CHAPTER - I

1. INTRODUCTION

Children love to grow and play under the wings of their parents and loved
ones. They need our loving touch, care and guidance to nurture, just like a plant that
needs soil, water and sunlight to grow but there are some unfortunate ones who are
left destitute or orphaned. The cruel hands of nature take their loved ones away from
them. And sometimes, due to lack of proper supervision and guidance, these
unfortunate juveniles sometimes become delinquents and to avoid such circumstances
we need institutions like Apna Ghar.

APNA GHAR is though all-india based with eight founder members from
various sectors and each one is a silent specialist worker in his/her own field. Apna
Ghar was started with a motto to ensure development and rehabilitation of neglected
or delinquent juvenile’s .It has one of its branches in Merces in Goa. Their institution
is an age old establishment and has provisions of hostels, libraries and old age homes
for orphans and other needy persons without any discrimination of caste, creed,
religion or sex.

It also provides shelter,clothing,medical facilities , nutritious food to the


inmates of the centre promote welfare programmes for women, children, and the
remand home presently has courses in craft, tailoring and clay modeling.
Occasionally, a three-month course in cookery and baking is also taught.

2. IMPORTANCE OF THE STUDY OF APANA GHAR IN GOA.

Apana Ghar is a Government Institution which is functioning in the state of


Goa which is a boon to the society. Apna Ghar is a the government run children’s
home, to provide home/settled place/abode, clothing, medical facilities, nutritious
food to the inmates of the centre promote welfare programmes for children, and
orphans, sexually abused child, child found begging, a street child or a working child,
neglected child, child caught committing crimes, abundant, mentally or physically
challenged child, child suffering from terminal or incurable disease having no one to
support or look after, run away, child abused, tortured or exploited for the purpose of
sexual abuse or illegal acts, child who is a victim of any armed conflict civil
commotion or natural calamity, women rescued from trafficking without any
discrimination of caste, creed, religion or sex to the children abandoned by the society
and to bring these children back to the right path.

3. OBJECTIVES OF THE STUDY

The main objective of the study is to evaluate the efficacy of the various
provisions of the Juvenile Justice Board and Child Welfare Committee in the Apana
Ghar situated at Merces Goa under the Juvenile Justice (Care and Protection of
Children) Act, 2000.

The other objectives of the study are as follows:

1. To understand the various provisions of the Juvenile Justice Board and Child
Welfare Committee under Juvenile Justice (Care and Protection of Children)
Act, 2000.

2. To analyses the various International Convention and National


enactments/Provisions of the enactment dealing with the welfare of children
to analyses the role-played by the Indian Judiciary.

3. To analyses how efficiently the provisions of the Juvenile Justice Board and
Child Welfare Committee under Juvenile Justice Board (Care and Protection
of Children) Act, 2000 is enforced in Apana Ghar situated at Merces Goa.

4. To provide suggestions for proper/effectively enforce the Provisions of the


Juvenile Justice Board and Child Welfare Committee under Juvenile Justice
Board (Care and Protection of Children) Act, 2000.
5. To find out the degree of care taken by the Government of Goa in Apana Ghar
with special reference child welfare committee and juvenile justice board.

6. To deal with the adjudicatory function of the juvenile justice board and to find
out the present functioning condition of the child welfare committee vis-a-visa
juvenile justice board.

7. To analyses the problem of juvenile in Apana Ghar with recent case laws.

8. To make it effective enforcement and implementation of juvenile justice in the


sate of Goa.

9. To make suggestion in the effective enforcement and implementation of


juvenile justice in the state of Goa.

4. SCOPE OF THE STUDY

The scope of the present research is limited wholly on the Juvenile Justice
(Care and Protection of Children) Act, 2000, and Child Welfare Committee that deals
with rights of child/provision in other national laws and international conventions and
empirical study. The scope of the topic is to provide basic guidelines to the children of
the Apana Ghar and there functioning system.

5. LIMITATION OF THE STUDY

The present research shall be limited to the Apana Ghar Merces, Goa with
brief details study of Apana Ghar in Goa with special reference to child Welfare
Committee and Juvenile justice Board with the help of functioning of NGO in Goa.
6. HYPOTHESIS

1. The provisions of the Juvenile Justice (Care and Protection of


Children) Act, 2000 and Child Welfare Committee are not
effectively and efficiently implemented in Apana Ghar situated at
the Merces Goa.

2. Irregulars sitting of Juvenile Justice Board under the act result in


redressing the care of diligent.

3. Lack of proper humanitarian treatment and protection to juvenile


and children in Apana Ghar.

4. Legal provisions under juvenile justice board and child welfare


committee are not strictly complied with by the authorities.

5. Interference of NGO is justices?

7. METHODOLOGY

The present research is based on doctrinal and empirical method. The


necessary data for this study shall be collected from Primary and Secondary Source.

 Primary Source: includes Survey, Observation, Interview and

Statistics.

 Secondary Source: includes reference of Books, Government

Notifications, Journal, Periodicals, Newspaper articles and Internet

website.
