Information and Instructions:

1. This group assignment carries 20% (10% for Oral Presentation, 10% for Written
Submission)

2. One group shall represent the Plaintiff, and the other shall represent the Defendant.

3. The written submission must be TYPED:

a. Font Calibri
b. Font Size 11
c. Spacing 1.5

4. Front cover of your written submission should at least, state:

a. Group.
b. Name of group members.
c. Please print the above mentioned information on the YELLOW PAPER - that yellow
paper should be your front cover.

5. NO FREE RIDER CONCEPT each member must contribute to this assignment. It is

unfair to share the marks with those who are reluctant or those who show less interest to
participate. Report this event to me should this thing happen.

6. I impose STRICT POLICY ON COPY PASTE answer (either from notes from the
lectures and tutorials, or from the internet I will do answer checking and verification, and
yes, I can tell the difference). Should I receive any sort of answer from these materials
and source(s), I will not hesitate to either AWARD NO MARKS, or DEDUCT 10 marks
from your final award. Bear in mind that you are students of TERTIARY LEVEL learn to
do extra readings, paraphrase and explain the concepts and thoughts in your own words
not merely regurgitating the notes and information.

7. HEARING WEEK (ORAL PRESENTATION): WEEK 12 and WEEK 13 (during your

respective tutorial time).

 INTELLECTUAL PROPERTY LAW

Head & Shoulderz (M) Sdn Bhd wishes to register the brand name HI CLEANZ for their

new fruit-based shampoo which is expected to be released in 3 months time subject to

laboratory experiment. In February 2017, they have sent the application for HI CLEANZ

with Intellectual Property Corporation of Malaysia (MyIPO), but their application was

rejected by MyIPO. Head & Shoulderz (M) Sdn Bhd has further asked for the ground of

refusal, unfortunately, MyIPO still insisted on the refusal. This case now is brought before

the court for further deliberation.

In view of the above situation, prepare an oral and a written submission for:

1. Head & Shoulderz (M) Sdn Bhd (the Plaintiff)

2. MyIPO (the Defendant)
