SIMULTANEOUS SALE

KNOW ALL MEN BY THESE PRESENTS:

KEZIAH JIREH R. PALAY-TAWTAWAN, of legal age, Filipino,


married to JONATHAN B. TAWTAWAN and with address at
Poblacion, Narra, Palawan;

KEVIN JEZER R. PALAY, of legal age, Filipino, single and


with address at Brgy. Tiniguiban, Puerto Princesa City; and

KARL JASPER R. PALAY, minor 16 years old, Filipino, single


and with address at Brgy. Nicanor Zabala, Roxas, Palawan,
herein represented by his legal guardian KEZIAH JIREH R.
PALAY-TAWTAWAN, of legal age, Filipino, married and with
address at Poblacion, Narra, Palawan, hereinafter referred to
as the HEIRS; and

DON JOSE R. VALENCIA of legal age, Filipino single and a


resident of Brgy. Bancao-Bancao, Puerto Princesa City,
hereinafter referred to as VENDEE.

WITNESSETH:

WHEREAS, the above name parties are the legitimate children and
legal heirs of the late EVELYN R. PALAY who died, intestate on
November 30, 2014 at Brgy. Nicanor Zabala, Roxas Palawan, without
any will;

WHEREAS, upon hers death, the said decedent left one half ( )
conjugal share plus one fourth () hereditary share of the unsegregated
portion of three (3) parcels of land located in the Municipality of Roxas,
Province of Palawan, said parcels of land are more particularly described
as follows:

That no personal property is involved in this extrajudicial


settlement of estate;

That to the best knowledge and information of the parties hereto


the said deceased left no debts;

That a true copy of this extra-judicial settlement shall be published


once a week for three (3) consecutive weeks in a newspaper of general
circulation in the Province of Palawan;

That it is to the best interest of the parties hereto to divide,


partition and adjudicate between themselves the entire estate
particularly the real property above described extrajudicially in the
manner and form hereinafter setforth;

NOW THEREFORE, for and in consideration of the foregoing


premises, and pursuant to the provision of Section 1, Rule 74 of the
Rules of Court, the parties agreed as they hereby do so agree to divide,
partition and adjudicate the above-estate among themselves equally in
the following manners;

To: KEZIA JIREH : One third (1/3) share on the one half
(1/2) conjugal share plus one fourth
(1/4) on the hereditary share
representing her lawful share from her
mothers estate.

To: KEVIN JEZER : One third (1/3) share on the one half
(1/2) conjugal share plus one fourth
(1/4) on the hereditary share
representing his lawful share from his
mothers estate.

To: KARL JASPER : One third (1/3) share on the one half
(1/2) conjugal share plus one fourth
(1/4) on the hereditary share
representing his lawful share from his
mothers estate.

HOWEVER the parties hereto have agreed that Lot 76 Psd-04-


042104 (AR) consisting of TWENTY THOUSAND THREE HUNDRED NINETY
SEVEN (20,397) SQUARE METERS covered by TRANSFER CERTIFICATE OF
TITLE NO. 065-2015000273 should be subdivided into four (4) lots and
agreed to Partition as follows:

To: KEZIA JIREH : Lot 76-A with an area of 6,799 Square meters.
To: KEVIN JEZER : Lot 76-B with an area of 3,201 Square meters.
To: KEVIN JEZER : Lot 76-C with an area of 3,598 Square meters.
To: KARL JASPER : Lot 76-D with an area of 6,799 Square meters.

THEREFORE, WE, KEZIA JIREH R. PALAY-TAWTAWAN of legal


age, Filipino, married to JONATHAN TAWTAWAN and KEVIN JEZER R.
PALAY, likewise of legal age, Filipino, single, for and in consideration of
the sum of PESOS TWO MILLION (P2,000,000.00) Philippine Currency,
DO HEREBY SELL, TRANSFER and CONVEY by way of Absolute Sale
unto the said VENDEE his heirs and assign our inherited properties
described as Lot No. 76-A consisting of 6,799 SQUARE METERS (share
by Vendor Kezia Jireh) and Lot No. 76-B consisting of 3,201 SQUARE
METERS (portion share by Vendor Kevin Jezer) and said properties are
more particularly described as follows:

voluntary act and deed.

This instrument consist of four (4) pages including this


acknowledgment signed by the parties together with their instrumental
