STATE MINISTER OF ENVIRONMENTAL AFFAIRS DECREE

NUMBER 111 YEAR 2003
REGARDING
GUIDELINES OF REQUIREMENTS, PERMIT PROCEDURES AND STUDIES
FOR WASTEWATER DISPOSAL INTO THE WATER OR WATER RESOURCES

STATE MINISTER OF ENVIRONMENTAL AFFAIRS ,

Consider: that in order to implement stipulation Article 41 verse (7) and verse
(8) Government regulation Number 82 Year 2001 regarding Water
Quality Management and Water Pollution Restraint, thus
considered that need to establish State Minister of Environmental
Affairs Decree regarding Guidelines of Requirement and Permission
Procedure, and Studies Guidelines of Wastewater Disposement Into
The Water or Water Resources;

Recalling: 1. The Act Number 23 Year 1997 regarding Environmental

Management (Supplement State Gazette Number 3699);
2. The Act Number 22 Year 1999 regarding Region Government
(State Gazette Year 1999 Number 60, Supplement State Gazette
Number 3839);
3. Government Regulation Number 35 Year 1991 regarding river
(State Gazette Year 1991 Number 24, Supplement State Gazette
Number 3409);
4. Government Regulation Number 27 Year 1999 regarding
Analysis of Environment Impact (State Gazette Year 1999
Number 59, Supplement State Gazette Number 3838);

Determine: GUIDELINES OF REQUIREMENTS, PERMIT PROCEDURES

AND STUDIES FOR WASTEWATER DISPOSAL INTO THE
WATER OR WATER RESOURCES.

Article 1
Every work and or activity is banned to dispose wastewater that contain radioactive
into the water or water resources.

Article 2
Regent/Mayor is banned to publish the permission of wastewater disposal into the
water or water resources that contravene the standard of water quality and cause the
water pollution.

Article3
(1) Every work and or activity that will dispose wastewater into the water or water
resources must get the written permission from Regent/Mayor.
(2) Permission proposal as mentioned on verse (1) is based on analysis of studies
result concerning environment impact or studies of environment management
efforts and environment monitoring efforts.
(3) The requirements of permission of wastewater disposement into the water or
water resources must obey the requirements as mentioned on Article 38 verse
(2) Government Regulaition Number 82 Year 2001 regarding Water Quality
Management and Water Pollution Restraint.

Article 4
(1) Permission proposal to dispose wastewater into the water or water resources
must completed the data and information with using the form as enclosed in
this Decision.
(2) Data and information as mentioned on verse (1) above are one of condition for
permission proposal wastewater disposal into the water or water resources.
(3) Besides rules and regulations as mentiones on verse (2) above, permission
proposal must completed with:
a. Studies result document of wastewater disposal into the water or water
resources;
b. Monitoring result of environment management in the last month;
c. Other document that related to the form filling up as enclosed in this
Decision;

 Article5
Studies as mentioned on Article 2 verse (3) based on:
a. Industry classification and business classification and or related activities;
b. Environment color;
c. The total waste that disposed;
d. Load capacity of water pollution as mentioned on State Minister of
Environmental Affairs Decision Number 110 Year 2003 concerning Guidelines
of The Determining of Water Pollution Load Capacity to water resouces.

Article 6
Regent/Mayor must attached on the permission of wastewater disposalt into the
water or water resources, the entire obligations and ban for business and or activity as
enclosed on Government Regulation Number 82 Year 2001 regarding Water Quality
Management and Water Pollution Restraint.

Article7
The permission of wastewater disposal is regulated by the separate legislation
regulation.

Article 8
This Decision will be valid on the date that have been decided.

On 27 June 2003

I. The procedure of giving the Wastewater Disposal permission

1. The applicant propose permission to Regent/Mayor through head of
instance that responsible in the Regency/City..
2. Permission proposal letter is made in certain double amount agree with
the Regent/Mayor policy.
3. Head of Instance that responsible in the Regency/City check the
permission proposal requirement completeness, if it is not complete, sent
it back to the permission applicant.
4. Head of Instance that responsible in the Regency/City assign technical
team to do research paper and process the permission proposal.
5. Technical team researchs and processes the permission proposal
document include phase:
a. Field visit if needed;
b. Discussion session;
c. Arranging the draft of permission letter.
6. Regent/Mayor is issuing, delaying, or refusing the permission letter.
7. Permission letter, Deferment letter, or refusal letter is accepted by
permission applicant.

Information:
Technical team is a team that is formed by Regent/Mayor which have as members
from instance that has duty and function related to water management or business
service instance and or permission applicant activity.

II. The Process of Wastewater Permission into the Surface Water.
