 22, has the task:

a. To investigate the strategic problem regarding infrastructure development;

b. Holding a discussion forum to acquire effective mechanism for infrastructure


development

c. To prepare study and analysis required in effective decision making regarding


infrastructure policy and development.

CHAPTER XI

COMPANION TEAM

Article 24

Companion team is a team that consist of The Echelon I Official on related


ministry which constitute The Committee Member as referred in Republic of
Indonesia’s Presidential Regulation No. 42 Year 2005, which accompany The
Secretary I and Secretary II in executing its task.

Article 25

The Companion Team as referred in Article 24, has the task to provide input and
consideration as needed by The Committee’s Secretary I and Secretary II.

CHAPTER XII

WORKING PROCEDURES

Article 26
The Daily Executive Chairman, Secretaries, Working Group Chairman, Unit
Chairman and Forum Chairman, in executing the task is obliged to cooperate
under the leadership of The Committee Chairman

Article 27

The Daily Executive Chairman, Secretaries, Working Group Chairman, Unit


Chairman and Forum Chairman, in executing the task is obliged to apply the
apparatus performance accountability system.

Article 28

Every leader of organization unit in The Committee circle, must apply internal
control system in each circle which allows implementation of re examination
mechanism.

Article 29

In carrying out its task every leader of organization unit in the Committee circle,
is obliged to apply coordination, integration and synchronization principle, either
on each circle or between organization unit in The Committee circle, as well as
with other agency outside the Committee in accordance with the main tasks of
each.

Article 30

Every leader of organization unit in the circle of the Committee, is obliged to


supervise the task execution of each subordinate and when the deviation occurs
must take necessary step according to prevailing regulatory law.

Article 31

Every leader of organization unit in the circle of the Committee, is responsible to


lead and coordinate their each subordinate and provide guidance and also
direction for the subordinate’s task execution

Article 32

Every leader of organization unit in the circle of the Committee, is obliged to


follow and obey the direction and responsible to each supervisor and conveys
periodical report in time.

Article 33

In submitting the report to the supervisor, the copy of report must also be
conveyed to other organization unit leader in the Committee’s circle which
functionally has a working relationship.
Article 34

Every report received by the leader of organization unit in The Committee’s


circle from the subordinate must be processed and being used as materials for
preparing further reports and for provide guidance to subordinates

Article 35

Every leader of organizational unit in The Committee’s circle is obliged to hold


periodical meeting in order to provide guidance and coaching to subordinates

Article 36

(1) The Daily Executive Chairman conveys periodical report to the Committee
Chairman

(2) The Committee secretaries conveys periodical report to the Daily Executive
Chairman

(3) Head of The Secretariat conveys the periodical report to the Secretary of the
Committee

(4) The Chairman of the Working Group conveys the periodical report to The
Secretary II of the Committee

(5) The Chairman of the Unit and The Forum’s Chairman conveys the periodical
report to the Secretary I of The Committee.

CHAPTER XIII

OTHER STIPULATIONS

Article 37

The attached Committee’s organizational chart, constitute integral part of this


Regulation.

Article 38

Changes in the organizational structure and working procedure as referred in


this Regulation is established by The Coordinating Minister of Economic
Affairs in charge of Chairman of The Committee.

CHAPTER XIV

CLOSING STIPULATION

Article 39
This Coordinating Minister of Economic Affairs Regulation is prevail in date it was
established.
