1.00 NOTICE INVITING TENDER

1.1 Sealed Items Rate TENDERS are hereby invited for and on behalf of M/s Corona Housing Pvt. Ltd.
for the following works:

1.2 The Tender document will be issued by the Services Consultants, M/s Krim Engineering Services Pvt
Ltd., B 140, Freedom Fighters` Enclave, Neb Sarai, IGNOU Road, New Delhi 110 068 on all working
days between 11.00 a.m. to 5.00 .p.m. except Sunday or Public Holidays, from . to on
cash payment of Rs. ---------------- . The intending tenderer shall send the authority letter in the name of
person, who is entrusted to collect the tender documents.

1.3 The sealed Bid shall be received at M/s Corona Housing Pvt. Ltd. . upto 5.00 p.m on .

1.4 This Notice Inviting Tenders and enclosed Specifications, General Conditions, Commercial Terms &
Conditions, Bill of Quantities along with its preamble and Tender Drawings etc. shall form the TENDER
DOCUMENTS.

1.5 The Rates should be quoted in figures and words and TENDERER shall give the respective amounts or
total. In case of any difference in rates in figures / words, those given in words, shall hold good as
quoted rate.

1.6 TENDERER shall quote for all items of work and in case TENDERER does not quote for any items, it
will be presumed that the cost of said item is already included in other items and the CONTRACTOR
shall execute the item without any extra cost to the Owner.
1.07 The TENDERS shall remain valid for acceptance for 60 (Sixty) days from the due date of Submission.

The site is available and is free from any encumbrances and TENDERER shall be deemed to have
visited the site and seen the site conditions before quoting his TENDER. No claim on grounds for want
of such knowledge / site inspection shall be entertained at any stage.

Tender shall be signed by the legally authorised representative of the TENDERER with TENDERERS
full name, designation, and his complete address shall be given. Tender is to be submitted in a sealed
cover superscribed TENDER DOCUMENT FOR DESIGN, SUPPLY, INSTALLATION, TESTING &
COMMISSIONING OF ELECTRIC PASSENGER LIFTS FOR TAJ GATEWAY RESORT AT THIOG,
SHIMLA

All pages of the Tender document shall be signed & stamped by signatory of the TENDERER.

1.09 Incomplete and late TENDERS shall be rejected without any further reference.

1.10 The Owner reserves the rights to split the contract amongst two or more tenderers and to reject any / all
TENDERS without assigning any reason and shall not be bound to accept the lowest or any other
TENDER.

1.11 After acceptance of the tender the TENDERER shall sign the necessary agreement within fifteen days
of intimation

NOTE: Each tenderer shall submit the documentary proof for his registrations e.g. PAN Number for
Income Tax, Latest I.T.C.C., Works Contract Tax Registration, P.F. and ESI registration Nos, etc.
alongwith his tender.

21. Fireman switch At ground floor lobby

22. Car frame : The car frame supporting car platform and enclosures,
will be made of structural steel and equipped with
suitable guiders and other car safety devices mounted
underneath the car platform. The hoist ropes will
include adjustable self aligning nitches. On top of the
car body, a railing is to be provided
23. Car safety : Car safety shall be provided against

i) Excessive descending speed

ii) Falling of car in case of failure of hoist ropes

iii) Provision of electro mechanical door locks at the


'landing doors to prevent car from moving away
from the landing unless doors are closed and
locked. The doors should not open unless the car
is in the stop position at landing.

24. Top of car inspection operation : A car operating fixture will also be provided on car top
and will contain continuous pressure buttons for
operating the car in both directions and a toggle switch,
on top of the car, for making the buttons operative. This
toggle switched to inspection operation will modify the
operation of that car to disconnect it from the group
operation, if any, hall buttons, to eliminate all normal
operating devices, automatic leveling and power door
operation if applicable, and the car will run at normal or
reduced speed.

25. Counter balance : A suitable guided structural steel frame with


appropriate metal weights.

26. Terminal and final limits : Terminal limit switch will be provided to slow down and
to stop the car automatically at the terminal landings
and final limit switches to automatically cut off the
power supply and apply the brake so that the car
should not travel beyond the terminal landing

27. Terminal Buffers : Suitable spring buffers for stopping the car and counter
weight at the extreme limits of travel shall be provided
in the case of pit, they should be mounted on steel
channels which extend between both the car and the
counter weight guide rails.

A duly painted MS ladder is to be provided in each lift


pit.

28. Rope : Elevator shall be provided with traction steel hoist


ropes conforming to IS 2365:1977 (with latest
amendments). Minimum dia of rope shall be 10mm.
29. Controller : Electro magnetic controller adaptable with micro
processor shall be provided to control starting,
stopping and speed of elevator motor and also
automatically apply the brake if any of safety devices
operate or power supply fails from any cause.

Control cabinet will be provided with doors or louvers


and adequate ventilation and shall be placed in the
machine room.

A (single phase preventor & phase reversal relay) shall


be provided on the controller.

30. Machine : Elevator machine consisting of main hoist motor,


electro mechanical brake, reduction gear, chromium
molybdenum and ferro molybdenum sheave and steel
sheave shaft all compactly mounted on a single base
or bed plate for perfect alignment and for continuous
operation.

The worm shaft will be provided with taper roller


bearing to take the end thrust and self aligning
spherical roller bearing will be furnished for the sheave
shaft to ensure alignment and long bearing life. The
driving sheave will be grooved to ensure sufficient
traction and minimum rope wears.

Adequate means for lubrication shall be provided for all


bearings and worm gear. Electro magnetic brakes
spring applied, electrically released and designed to
provide smooth stops under variable loads shall be
provided. Oil sealing and oil level indicator shall also
be provided in the gear box. The elevator machines
shall be erected in a way, so that the load is transferred
to the main columns and not in the machine room slab.

31. Brake : The direct current brake will be spring applied and
electrically released and designed to provide smooth
stops under variable loads.

32. Motor : As per lift manufacturers requirement for variable


voltage and variable frequency control and having
Class F Insulation.

33. Micro self leveling : The elevator will be provided with a micro self leveling
feature that will automatically bring the car to the floor
landings. This micro leveling within its zone shall be
entirely automatic and independent of the operating
device and will not permit over travel or under travel.
34. Over speed governor : The safety device will be operated by a centrifugal
speed governor located at the top of the hoist way and
connected to the motor through a continuous steel
rope. Suitable means will be applied to cut off power to
the motor and apply the brake on application of the
safety devices.

35. Tee guides : Steel Tee guides duly tongued and grooved Shall be
provided for elevator and counter weight for the guided
rails shall be fixed to the hoist way wall by means of
steel brackets and sliding clips.

36. Hand winding and brakes release


device : Hand winding and brake release device shall be
provided

37. Wiring : Wiring from main control board to the controller and
from controller to other electrical equipments shall be
done in MS conduits with removable covers for ease of
maintenance and shall be done with PVC insulated
copper wires of adequate size and conforming to IS :
1554/Pt.1- 1964. All conduits in the machine room shall
be properly painted.

All multi-core travelling cables used for the car shall


conform to IS : 4289. Control cable shall be used for
light & fan circuit. There shall be separate cables for
light, fan and signal circuits & properly tagged for
identification.

38. Layout of equipment in the


machine room : The layout of the various equipments shall be such as
not to cause any hindrance to the free movement
inside the machine room.

39. Building work : All the minor building work such as making of holes for
fixing guide brackets etc. also making good the
damages shall be done by the Contractor including
scaffolding, painting, supply and erection of bearing
plates, buffer support channels, facia plates, ladder in
pit & other structure as required. MS beam / hook for
lifting the machine will be provided by the Owner.

40. Electrical control board : Cubical type control board in machine room shall be
provided by the OWNER, requirement to be indicated
by lift manufacturer.

41. Performance & type test : The stage manufacture type and performance test at
works/site on contracts, door operation door lock and
any other accessories must be done in accordance
with IS : 4666-1980 by the lift supplier.
42. Guarantee : The guarantee for a period of 12 months after final
commissioning for trouble free performance against
defective workmanship or manufacture for over wear
and tear in parts not attributable to negligence shall be
given along with tender.

43. Free post commissioning


maintenance service : The supplier must give 18 months free post
commissioning maintenance service.

44. Drawing and literature : The supplier must provide general arrangement layout
drawing of the elevator on award of contract.
Necessary number of final approved layout drawings
are to be provided for purchasers records. In addition
to the elevator drawing wiring diagram, maintenance
and lubricating check chart are also to be supplied on
completion of installation. Schematic wiring diagram is
to be displayed in the machine room as per applicable
lift code.

45. Foundation : The structural work required for the foundation of the
lift machine shall be done by other agency. The lift
manufacturer shall provide the details of the foundation
/lift well lights and power socket outlets as required.

21. Fireman switch At ground floor lobby

22. Car frame : The car frame supporting car platform and enclosures,
will be made of structural steel and equipped with
suitable guiders and other car safety devices mounted
underneath the car platform. The hoist ropes will
include adjustable self aligning nitches. On top of the
car body, a railing is to be provided
23. Car safety : Car safety shall be provided against

i) Excessive descending speed

ii) Falling of car in case of failure of hoist ropes

viii) Provision of electro mechanical door locks at the


'landing doors to prevent car from moving away
from the landing unless doors are closed and
locked. The doors should not open unless the car
is in the stop position at landing.

24. Top of car inspection operation : A car operating fixture will also be provided on car top
and will contain continuous pressure buttons for
operating the car in both directions and a toggle switch,
on top of the car, for making the buttons operative. This
toggle switched to inspection operation will modify the
operation of that car to disconnect it from the group
operation, if any, hall buttons, to eliminate all normal
operating devices, automatic leveling and power door
operation if applicable, and the car will run at normal or
reduced speed.

25. Counter balance : A suitable guided structural steel frame with


appropriate metal weights.

26. Terminal and final limits : Terminal limit switch will be provided to slow down and
to stop the car automatically at the terminal landings
and final limit switches to automatically cut off the
power supply and apply the brake so that the car
should not travel beyond the terminal landing

27. Terminal Buffers : Suitable spring buffers for stopping the car and counter
weight at the extreme limits of travel shall be provided
in the case of pit, they should be mounted on steel
channels which extend between both the car and the
counter weight guide rails.

A duly painted MS ladder is to be provided in each lift


pit.

28. Rope : Elevator shall be provided with traction steel hoist


ropes conforming to IS 2365:1977 (with latest
amendments). Minimum dia of rope shall be 10mm.
29. Controller : Electro magnetic controller adaptable with micro
processor shall be provided to control starting,
stopping and speed of elevator motor and also
automatically apply the brake if any of safety devices
operate or power supply fails from any cause.

Control cabinet will be provided with doors or louvers


and adequate ventilation and shall be placed in the
machine room.

A (single phase preventor & phase reversal relay) shall


be provided on the controller.

30. Machine : Elevator machine consisting of main hoist motor,


electro mechanical brake, reduction gear, chromium
molybdenum and ferro molybdenum sheave and steel
sheave shaft all compactly mounted on a single base
or bed plate for perfect alignment and for continuous
operation.

The worm shaft will be provided with taper roller


bearing to take the end thrust and self aligning
spherical roller bearing will be furnished for the sheave
shaft to ensure alignment and long bearing life. The
driving sheave will be grooved to ensure sufficient
traction and minimum rope wears.

Adequate means for lubrication shall be provided for all


bearings and worm gear. Electro magnetic brakes
spring applied, electrically released and designed to
provide smooth stops under variable loads shall be
provided. Oil sealing and oil level indicator shall also
be provided in the gear box. The elevator machines
shall be erected in a way, so that the load is transferred
to the main columns and not in the machine room slab.

31. Brake : The direct current brake will be spring applied and
electrically released and designed to provide smooth
stops under variable loads.

32. Motor : As per lift manufacturers requirement for variable


voltage and variable frequency control and having
Class F Insulation.

33. Micro self leveling : The elevator will be provided with a micro self leveling
feature that will automatically bring the car to the floor
landings. This micro leveling within its zone shall be
entirely automatic and independent of the operating
device and will not permit over travel or under travel.
34. Over speed governor : The safety device will be operated by a centrifugal
speed governor located at the top of the hoist way and
connected to the motor through a continuous steel
rope. Suitable means will be applied to cut off power to
the motor and apply the brake on application of the
safety devices.

35. Tee guides : Steel Tee guides duly tongued and grooved Shall be
provided for elevator and counter weight for the guided
rails shall be fixed to the hoist way wall by means of
steel brackets and sliding clips.
36. Hand winding and brakes release
device : Hand winding and brake release device shall be
provided

37. Wiring : Wiring from main control board to the controller and
from controller to other electrical equipments shall be
done in MS conduits with removable covers for ease of
maintenance and shall be done with PVC insulated
copper wires of adequate size and conforming to IS :
1554/Pt.1- 1964. All conduits in the machine room shall
be properly painted.

All multi-core travelling cables used for the car shall


conform to IS : 4289. Control cable shall be used for
light & fan circuit. There shall be separate cables for
light, fan and signal circuits & properly tagged for
identification.

38. Layout of equipment in the


machine room : The layout of the various equipments shall be such as
not to cause any hindrance to the free movement
inside the machine room.

39. Building work : All the minor building work such as making of holes for
fixing guide brackets etc. also making good the
damages shall be done by the Contractor including
scaffolding, painting, supply and erection of bearing
plates, buffer support channels, facia plates, ladder in
pit & other structure as required. MS beam / hook for
lifting the machine will be provided by the Owner.

40. Electrical control board : Cubical type control board in machine room shall be
provided by the OWNER, requirement to be indicated
by lift manufacturer.

41. Performance & type test : The stage manufacture type and performance test at
works/site on contracts, door operation door lock and
any other accessories must be done in accordance
with IS : 4666-1980 by the lift supplier.
42. Guarantee : The guarantee for a period of 12 months after final
commissioning for trouble free performance against
defective workmanship or manufacture for over wear
and tear in parts not attributable to negligence shall be
given along with tender.
43. Free post commissioning
maintenance service : The supplier must give 18 months free post
commissioning maintenance service.

44. Drawing and literature : The supplier must provide general arrangement layout
drawing of the elevator on award of contract.
Necessary number of final approved layout drawings
are to be provided for purchasers records. In addition
to the elevator drawing wiring diagram, maintenance
and lubricating check chart are also to be supplied on
completion of installation. Schematic wiring diagram is
to be displayed in the machine room as per applicable
lift code.

45. Foundation : The structural work required for the foundation of the
lift machine shall be done by other agency. The lift
manufacturer shall provide the details of the foundation
/lift well lights and power socket outlets as required.

3.00 CONDITIONS & SPECIFICATIONS

3.01 GENERAL

(i) These General Specifications indicate the requirements and precautions to be taken during the
execution of the lift installation work to ensure efficient, safe, economical and practical use of
materials and equipments including prevention of risks and fire hazards.

(ii) These General Specifications are subject to revision from time to time.

(iii) This Chapter covers the general commercial requirements applicable to works contracts for lift
Installation works:

(iv) Work shall be carried out as per IS: 1860: 1980 amended up to date.

3.02 STANDARD

The work shall be done in accordance with the following IS codes amended upto date

i) Electric Traction Lifts : IS:14665 Part-I to Part-V

All related works and materials shall be as per the relevant IS Codes as referred to in the
above mentioned Code.

In addition to the above Codes, relevant, laws, rules and regulations shall also apply.

3.03 SITE INFORMATION

The tenderer is advised to visit the site for any details and, technical particulars and other site
requirement by him before tendering.

3.04 RELATED DOCUMENTS

(i) Each work has its own particular requirements. These General Specifications shall be read in
conjunction with the standard conditions of contract contained in CPWD contract forms concerned
and their correction slips, the tender specifications, schedule of work, drawings and other
documents in the tender papers connected with the particular work.

(ii) In the event of any discrepancy between these General Specifications and the inter-connected
documents, the requirements and conditions as per the latter shall have overriding value and shall
be followed.

3.05 SUBMISSION OF TENDER AND OPENING OF TENDERS:

3.05.1 The tenderer shall submit the tender in two separate sealed covers duly completed in all respects viz.
one for Technical cum commercial bid & the other for price bid for the work. Both the Technical cum
commercial bid and the price bid shall be submitted simultaneously. The name of work and the words
Technical cum commercial bid only and Price bid only as the case may be, shall be clearly written on
top of the respective sealed covers.
3.05.2 The Technical cum Commercial Bid Shall be Complete with the Following:

a) Complete tender documents as purchased including the concerned schedule of work thereof
(without indication of price), duly signed for acceptance of all terms and conditions.
b) Earnest money deposit
c) Deviations, if any, from tender specifications.
d) Complete technical particulars as per specifications.
e) Additional technical particulars required in these tender papers.
f) Any other supplementary details required for the evaluation of tender like drawings, technical data
etc.

The price bid in a separate sealed cover shall be in the same format of the schedule of works given in
the I/T tender papers. The tenderer, if he so desires, may give further breakup of the same in the price
bid. Further modifications in rates any alternatives as indicated in the above and also unit rates and
details of excise duty as per 4.08.3 below shall also be furnished.

3.5.3 Scrutiny/evaluation of the Technical cum commercial bid shall be done by the engineer-in-charge in
Consultation with any agency as deemed necessary by him. The tenderer will furnish necessary
clarifications required by the Owner within the time given by the Owner for the same.

3.5.4 Tenders in which price is changed for any item without corresponding change in specification or
commercial conditions are liable to be rejected.

3.5.5 Any financial implication due to non-acceptance of conditions and/or proposed by the tenderers in their
technical cum commercial bid, pointed out by the Owner, shall be given immediately, in any case before
the date fixed for the price bid, in a separated sealed cover indicating plus or minus over the tender.
The name of work and works changes in Price Bid shall be written on top of such sealed cover.

3.5.6 It should be clearly understood by the tenderers that no further opportunity shall be given to them to
modify or withdraw any stipulation at any stage when the price bid is known to all the tenderers.

3.06 EXCLUSIONS

Any items exclude from the offer but required functionally, should be clearly defined & listed giving,
description of the items, quantity & estimated cost.

3.07 RATES

The rates quoted by the tenderer in the tender shall be firm inclusive of all taxes and levies and no
escalation in the rates shall be permitted due to any increase in case of labour and/or of material except
due to statutory variations on account of taxes and duties to the extent indicated in para. 3.08 below,

3.08 TAXES & DUTIES

3.08.01 Being an indivisible works contract, no sales tax shall be payable.


3.08.02 The tenderer shall clearly indicate the quantum of Excise duty included in the tender. The tenderer
should also give rate of Excise Duty and the amount of each component / components based on which
he has assessed the excise duty in his tender amount. The information shall be furnished in the tender in
the following format.

The Excise duty shall be payable to the contractor only on production on satisfactory proof of the
contractor having paid that quantum of Excise duty to the Government. He shall also furnish necessary
certificate that may be prescribed by the engineer-in-charge in this regard.

3.08.03 Any statutory variations (plus or minus) in the Excise duty from the quantum indicated in the tender shall
be applicable as such in actual payment towards the excise duty component.

3.09 PAYMENT TERMS

3.09.01 10% of the contract value as mobilization advance against bank guarantee recoverable fully upto 90%
billing.

3.09.02 65% of the contract value for the materials and equipment supplied will be paid on initial inspection and
delivery at site.

3.09.03 10% of the contract value on handing over of doors for lift faade stone financing.

3.09.04 15% of the contract value will be paid on completion of installation, testing, commissioning and trial
operation.

3.9.5 10% of the contract value will be paid on submission of statutory approval / clearances and submission
of drawings & manuals against Bank Guarantee valid for 1 year after commissioning and successful trial
of the lifts for one month.

This shall be done on the basis of certificate to be issued by the Engineer-in-charge in proof of the lifts
having successful completed the test and handing over the lifts for beneficial use. The guarantee period
of 12 months shall be reckoned from this date of handing over. This will also include one-year free
maintenance period.

NOTE-1: The contract value referred to in this Para 3.09 means the rates for each item of work in the
schedule of works and any additional substituted and deviated items of work under this
contract.

NOTE-2: The percentages indicated above will apply to individual equipments and materials, where the
individual items in the schedule of work are further broken up for the purpose of payment and
so indicated in the price bids of the tenders.

3.11. COMPLETION PERIOD

The time permitted for the entire work of supply, installation, testing and commissioning in all respects to
the satisfaction of the engineer-in-charge shall be reckoned from the 15 th day after award of work. The
entire lift installations will be completed in phased manner with in a total time frame of 15 months.
3.12. INFORMATION TO BE SUPPLIED BY THE OWNER:

For any lift installation covered by these specifications, the information, if any, shall be supplied to the
tenderer together with two sets of complete drawings showing the plan and sectional elevation of lift well
and the machine room.

3.13. WORKS TO BE DONE BY THE OWNER

The indenture shall be responsible for the following works only and these are excluded from the
responsibility of the successful contractor.

a) Provision of 3 phase 4 wire 50 Hz 415 V A.C. power supply terminate in the lift machine room with
suitable sized TP & N main switch unless otherwise specified the location of the mains switch shall
be on the well near the entrance to the machine room.

b) Provision of single phase 50 Hz 230 V A.C. power supply terminated with suitable sized SP & N
switch fuse for:

i) Lighting in the machine room and lift well.


ii) Lighting in the lift well as per approved drawing submitted by the contractor.

NOTE: The lift supplier shall indicate the requirement, number capacity of switches for the above items.

c) Free water and power supply during installation, testing and commissioning periods.

d) Properly ventilated machine room, lift well and waterproof lift pit.

e) Provision of suitable storage space.

f) Provision of adequate lighting in the machine room and at all landings.

g) Provision of hoisting beam or hook above the lift well and trapdoor.

h) Necessary flooring in the lift well portion in the machine room to cover the open areas after
installation of machine.

3.14. WORKS TO BE DONE BY THE CONTRACTOR:

In addition to the manufacture, supply, installation, testing and commissioning of the lift including all
auxiliary equipment, following works shall be deemed to be included within the scope of the work to be
done by the contractor.

i) All minor building work necessary for installation of equipment such as making of opening in walls/
floors, either of RCC or brick masonry etc., and restoring them to original condition and finish. The
scope of minor building work included all grouting of foundation concrete pads to be formed or
made base for supporting R.S. joists in the machine room, lift well or in the pit. Such works shall
exclude cutting of marble work and construction of partition wall wherever involved.
ii) Supply of necessary R.S. joists or angle iron supports brackets etc., for installation of the lift, either
in the machine room or at other places as may be necessary including their installation in position.
iii) All electrical works except bringing in main connection and earth connection to the machine room
main panel terminated on suitable switch fuse unit/board. All electrical works including
interconnection from this lift panel and loop earthing from the earth bar to be provided in the
machine room shall be done by the successful contractor.
iv) Responsibilities to ensure safety of lift materials against pilferage and damage till the installation is
handed over to the consignee.
v) All scaffolding as may be necessary in the lift well during erection work and subsequently removed.
vi) Temporary barricades with caution boards at each landing to prevent accident during execution of
work.
vii) Supply and installation of landing facial plates made of steel/car apron plates, sill support angles
with necessary clamps, foundation bolts, supports etc. as are necessary in connection with the
installation of the lift.
viii) Steel ladder to be provided for access to lift pit wherever required under regulations.
ix) Provision of suitable lights and socket outlets in the lift pit and lift well shall be made. Wiring for
these shall be connected to the power supply available in the machine room.

x) Lighting / battery operated emergency light and fan inside lift car by the contractor.

3.15 GUARANTEE

The contractor shall guarantee the entire lift installation as per specification. All equipments shall be
guaranteed for one year from the date of acceptance against unsatisfactory performance or break down
due to defective design manufacture and installation, the installation shall be covered by the conditions
that whole installation or any part thereof found defective within one year from the date of take over shall
be replaced or repaired by the contractor free of charge as decided by the OWNER.

The warranty shall cover the following:

a) Quality, strength and performance of the materials and equipment used.

b) Safe electrical and mechanical stresses on all parts of the equipment under all specified conditions
of operation.

c) Satisfactory, performance during guarantee period including free replacement to be done in


accordance with the maintenance instructions and schedules.

d) Performance figures and other values as specified in schedule of guaranteed technical particulars.

e) Prompt services during maintenance period for repairs and breakdowns.

f) Attending to consequential damages to consignment of lift items supplied and installed due to
defective workmanship, material designs etc., in any part from manufacturers work.

There should not be more than 8 hours delay in attending to break downs/defects reported in station
where the contractor has his service organization. At other places the contractor shall specify this
service period along with his tender and this shall be strictly adhered to.
3.16 MAINTENANCE DURING GUARANTEE PERIOD

After handing over the installation of the lifts, maintenance service of the equipment shall be provided
for a period of 18 months at no extra cost to the Engineer in_charge/Project Manager. This service shall
include regular examination of the installation by a trained engineer & shall include all necessary
adjustment, greasing, oiling, cleaning & replacement (if required) to keep he equipment in proper
operation as if in maintenance contract. In addition the fault calls will also have to be attended to
promptly as & when required. A 24-hours call back service should be available and the tenderer shall
furnish details of such facilities available with them in the city.

3.17 UNIT RATES:

The tenderer may indicate in the price bid unit rates for any items not covered under the schedule of
work, but considered by him as useful in the execution of the work.

3.18 SPARES AND TOOLS:

The tenderer may quote separately in the price bid for all the recommended spares and tools as
required.

3.19 AFTER SALES SERVICES:

Contractor shall ensure adequate and prompt after sales services in the form of maintenance personal
and spares as and when required. Particular attention shall be taken to ensure that all spares are easily
available during the normal course of life of the installation.

3.20 CARE OF BUILDING:

Care shall be taken in handling/ stacking of material to avoid damage to the building. On completion of
the lift installation contractor shall remove all debris and leave the machine room and other areas used
by him in a clean state.

3.21 DEFECTS LIABILITY PERIOD

The period of defect liability shall be a period of 12 (twelve) months to be reckoned from the date the
installation is commissioned & handed over to the Engineer in_charge/Project Manager in perfect
working condition.

3.22 MAINTENANCE CONTRACT

Along with the tender, an offer for comprehensive maintenance contract for 5 years, beyond the defects
liability period, should also be given mentioning clearly whether through own network or through sub-
agencies.
3.23 INSURANCE

The contractor shall obtain contractors All Risk (CAR) insurance policy for a value equivalent to
Contract Value as mentioned in the letter of award of work plus 10% (ten percent) only and other
insurance policies, in the name of the contractor and Engineer in_charge/Project Manager; beneficiary
being Engineer in_charge/Project Manager. The original policies shall be deposited with Engineer
in_charge/Project Manager. The policies shall cover clauses as under.

The contractor shall at all times indemnify and keep indemnified Engineer in_charge/Project Manager
and its officers, servants, agents and any other guest or person moving in the project premises, from
and against all third party claims whatsoever which may arise out of or in consequence of the
Construction, Execution, Installation and Maintenance of works, (including but not limited to property
loss and damage, personal accident, injury or death of / to servants, or agents of the contractor, any
labour contractor(s)/Suppliers and / or the Engineer in_charge/Project Manager) and the contractor shall
at his own cost and initiative at all times up to the successful conclusion of the defect liability period
maintain all insurable liabilities under this clause, including but not limited to third party insurance and
liabilities under the Motor Vehicles Act, Workmens Compensation Act, Fatal Accidents Act, Personal
Injuries Insurance Act, Employees State Insurance (ESI), Emergency Risk Insurance Act and / or other
Industrial Legislation from time to time in force in India with Insurance company (ies) shall be of not
lesser limit than that the limits hereunder specified with reference to the matters hereunder specified,
namely.

a. Workmens Compensation Insurance to the limit to which compensation may be payable under
the laws of the Republic of India.
b. Third Party Insurance bodily injury and property damage to the limit of not less than Rs. 1,00,000/-
(Rupees One Lakh only) in each accident at site (no. of accidents unlimited) and to a limit of not
less than Rs. 5,00,000/- (Rupees Five Lakh only) for all accidents at site.

3.24 STRUCTURAL REQUIREMENTS

Contractor shall clearly indicate the structural & electrical requirements for the installation of lifts. The
Engineer in_charge/Project Manager through other agency shall provide machine room, shaft & pit.
Other preparation work & all items of supply & installation in the hoistway shall be the responsibility of
the successful tenderer.

3.25 TOOLS FOR HANDLING AND ERECTION

All tools and tackles required for handling of equipments and materials at site of work as well as for their
assembly and erection and also necessary test instruments shall be the responsibility of the contractor.

3.26 PAINTING:

The contractor shall not employ women and men below the age of 18 years on the work of painting with
products containing lead, in any form. Whenever work of lead painting, the following principles must be
observed for each use:

a) White lead, sulfate of lead, or product containing these pigments, shall not be used in painting
operation, except in the form of paste of paint ready for use.

b) Measures shall be taken, whenever, required in order to prevent danger arising out from the
application of a paint in the for of spray.
c) Measures shall be taken, whenever practicable to prevent danger arising out from dust caused by
dry rubbing down and scrapping.

d) Adequate facilities shall be provided to enable working painter to wash during the occasion of work.

e) Suitable arrangements shall be made to prevent clothing put on during working hours being soiled
by painting materials.

f) Overalls shall be worn by working painters during the whole of working period.

Cases of lead poisoning and suspected lead poisoning shall be notified and shall be subsequently
verified by a medical man appointed by the competent authority of Engineer in_charge/Project Manager.

The Engineer in_charge/Project Manager may require when necessary medical examination of workers.

Instructions with regard to special hygienic precautions to be taken in the painting trade shall be
distributed to working painter.

3.27 CONTRACTORS LIABILITY FOR DAMAGES CAUSED AND IMPERFECTIONS NOTICED


WITHIN THE MAINTENANCE PERIOD: -

If the contractor or his working people or servants shall break deface, injure or destroy any part of the
building, in which they may be working, or any building, road, road curb, fence, enclosure, water pipe,
cables, drains, electric or telephone posts or wires, trees, grass or grassland or cultivated ground
contiguous to the premises on which the work or any part of it is being executed, or if any damage shall
happen to the work in progress from any cause whatever, or if any defect shrinkage or other faults
appear in the work within 12 months after a certificate final or otherwise of its completion shall have
been given by the engineer-in-charge arising out of defective or improper materials or workmanship, the
contractor shall upon: receipt of a notice in writing on that behalf make the same good at his own
expenses, or in default, the engineer-in-charge may cause the same to be made good by other
workmen and deduct the expenses from any sums that may be then or at any time thereafter may
become due to the contractor, or from his security deposit.

3.28 POWER SUPPLY

3.28.1 Electric power supply for testing and commissioning shall be provided free of cost by terminating the
cable(s) in the main incoming switchgear in the electrical panel board to be provided by the OWNER in
the machine room. The contractor shall carry out the cabling work of the entire equipments.

3.28.2 Complete loop earthing of all electrical equipment shall be carried out by contractor, in conformity with
IE Rules 1956 amended upto date.

3.29 WATCH AND WARD OF MATERIALS AND EQUIPMENT

The contractor shall, on supply of material and equipment for bonafide use of work at site, shall continue
to be responsible for their safe custody till they are installed in position, tested, commissioned and
handed over to the engineer-in-charge for all the items of materials and equipment so supplied at site
before taking payment for the same.

3.30 CO-ORDINATION WITH OTHER AGENCIES

The contractor shall co-ordinate with all other agencies involved in the building work so that the building
work is not hampered due to delay in his work.
3.31 STRUCTURAL ALTERATIONS TO BUILDINGS

(i) No structural member in the building shall be damaged/altered, without prior approval from the
competent authority through the Engineer-in-charge.

(ii) Structural provisions like openings, cutouts, if any, provided by the OWNER for the work, shall be
used. Where these require modifications, or where fresh provisions are required to be made, such
contingent works shall be carried out by the contractor at his cost.

(iii) All chases required in connection with the electrical works shall be provided and filled by the
contractor at his own cost to the original architectural finish of the buildings.

3.32 WORK AND TIME SCHEDULE:

The contractor shall prepare a work and time schedule in a format as approved by Engineer-in. Charge.
The schedule shall be submitted to the Engineer-in-charge within ten days of award of the contract. It
shall indicate the expected date of commencement and completion of each item of work. In addition to
this the contractor shall furnish a fortnightly progress report indicating percentage of completion of each
item of work.

3.33 STORAGE:

All the materials brought to the site shall be stored and stacked in proper manner. The material
requiring protection from sun and rain shall be kept inside the temporary structure to be erected at site
by the contractor. The contractor shall also follow the manufacturers instructions for storing and stacking
of material. The storage facilities are to be created by the contractor at his own cost.

3.34 SAFETY PRECAUTIONS

a) A competent and authorized supervisor shall be on the site whenever the contractors men are at
work. The supervisor should ensure that all the plant and machinery used on the site are rendered
safe for working and meets with the Indian or International safety standards applicable for the use
and operation of such machinery. The supervisor should also ensure that the workmen are supplied
with and made to use safety appliances such as safety belts, helmets etc. The supervisor shall not
leave the work site without permission from the Engineer-in-Charge.

b) Smoking shall not be encouraged at site but altogether strictly prohibited in areas where
combustible and inflammable goods/ materials are stored.

c) Any hot jobs such as welding, soldering, gas cutting shall not be carried out without the permission
of the Engineer-in-charge. Such jobs shall not be carried out where inflammable materials are
stored or lying about. All electric connections shall be through adequately sized mechanically
protected cables without any joints and with proper and adequate terminals. All power supplies shall
be through properly rated fuses with isolating devises. No such hot jobs shall be carried out on
holidays and without the presence of the contractors supervisor.

d) It is entirely the responsibility of the contractor to practice the principles of SAFETY FIRST during
the entire tenure of work with adequate insurance covering injury or death to workmen, loss by theft
or damage to materials and property in position or not and third party.

e) The contractor should clear the site of all debris every day to avoid accidents. In case this is not
done, the OWNER may engage necessary labour to maintain the cleanliness of the premises and
removal of debris, and debit all or part of the expenditure so incurred from the contractor.
3.35 LIQUIDATED DAMAGES ON LATE COMPLETION

In case of delay in completion of work, Engineer in_charge/Project Manager shall recover agreed
liquidated damages at the rate of 0.5% (point half percent) of Contract Value for each week of delay or
part thereof subject to maximum of 5% (five percent) of Contract Value. It is expressly agreed that
deduction aforesaid shall being the agreed liquidated damages and not as penalty.

3.36 TERMINATION

3.36.1 Engineer in_charge/Project Manager may for any reason whatsoever in addition to any breach of any
provisions of
Contract Agreement at any time by notice in writing to contractor, terminate the contract.

3.36 .2 In the event of termination pursuant to Clause above :

a) Contractor shall carry out instructions of Engineer in_charge/Project Manager in connection with
such termination including the cancellation of orders and termination of contracts, which the
contractor may have placed with others.

b) Engineer in_charge/Project Manager shall pay contractor for all materials used and work executed
pursuant to contract but unpaid at the date of such termination together with any reasonable costs
necessarily incurred by contractor in connection with work as a result of such termination provided
that Engineer in_charge/Project Manager shall not be liable for any indirect loss, any business loss
or damage or loss of profit suffered by contractor as a result of such termination.

c) Contractor shall, upon receiving notice from Engineer in_charge/Project Manager in accordance
notify Engineer in_charge/Project Manager within a reasonable time, of the sums for materials used
and work executed as mentioned in paragraph of this clause. These sums and all terms and
conditions of termination pursuant to this clause shall be agreed in writing between Engineer
in_charge/Project Manager and contractor.

d) In the event of any breach of the provisions of contract or default in the performance of the
obligations by contractor not being remedied by him within 30 (thirty) days of receipt of notice in that
behalf from Engineer in_charge/Project Manager, Engineer in_charge/Project Manager shall be
entitled to terminate contract forthwith without prejudice to his other rights and remedies hereunder
by a communication in writing to contractor and on such termination contractor shall be liable to pay
to Engineer in_charge/Project Manager all loss and damages and sums that may be suffered and
incurred in rectifying default and/or completing unfinished work not withstanding anything contrary
contained in this contract.

Upon termination of Contract Agreement pursuant to this clause, obligation of the parties hereto shall
cease except as to the liabilities of either party to the other for obligations accrued prior to the date of
such termination.

3.37 SUSPENSION OF WORKS

The contractor shall, on an order issued by the Engineer in_charge/Project Manager and duly
communicated to him, suspend the progress of the work or any part thereof for such time or times and
in such manner as the Engineer in_charge/Project Manager may consider necessary, and shall during
the period of such suspension, protect and render secure the work to the extent necessary in the option
of the Engineer in_charge/Project Manager. If such suspension is: -

a) Provided for in the contract, or


b) Necessary for the proper execution of the work or by reason of weather conditions or by some
default on the par of the contractor, or
c) Necessary for the safety of the work or any part thereof. The contractor shall not be entitled to
any extra payments, compensation or extension of time. But if the suspension order by
Engineer in_charge/Project Manager is for reasons other than those mentioned above such as
due to any modification in the design, site conditions or otherwise deemed necessary by
Engineer in_charge/Project Manager due to any other reason what soever including non
availability of drawings or materials to be supplied by Engineer in_charge/Project Manager and
if any such period of suspension exceeds 14 days, the contractor shall be entitled to such
extension of time for completion of the work as Engineer in_charge/Project Manager may

consider proper having regard to the period or periods of such suspension and no other claim in respect
of idle wages or any other account whatsoever of compensation shall be admitted.

3.38 EXTRA ITEMS/SUBSTITUTED ITEMS

The rates for all extra items/substituted items etc. of work shall be valued in the manner and in the
following order of preference: -

a) At rates of prices deducted from the accepted contract rates as far as it is practicable to do so.

b) If direct assessment or proportionment as stated above in sub clause a) is not possible such works
shall be valued at the rates set out in C.P.W.D. Schedule of Rates (1994 edition), Delhi plus 58
percentage.

c) In case the extra item is not covered by any of the above two cases , the same shall be valued on
the basis of actual cost of labour and the market value of materials actually incorporated in the work
subject to verification and correction plus materials 15% (Fifteen percent) to cover contractors profit
supervision charges and other overhead expenses. In case of materials issued by Engineer
in_charge/Project Manager the cost of materials shall be taken at issue rate plus 10% handling
charges and overheads etc. No separate profit or any other payment over it shall be allowed.

3.39 COMPLETION CERTIFICATE

On completion of the Lift installation the contractor countersigned by a supervisor shall furnish a
completion certificate, under whose direct supervision the installation was carried out. This certificate
shall be in the prescribed from as required by the local authority. The contractor shall be responsible for
getting the Lift installations inspected and approved by the Local Authorities concerned/Chief Electrical
Inspector of Haryana State.

3.40 P.F. REGISTRATION

It is mandatory for the tenderer to have proper registration with P.F. commissioner Office. Contractor
shall make due arrangement for deduction of employees contribution to provident fund as required
under the law and shall regularity make the payments to the Govt. Authorities of this and workmens
contribution. He shall satisfy Engineer in_charge/Project Manager representatives with documentary
evidences in regard to regular and update payments of provident fund contributions.

Likewise, it will be the sole responsibility and liability of contractor to duly observe all statutory provisions
either for engagement of labour or otherwise submission of periodical returns and information as may be
called for by any statutory authority from time to time and for all claims and payments, either statutory or
otherwise arising out of or connected with contract. If Engineer in_charge/Project Manager is subjected
to any liability or penalty due to the default on the part of the contractor. The contractor by taking such
action, which is required as per above stated statutory rules, shall indemnify Engineer in_charge/Project
Manager.
3.41 SECURITY DEPOSIT

Security deposit equivalent to 5% of work done shall be deducted from the contractors each running
bills, which shall be released on submission of a Bank Guarantee of equivalent amount, within one
month from the Date of Actual completion of works as recorded by Engineer-in-charge. The 5%
deduction from the running bills shall be made after EMD with the tender has been accounted for.
Engineer in_charge/Project Manager shall give no interest on security deposit/earnest money.

3.42 ARBITRATION

Except where otherwise provided for in the contract all questions and disputes relating to the meaning of
the specifications, designs, drawings and instructions herein before mentioned and as to the quality of
workmanship or materials used on the work or as to any other question, claim, right matter or thing
whatsoever in any way arising out or relating to the contract, designs, drawings; specifications,
estimates, instructions, orders or these conditions or otherwise concerning the works, or execution or
failure to execute the same whether arising during the progress of the work or after the completion or
abandonment thereof shall be referred to the Sole Arbitration of the Arbitrator appointed by Engineer
in_charge/Project Manager whose order/Award shall be final, conclusive and binding on all parties
related to this contract.
The jurisdiction for arbitration will be in Delhi/New Delhi.

3.43 FORCE MAJEURE

The terms and conditions agreed upon with respect to this contract shall be subject to Force Majeure.
Force Majeure shall be deemed to be only cause, beyond the reasonable control of contractor or
Project Manager as the case may be, which prevents or impedes the due performance of contract and
which, by due diligence, the affected party is unable to avoid or overcome through his individual or
concerned effort. For the purpose of this clause, Force Majeure shall include the following: -

a) Acts of God.
b) Any war or hostilities.
c) Any riots or civil commotion.
d) Any earthquake, flood, tempest, lightening or other natural physical disaster.
e) Any accident, fire or explosion not caused by the negligence of sub-contractor.
f) Any strike or legal lockout or other industrial disturbance continuing for a period of more than 10
(ten) days and affecting the performance of contractual obligation.

Any law and order of any Government or other Local Authority, which delays or impedes sub-contractor
in the execution of work.
