The submission of Mr. Katyal is that the impugned judgment borders
on perversity.
Prima-facie a reading of the impugned judgment gives us the same
impression. We have come across several decisions rendered by the same
learned Judge in cases under the Prevention of Children from Sexual
Offences (POCSO) Act, and they all, prima-facie, appear to be laconic.
There is a fundamental and serious error in the approach of the learned

Judge in deciding the cases which have come to our notice. The particulars
of the other cases in which the learned Judge has rendered decisions are the
following:

In these circumstances, we are of the view that the situation demands

that we examine all the decisions rendered by the learned Additional &
Sessions Judge Mr. Sunil Chaudhary while discharging functions as the
ASJ-01, South-East District, New Delhi, in cases under POCSO Act.
We direct the learned District & Sessions Judge, South-East District,
New Delhi to place before this Court on the next date all the decisions
rendered by the aforesaid ASJ-01, South-East District, New Delhi, in
POCSO Act cases before this Court for its examination under Section 397/
401 Cr.P.C.
Issue notice to the respondent returnable on 07.12.2017.
A copy of this order be communicated to the learned District &
Sessions Judge, South-East District, New Delhi, forthwith for compliance.
