ISLAMIC WILL AND TESTAMENT

TESTATOR

City/Town of Residence:_____________________ Region/County _______________

State/Province______________________Country_____________________________

Pursuant to the Prophets (saws) advice for Muslims to write their wills,

I, ______________________________________________being of sound mind and

memory, do hereby revoke any and all former wills and amendments, and declare that
this is my last Will and Testament. This supersedes any previous Will or Testament that I
have written and signed.

All praise is due to Allah in whom we believe and from whom we seek forgiveness and
help. We seek refuge in Allah from all evil and bad deeds, our own and those of others.
Whosoever Allah guides, no one can lead astray; and whosoever Allah leads astray, no
one can guide. Abdallah ibn Umar (ra) narrates that the Messenger of Allah (saws) said:
It is not permissible for any Muslim who has something to will to stay for two nights
without having his will and testament written and kept ready with him. (Sahih Al-
Bukhari).

My bequest is as follows:

I, ____________________________________ bear witness that there is no god except

Allah, that He has no partners, and that Muhammad (saws) is His slave and Messenger;
and that the Hour for certain will come, and that Allah will resurrect all those who are in
the grave.

I ask those who survive me from among my relatives and immediate family members to
fear Allah (saws) and to obey Allah and His Messenger (saws) as Allah orders in the
Quran: So fear Allah and keep straight the relations between yourselves and obey Allah
and His Messenger if you have indeed made a firm commitment [to Allah]. (Surah al-
Anfal: 1).

I also enjoin upon those of my family who survive me what Prophets Ibrahim and Yaqub
(peace be upon them) directed their sons: O my sons, Allah has chosen for you the deen
[of Islam], so do not die except as Muslims [in a state of submission to Allah]. (Surah
al-Baqarah [2]:132).
I request that when I approach death, the best of people with the utmost iman (faith) be
called to remind and encourage me to say the words of the Shahadah: Ash-hadu Allah
ilaha il-Allah, wa Ash-hadu Ana Muhammadun Rasulullah. This is in accordance with the
Prophets saying: Anyone whose last words were La ilaha il-Allah will enter Paradise.
[Ahmad, Abu Dawud and al-Hakim - Sahih.]

There is no god except Allah. Indeed, to Allah we belong and to Him is our return. O
Allah, help me in this affliction and replace it with something better for me.

Upon my death, my last rites should be performed in accordance with the Islamic
traditionwashing of the body and shrouding it in three pieces of unstitched cloth (five
for women)in preparation for burial. After I have been buried, the first thing that must
be done is to clear all my debts (if any), as the believers soul is held back by his
liabilities.

I, ______________________________________ nominate, constitute and appoint

my executor, herein named, first apply the assets of my estate to the payment of all my
legal debts, including such expenses incurred by my last illness and burial, as well as the
expenses of the administration of my estate. I direct said executor to pay any outstanding
obligations that are binding on me before Allah including unpaid Zakat, vows and
kaffarahs.

2: I direct that all inheritance, estate and succession taxes (including interest and
penalties thereon), payable by reason of my death, shall be paid out of, and be charged
generally against, the principal of my residuary estate without reimbursement from any

each and every point. The distribution of the residue and remainder of my estate shall be
made by my executor strictly in accordance with the Islamic Law of Inheritance (based
on Surah An-Nisa (4):11-12; namely, male children shall get the equivalent of the portion
of two female children of the residue of the estate while the wife is entitled to one-
eighth).
2: My final bequest for my family and children is the same one that the Messenger of
Allah (saws) enjoined upon his followers: The prayer, the prayer, and I advise my family
to have patience and accept Allahs will. (Surah al-Baqarah:156).

3: This is my last will and testament, and so I am now free before Allah (saws) from any
words or deeds that distort and contradict the guidance of Allahs Messenger (saws), as is
forewarned by the following Quranic verses: Then whoever alters it [i.e. the bequest]
after he has heard it - the sin is only upon those who alter it. (Surah al-Baqarah:181).

Glory be to your Lord, the Lord of Honor and Might, [who is free] from what they
ascribe to Him. And peace be upon the Messengers. And praise be to Allah, Lord of the
worlds. (Surah as-Saffat:180-182)
