2 MR. CHARLAND: We are about to
3 begin the fourth meeting of the Hope Zoning
4 Board hearing for the Hope Mill. First off,
5 the fire marshal asked me specifically to make
6 sure there's no standing in the back of the
7 room. Everybody please take a seat. Also,
8 close the back doors. If you need to go in and
9 out, that's fine. We are supposed to keep the
10 fire doors closed. One other thing the fire
11 marshal wants to make sure is that everybody is
12 aware of where the exits are and where you are.
13 In the event of an emergency, exits are clearly
14 posted. The exits are over here and the exits
15 that you came through.
16 I request that anyone with a cellular phone
17 be put on silence, during the meeting. Those of
18 you from prior meetings know that the mic
19 doesn't work that great. The meeting is being
20 recorded as well as the stenographer is taking
21 all the minutes and everything being said. If
22 we need this for a legal document later on, it's
23 available for that purpose. We will be talking
24 up here.

1 There is no public comment tonight. If you


2 came expecting to be able to say your piece,
3 this is just for the zoning board to deliberate
4 tonight so we can make a decision and go forward
5 from there. We've heard what we believe is a
6 lot of compassionate testimony. We've heard
7 some factual testimony. We've heard from both
8 the residents of Hope for and against, and we've
9 heard from the developer. We feel we've got a
10 good basis of which to use to make a decision.
11 The case was originally heard by six members
12 that we have up here on the panel of the zoning
13 board. The the design of that is only five of
14 us are able to vote on the cases before us. One
15 serves as an alternate. Should one of us had
16 not been able to continue through, we would not
17 have had to start over with this entire process.
18 I'd like to take a moment to identify the
19 members. Dean Costakos is at the very end. Joe
20 D'Amico is next to him. Ed Rambone is next to
21 him. Steve Gaddes, and then Paul Durfee next to
22 me. Myself, Dennis Charland.
23 Just so you're aware, when we do take votes
24 tonight only four votes will pass. If we have a

1 situation where two people vote against a


2 motion, the motion dies. That way if there's a
3 situation where we are voting on any one of the
4 variances or the Special Use Permit, if any one
5 or if two people of the five vote against
6 it, the motion ends up killing the project. I'd
7 like to also identify Peter Ruggiero who is the
8 town's legal counsel. He's next to me on my
9 right as well as Calista McDermott who is the
10 zoning board clerk.
11 At the end of the September 29th meeting a
12 motion was made by our board to terminate all
13 further comments, public comments on this.
14 People have continued to send us letters and
15 additional information. That information will
16 be added to the public documents associated with
17 this, but we are not using any of that
18 information for any of our deliberations
19 tonight. Anything that was sent after the
20 29th is not being used in deliberation.
21 Now, for the meat of the meeting. I've
22 prepared to help expedite this from my notes
23 what I'm going to call some findings of fact.
24 What I'd like to do is I'm going to go through

1 each of these nineteen different items. I'm


2 going to go through these things first and ask
3 the panel if they agree or get comments from
4 those. Then we'll go on. If they have
5 additional comments or facts that they want to
6 put into this, we'll have that as a basis of our
7 finding of facts. After that, based on that
8 document that we get through that we will then
9 be making our decision as it relates to the
10 Special Use Permit and then the variances if
11 they go from there.
12 The first finding of fact. The proposal to
13 establish 193 multi-family residential dwelling
14 units on the subject property. The unit counts
15 and locations are proposed as follows:
16 Phase 1 Building 1, Building 2 fifty-eight
17 dwelling units. Phase 2 that is with the
18 existing main mill complex. Phase 2 Building 3,
19 Building 4 of what is now known as the rooming
20 and ancillary structures will have sixty
21 dwelling units. Building 6 and Building 7
22 common area. Building 9 being the museum.
23 Phase 3 will be Building No. 14 and Building No.
24 15. There will be seventy-five dwelling units

1 and the two structures that are comprised of


2 that. There is 10,400 square feet in each of
3 those buildings. Any discussion, at this point?
4 No. 2. That the proposed use is
5 specifically authorized in the RRW60/80 rural
6 residential water zone and the "M" general
7 manufacturing zone upon issuance of a Special
8 Use Permit according to Article 2 Section 2
9 District Use Regulations Subsection 3
10 Multi-family Dwelling Structures. Agreed to on
11 that? Okay.
12 No. 3. The density requirement is 40,000
13 square feet per dwelling unit for developments
14 in excess of thirty-five dwelling units in
15 accordance with Article 3 Section 3 Subsection 5
16 of the Situate Zoning Ordinance for a total
17 required area of 7,720,000 square feet, and that
18 the developer is proposing a density of
19 7,272 square feet per dwelling unit,
20 approximately 18 percent of the area that is
21 required in our zoning ordinance for this
22 multi-family development. I'm looking to make
23 sure there's no discussion, at this point.
24 No. 4. That the site is comprised of

1 slightly more than 32 acres and placing 193


2 dwelling units on this area of land would
3 constitute a density of approximately six
4 dwelling units per acre which is far in excess
5 of the standard prescribed in the town's zoning
6 ordinance. Any questions?
7 No. 5. That the pattern of development in
8 the surrounding area is generally rural in
9 character with low density development other
10 than the associated mill housing located
11 primarily along Mill Street. Any discussion?
12 I'm hearing none. That the surrounding
13 neighborhood is a historic mill village
14 primarily developed for single and two-family
15 dwellings on individual lots of various sizes.
16 Access to be at Mill Street, a narrow roadway
17 with little to no on site or on-street parking
18 available.
19 No. 7. Phase 1 and Phase 2 proposals
20 involve rehabilitating existing mill structures
21 on the property in keeping with the present
22 pattern. Again, no questions. Phase 3 of the
23 development proposal seeks to establish two,
24 five story 52,000 square foot buildings that are

1 68 feet in height with parking beneath which is


2 more than double the maximum 30-foot height
3 required for a maximum by our zoning ordinance.
4 Any questions?
5 No. 9. That the proposed Phase 3
6 buildings are out of character with the existing
7 mill complex and do not mirror the design
8 quality of materials or sense of the sightings
9 of the predecessor distracting from appreciation
10 of existing architecture and muddling the
11 perception of historic settlement patterns in
12 the Hope Village.
13 MR. GADDES: The two new buildings
14 for Phase 3 were reviewed by the --
15 COURT REPORTER: I can't hear you.
16 MR. GADDES: The two new buildings
17 for Phase 3 were reviewed by the committee.
18 (Inaudible)
19 MR. CHARLAND: No. 10 that the
20 applicant was questioned by the board on several
21 occasions whether the proposed new Building 3s
22 could be reduced in size, scale or dimensions.
23 On each occasion, the applicant refused on the
24 basis of the project -- on the basis that the

1 project would not work in that way.


2 MR. GADDES: Yes.
3 MR. CHARLAND: Any questions?
4 No. 11 that the zoning board of review finds the
5 overall density of the proposed development is
6 excessive in comparison with the development
7 density of the existing village. The zoning
8 board of review further finds that the magnitude
9 and intensity of the proposed development is out
10 of scale with the character of the surrounding
11 neighborhood. Any discussion?
12 No. 12 that the zoning board of review
13 further finds the two buildings proposed in
14 Phase 3 to be completely out of scale with the
15 existing Hope Mill property and out of character
16 with the surrounding area which is generally
17 rural in character with low density development.
18 The zoning board of review further finds that
19 the size, scale and configuration and location
20 of the proposed new buildings will impair the
21 character of the mill property and constitute a
22 density of development more than appropriate in
23 the urban setting -- in an urban setting and not
24 compatible with the character of the mill

1 village.
2 MR. GADDES: Dennis, could you
3 read that again.
4 MR. CHARLAND: Sure. The zoning
5 board of review further finds the two buildings
6 proposed in Phase 3 to be completely out of
7 scale with the existing Hope Mill property and
8 out of character with the surrounding area which
9 is generally rural in character with low density
10 development. The zoning board of review further
11 finds that the size, scale, configuration and
12 location of the proposed new buildings will
13 impair the character of the mill property and
14 constitute a density of development which is
15 more appropriate in an urban setting and not
16 compatible with the character of the mill
17 village.
18 MR. GADDES: I would comment with
19 regard to the appearance of the intended merits
20 of the two added buildings that they somewhat
21 fit into a -- since the site is manufacturing,
22 they could fit into what could be described as a
23 mill or manufacturing-style Building 3.
24 MR. CHARLAND: I'll read the

1 proposed language, and tell me if this is adding


2 an additional line to that. The intended
3 cosmetic appearance of the new structures is
4 designed to present similar mill manufacturing
5 style to the existing mill Building 3.
6 MR. GADDES: Yes.
7 MR. CHARLAND: That the proposed
8 development requires 386 parking spaces while
9 the applicant initially proposed 227 parking
10 spaces which was approximately 59 percent of the
11 required spaces by our zoning. During the
12 course of the public hearings, the applicant
13 amended their petition to provide 342 parking
14 spaces which is still less than the 386 parking
15 spaces required.
16 MR. GADDES: Yes.
17 MR. CHARLAND: No. 14. That the
18 the applicant's traffic engineer did not
19 specifically address the parking relief. That
20 the zoning board of review hired a traffic
21 engineer to perform a peer review of the traffic
22 and parking impacts associated with the
23 proposal. The peer review traffic engineer
24 provided an opinion that the 342 parking spaces

1 proposed by the applicant conform to the


2 Institute of Traffic Engineers referred to as
3 ITE parkings spaces per dwelling unit standards.
4 MR. GADDES: It conforms to their
5 standards, but it does not meet our ordinance.
6 MR. CHARLAND: No. 15. That the
7 zoning board of review believes the proposed
8 project is unique to Situate and that the board
9 considers the development to be an urban
10 development proposed in a rural community. As a
11 result, the zoning board of review is not
12 persuaded that the parking spaces provided by
13 the applicant will be sufficient to prevent
14 spillover parking from occurring into the
15 neighborhood, thereby causing disruption and
16 further congestion on the village area street
17 system as urban communities provide alternate
18 transportation options such as public
19 transportation and taxicabs to relieve their
20 parking burden, which is not readily available
21 in rural Situate.
22 Further, the zoning board of review is of
23 the opinion that urban communities may also
24 provide ample on-street parking and off-site

1 parking opportunities where people could rent or


2 lease parking space for other structured parking
3 garages. None of which are available in this
4 area. Any discussion?
5 No. 16. The peer review traffic engineer
6 found that the North Road and Main Street
7 intersection, which is Route 115 and 116, had
8 levels of services rated as "F" under the
9 existing travel conditions that would worsen
10 under the proposed development external impacts
11 to that street system. The engineer found an
12 increase in wait times of 37.4 seconds or from
13 61.3 seconds to 98.7 seconds, which was an
14 increase of 60 percent. Any discussion?
15 That the peer review traffic engineer also
16 found that the Main Street and Hope Furnace Road
17 intersection had levels of service graded as "D"
18 and "E" which were also worsened from external
19 impacts from the proposed development. The P.M.
20 peak at this intersection would be reduced from
21 a "D" to an "E" with the increased wait time of
22 7.2 seconds, a 20 percent increase and the A.M.
23 peak would have an increase wait time of 5.5
24 seconds or a 14 percent increase. No traffic

1 mitigation measures were offered or proposed by


2 the applicant to offset these external negative
3 impacts in the surrounding village community.
4 MR. GADDES: We have testimony
5 regarding the overall traffic impact in terms of
6 overall percent of impact. My understanding is
7 those will be in the under 10 percent increase
8 in traffic. More in the 4 to 7 percent
9 increase. It was under 10. It was between a 4
10 and 7 percent increase of the overall traffic
11 volume based on the current project.
12 MR. CHARLAND: Adding to No. 17
13 testimony from Mr. Cronin of Cross Engineering
14 indicated that an average area impact of traffic
15 to increase 4 to 7 percent overall with the
16 traffic in the community from the planned
17 project.
18 MR. GADDES: Yes.
19 MR. CHARLAND: No. 18. The zoning
20 board reviewed the findings that the negative
21 traffic impacts associated with the development
22 on the village are not acceptable, will lead to
23 traffic movement delays, will increase the risk
24 and frequency of vehicular accidents. And since

1 no mitigation measures were offered by the


2 applicant to the public's health, safety and
3 welfare could be inferred. Any questions or
4 comments?
5 No. 19. That the Town of Situate's
6 Comprehensive Plan contains several citations
7 that could be considered to be contrary to the
8 project including the cultural resource element,
9 the housing element and the economic development
10 element. I specifically cited in this right
11 here Section H-3.1.6.2 Threats to Rural
12 Character. Section H-3.1.6.3 Threats to Village
13 Character. Section H-3.1.6.4 which is
14 Incremental Development. I also cited Housing
15 Elements E-3.1 Goals and Policies. E-5.2.4
16 Summary of Need. The last area of the
17 comprehensive plan was Economic Development
18 F-1.0 Introduction. I have those noted here if
19 you'd like me to read those.
20 MR. GADDES: Yes. I think we
21 should read those.
22 MR. CHARLAND: Okay. Cultural
23 Resource Element H-3.1.6.2 Threats to Rural
24 Character. The integration of new and historic

1 residences constitutes another threat to rural


2 Scituate's character. Often sited close to
3 historic structures, new houses frequently does
4 not mirror the design, quality, materials or
5 sensitive sitings of its predecessors detracting
6 from appreciation of existing architecture and
7 muddling the perception of historic settlement
8 patterns. H-3.1.6.3 Threats to Village
9 Character. The village of Hope provides another
10 interpretation of the 19th Century New England
11 in its nearly intact illustration of a mill
12 village, housing and associated developments.
13 The Hope Mill Complex including an 1840 stone
14 textile mill and subsequent additions represents
15 the living testimony to the state's industrial
16 architecture and history. The mill should be
17 examined for use potentials should it fall into
18 disuse. While they retain the architectural
19 styles and scale of the original settlement,
20 many of the residential neighborhoods in the
21 Hope Village are threatened by deterioration.
22 Initiatives should be sought for rehabilitating
23 these structures and their associated property
24 in a manner that will not disrupt a cohesive

1 whole of the village. H-3.1.6.4 Incremental


2 Development. The development which introduces
3 uses without regard for neighborhood character
4 or is otherwise uncoordinated with actual
5 community needs is overall detrimental to the
6 community's character. As a result of such
7 uncoordinated growth, many historic buildings
8 can become separated from the environmental
9 context in which they are best appreciated
10 creating visual intrusions or conflicting uses
11 that devalue historic properties and negatively
12 affect the quality of life.
13 Housing Elements. The next section of the
14 zoning board of the comprehensive plan.
15 E-3-1 Goals and Practices and Policies. Through
16 zoning slight modifications of that density
17 level can be known to encourage two objectives.
18 The production of affordable housing units as
19 part of a private sector subdivision and two
20 subdivisions siting which is respectful of rural
21 character. Therefore, it is recommended that
22 throughout undeveloped areas of the town allow
23 initiatives to density increases and flexibility
24 citing to developments which protect rural

1 character for affordable housing. That's


2 E-5.2.4 Summary of Need. Scituate's ability to
3 meet its housing needs must be concentrated in
4 two areas: 1) Zoning changes which provide
5 inducements for the creation of affordable
6 housing units by private Building 3 developers.
7 2) Proactive steps such as continuation of the
8 regional western Rhode Island home repair
9 program and creation of a regional community
10 land trust in cooperation with several adjoining
11 communities and I believe it's state agencies is
12 what it should have been. The creation of
13 multi-family housing in Scituate is not feasible
14 on one hand only to the constraints of the
15 watershed protection and lack of sewers. On the
16 other hand, due to the difficulty in satisfying
17 density requirements in existing zoning. While
18 there may be some Buildings suitable for limited
19 conversions to three or more housing units
20 including commercial industrial structures and
21 mill buildings, no sites are specifically
22 recommended since they lack the critical
23 environmental capability required. The proposed
24 zoning would require such an environmental

1 evaluation as a prerequisite to any exceptions.


2 It would be ideal to locate larger scale
3 multi-family developments in areas a far
4 distance from the reservoir watershed protection
5 zones and/or in areas with sewer and water or in
6 areas with potential for sewer and water
7 expansion.
8 The last section. Economic Development.
9 F-1.0 Introduction. Situate essentially is a
10 commuter town with between 80 and 90 percent of
11 its employable residents working in other parts
12 of the Providence Metropolitan area. That was
13 the sitings of the comprehensive plan. Those
14 were the proposed findings of fact that I came
15 up with. I invite the zoning board members to
16 add any additional information that you feel
17 should be noted in the facts.
18 MR. DURFEE: I wanted to note in
19 the --

21 MR. DURFEE: Under the
22 implementation of the Scituate Comprehensive
23 Plan, it also notes that subdivision regulations
24 is a 10 percent density increase for a

1 subdivision with ten or more units if they are


2 including affordable units. In section L-2.1.2,
3 the housing under the Scituate comprehensive
4 plan implementation chart prioritize goals by
5 element.
6 MR. CHARLAND: At this time, I'm
7 adding L.2.1 subdivision potential increase
8 allowed of 10 percent if including affordable
9 housing units; is that correct?
10 MR. DURFEE: Yes.
11 MR. CHARLAND: Any other
12 additions, deletions or any other comments?

16 for the variances, the zoning variances and the
17 Special Use Permit?

2 THE BOARD: A show of hands.
3 MR. CHARLAND: I will also
4 approve. It will be universal, as all five
5 approved that. Having addressed that, the first
6 item I'd like to take is the Special Use Permit
7 discussion. The finding -- we must find that it
8 is compatible with the neighborhood and the
9 neighboring land uses. It will not create a
10 nuisance in the neighborhood. It must not
11 hinder future development of the town. It must
12 be in conformance with the town's comprehensive
13 plan and the town's zoning ordinances. I have
14 in preparation in terms of its compatibility
15 with the neighboring land uses. The uses to
16 establish 193 dwelling units on the subject
17 property which we acknowledge in the statement
18 of the facts. We also knowledge that it is out
19 of scale with the character of the surrounding
20 village which would introduce development that
21 is out of scale to the rest of the community.
22 It's intensity and the impacts would not be
23 compatible with the neighboring village.
24 Further, the two buildings proposed in

1 Phase 3 are considered out of scale with the


2 existing Hope Mill property and out of character
3 with the surrounding area which is generally
4 rural in character with low density. The size,
5 scale, configuration and the location of the
6 proposed new buildings would impair the
7 character of the mill property and constitute a
8 density of development that is more appropriate
9 in an urban setting. Not compatible with the
10 Hope Mill Village. I also noted that the use is
11 specifically authorized under Article 2 Section
12 2 District Use Regulations Subsection 3 for
13 multi-family dwelling structures. The density
14 requirement is 40,000 square feet per dwelling
15 unit for developments in excess of the
16 thirty-five dwelling units which is in
17 accordance with Article 3 Section 3 Subsection 5
18 of the Situate Zoning Ordinance for a total
19 required area of 7,720,000 square feet. The
20 developers are proposing a density of
21 7,272 square feet per dwelling unit,
22 approximately, 18 percent of that which is
23 required under our zoning ordinance for a
24 multi-family development. That, in my mind, is

1 not compatible with the neighboring land uses.


2 Any discussion on that? I will move on. It
3 will not create a nuisance in the neighborhood
4 which was the other aspect that we have to
5 justify. The external impacts from the
6 spillover parking for the proposed development
7 into the village and the increased segregation
8 of the village traffic circulation and safety
9 constitute a nuisance to the neighborhood. The
10 board considers the development to be an urban
11 development proposed in a rural community. As a
12 result, the zoning board of review is concerned
13 that the parking spaces provided by the
14 applicant will not be sufficient to prevent
15 spillover parking from occurring in the
16 neighboring community thereby causing
17 disruption and further congestion on the
18 village's area of the street system. As urban
19 communities provide alternate transportation
20 options such as taxicab and bus transportation
21 to relieve parking burdens, which are not
22 available to rural Scituate.
23 Further, the zoning board is of the
24 opinion that urban communities may also provide

1 ample on-street parking and off-site parking


2 options that are not readily available in this
3 area. The proposed parking spaces are
4 insufficient to prevent off-site spillover into
5 the village community, or other off-site parking
6 will lead to congestion and make passage of
7 vehicles including public safety, emergency
8 response vehicles compromised and possibly in a
9 dangerous situation. Any discussion? C) It
10 will not hinder the future development of the
11 town. My comment to that is, the proposed
12 development will have negative impacts on the
13 village including visual impacts, traffic
14 circulation and parking issues which may hinder
15 future development of the town. Any discussion?
16 MR. GADDES: It's from an overall
17 town standpoint. I don't see that this
18 particular development would hinder the future
19 development of the overall town. It may hinder
20 the development within the village itself.
21 MR. CHARLAND: If I change the
22 wording to, the proposed development will have
23 negative impacts on the village including visual
24 impacts, traffic circulation and parking issues

1 which may hinder the future development of the


2 Hope Village. Is that acceptable?
3 THE BOARD: Yes.
4 MR. CHARLAND: All are in
5 agreement with that. D) It will be in
6 conformance with the purposes and intent of the
7 comprehensive plan and the zoning ordinance.
8 The proposal is out of scale with the land use
9 policies contained in the town's comprehensive
10 community plan. Although affordable housing is
11 proposed as part of the project, the negative
12 externality associated with the project on the
13 village and the town's resources are considered
14 to be outweighing the offering. Overall, the
15 project is not in conformance with the purposes
16 and intent of the comprehensive plan and the
17 zoning ordinances. That the Town of Situate's
18 comprehensive plan contains several citations
19 that could be considered to be contrary to the
20 project including the cultural resources
21 development, the housing element and the
22 economic development element as was cited under
23 our statement of facts in each of these separate
24 items.

1 That gentleman, would be the findings of


2 it not being compatible with the neighborhood.
3 Not creating a nuisance in the neighborhood.
4 Must not hinder future development of the town,
5 and must be in conformance with the town's
6 comprehensive plan. We are finding that it's

7 The other point. There's a meeting going

9 that is coming up as it relates to the school
10 bond issue. After we adjourn, I will call
11 Carolyn Diaz, who is on the school committee and
12 conducting tours of the building. I will find
13 out where they are, if anybody is so inclined to
14 go there. I was asked if one meeting ended to
15 let you know that. If you are interested, come
16 to the front and I will let you know where that
17 is. Having heard all of that -- Based on the
18 information that has been presented our attorney
19 is asking that you authorize myself and Peter
20 once we have the information from the
21 presentation of what we have done to sign the
22 zoning letters so that we do not have to go back
23 to a public meeting again before releasing the
