Nevada is in the United States Court of Appeals for the Ninth Circuit. (Underwood & Webb, p. 15)

The Nevada Constitution:

Article eleven of the Constitution of the State of Nevada pertains to education. This article of Nevadas
Constitution contains ten sections.

Section one instructs the Nevada legislature to provide for a Superintendent of Public Instruction and to
prescribe the manner of his or her appointment, term, and duties. Additionally, this section urges the
legislature to encourage the teaching of intellectual, literary, scientific, mining, mechanical, agricultural,
and moral improvements.

Section two instructs the legislature to establish public common schools (K to 8th grades) maintained
within school districts. Laws are to be passed that aim to have children attend these public schools for at
least six months in every year. Schools will be non-sectarian (non-religious); any school allowing
sectarian schooling will be deprived of funding.

Section three provides for funds for education from properties, money, lands, fines, and interest to be
utilized to fund education and university.

Section four instructs the legislature to establish and fund a State University that teaches agriculture,
mechanical arts, and mining. The constitution states the university is to be controlled by a Board of
Regents whose duties are to be prescribed by law.

Section five grants the power to the legislature to establish a normal school (a school for teachers and
professors) within the university. It requires teachers and professors to take an oath of office pledging
loyalty to the United States and the Federal Constitution and to Nevada and the State Constitution.

Section six requires the legislature in its biennial budgeting to fund schooling for grades kindergarten
through 12 as its first order of business.

Section seven establishes the first University Board of Regents as the Governor, Secretary of State and the
Superintendent of Public Instruction. Additionally, it instructs the legislature to pass laws for electing a
new Board of Regents and defining their duties.

Section eight calls for the Board of Regents to establish a university with funds granted to the state by the
United States Congress. It instructs the legislature to replenish the funds if they are lost.

Section nine establishes that no sectarian (religious) instruction will be allowed in state established
schools or universities.

Section ten establishes that no public monies or support will be given to support sectarian (religious)
purposes.
