1.01. MULTIPLE FUNCTIONS
- LTFRB regulate the operation of public
utilities, and grant CPCs, fix fares, approve petitions for
fare increases, and resolve oppositions to such
petitions.
- NTC granting franchises, allocating areas of
operations, rate-fixing
- ENERGY REGULATORY BOARD grants,
modify, revoke the authority to operate facilities in
generation of electricity AND fix tariffs of franchise
utilities.
- TOLL REGULATORY BOARD enter into
contracts for construction, operation of toll facilities,
issue and promulgate toll rates, adjudicatory jurisdiction
over matters involving toll rates.
1.02. PRIMARY JURISDICTION
- Belongs to the court when there is
misrepresentation, fraud and deceit on the part of the
regulatory boards.
- Findings and conclusions of fact of the PSC,
after weighing evidence are binding with the Supreme
Court and will remain undisturbed, UNLESS it appears
that it was not reasonably supported by evidence.
- Abuse of power of the PSC may be reviewed,
reversed and modified.
