Based on the totality of the circumstances and the information obtained through the Delta Chi

investigation, the investigator concluded there was sufficient information for the Office of
Student Conduct to pursue the following formal charges:

t. Hazing
o The initial report referenced PT where Associate Members (AM) were forced to
complete physical activities on Mondays and Wednesdays including push-ups, sit-
ups, wall sits, bows and toes, and planks when they did not answer posed
questions correctly. PT was corroborated by 14 witnesses. One witness
additionally added that while doing wall sits, the AMs would have to extend their
hands out and motion like they were wiggling their fingers and imitated jiggling
the balls of the brother standing in front of them. He clarified that they never
touched them but that the motion was still done.
o The initial report referenced metal music blaring in the background during PT.
AMs were expected to answer questions and recite elements of the Cornerstone
over the loud music during at least one event.
References were made to this occurring possibly twice during the Fall
semester.
Yelling occurred during this activity in combination with the PT by those
leading the AM event. This was corroborated by eight witnesses. One
witness stated they didnt yell unless the AMs were screwing up and that
they yelled less than their year. Two witnesses described it as screaming
and yelling in their face.
Additionally, there was very minimal light as only one red light bulb
provided any light in the garage during the PT as indicated by two
witnesses.
o The initial report indicated that AMs were made to stand outside the back of the
house prior to AM Events and only brought in one at a time. This was
corroborated by one witness, adding that this was meant as intimidation for the
AMs.
o The initial report referenced how hot the garage would get and that water was not
provided during PT. Two witnesses corroborated stating, water was only provided
after the AM Event ended.
o The initial report stated that AMs were not permitted to stop PT once it started.
One witness stated that he wasnt sure what would happen if someone tried to
stop, adding no one ever tried. Two witnesses also indicated that AMs couldnt
stop doing PT.
o Two witnesses reported that you didnt have to do PT if you didnt want to; they
were not forced. One witness added, he didnt do anything against his will.
o Through the investigation, nine witnesses admitted that AMs were given items
such as an empty trashcan, empty Gatorade cooler, and a traffic cone to hold
while doing wall sits. AMs were expected to hold the items out directly in front of
them and could pass to another AM if they needed help.
o Through the investigation, 14 witnesses stated that AMs were told to wear jeans
and a white t-shirt as part of their AM Event attire. On their first event day, when
they walked in one at a time, the word Pledge and their corresponding number
was written on their white t-shirt in permanent marker. They were not permitted
to wear the shirt outside of AM Events and had to cover them otherwise. The
investigator was provided a white pledge shirt to see in person. It was requested
that a picture not be taken in order to protect anonymity.
o AMs wore dress attire on Wednesdays including a button down shirt and blazer as
indicated by three witnesses.
o The initial report stated that one witness was made to consume alcohol while
doing wall sits including shot gunning a beer, chugging a beer, and then taking
four jello shots. The initial report also stated that everyone was given a jello shot
as they were left over from a previous event. Four witnesses corroborated jello
shots were given out at an AM Event. One witness admitted to giving out jello
shots to AMs. One witness admitted to giving another witness a beer to chug and
shotgun at an AM Event. The witness that was provided the alcohol said he could
have stopped drinking but they are supposed to follow the AMC (Assistants)
instructions.
o The initial report stated that the AMs were iced at an AM Event. Through the
investigation it was determined that as part of a scavenger hunt, a cooler of
Smirnoff Ice was brought out and the AMs were told they had been iced and
were told to drink the bottles. This was corroborated by three witnesses. One
witness added, this might have happened. Four witnesses were present for this
event in addition to other brothers whose names were not disclosed.
o The initial report referenced an event in which AMs held a match at a 45-degree
angle and had to recite the Greek alphabet before the flame reached their fingers.
Additionally, the report stated that one witness was burned as a result and that
three witnesses had also gone through Match Night their year and had each
gotten burned. This activity was corroborated by 14 witnesses. Two witnesses
both indicated this activity was mandatory. One witness indicated that this was a
fun day though also admitted that his fingernail melted to his skin when flames
engulfed his finger. The witness also shared that he had to pop his blood blister
to release the increasing pressure.
o The initial report spoke of a Goldfish Rule in which AMs are not permitted to talk
to anyone about the secrets of the fraternity except a make believe goldfish. This
rule was corroborated by 13 witnesses.
o The initial report referenced interviewing and obtaining signatures as part of the
AM process and how stressful that experience was. Through the investigation it
was learned that the AMs were told to interview each of the brothers using a
provided list of questions as a guide. The interviews were corroborated by 14
witnesses. Four witnesses each admitted that there were questions of a sexual
nature included. Six witnesses indicated you had to ask the provided questions,
including the sexual questions. Three witnesses stated you didnt have to ask all
the questions. One witness stated the questions were recommended and another
witness stated they were a guideline.
o Four witnesses made mention of another witness being the Zucchini Brother
and a joke existing about having to carry a zucchini at all times. All individuals
were uncertain how often that witness carried the zucchini.
o Accounts varied as to who was present for what activity and vary as to the level of
engagement by each individual. Ten witnesses each indicated that the associate
member coordinators were the individuals who were present and/or leading AM
Event activities.
o Twelve witnesses stated that leadership were not aware of or involved in the
hazing activities. Three witnesses stated that the executive board was possibly
aware of the hazing activities.
o Four witnesses indicated that the following events occurred in previous AM
classes
Obtaining signatures with sexual related questions (Four witnesses
personally experienced as part of their AM process.)
Match Night (Four witnesses personally experienced as part of their AM
process.)
PT (Four witnesses personally experienced as part of their AM process.)
Goldfish rule (Four witnesses personally experienced as part of their AM
process.)
Pledge shirts (Four witnesses personally experienced as part of their AM
process.)
Providing alcohol (Two witnesses personally experienced as part of their
AM process.)
Yelling (One witness personally experienced as part of their AM process.)

a.1. Acts of Harm: Physical Injury


o The initial report indicated that one witness had sustained a burn to his finger
while taking part in an activity in which matches were used to test the AMs
knowledge of the Greek alphabet. This injury was corroborated by 11 witnesses.
When asked about whether anyone was injured by the activity, one witness stated
that he kind of thought everyone got burned or singed adding it wouldnt blow
my mind if youre holding a match. One witness indicated that this was a fun
day though also admitted that his fingernail melted to his skin when flames
engulfed his finger. The witness also shared that he had to pop his blood blister
to release the increasing pressure.

a.2. Acts of Harm: Fear/Risk


o As outlined in the a.1. Acts of Harm: Physical Injury charge above, AMs were
expected to hold a lit match and complete tasks (reciting information) quickly
enough to prevent their fingers from getting burned. As articulated by one
witness, there was a reasonable expectation that individuals would be burned as a
result of participation in the activity. Numerous witnesses indicate that this
activity was required but that you could throw the match into the bowl of water.
o One witness admitted that the combination of blasted metal music, yelling,
decreased visibility in the room, use of a single red lightbulb was a tactic used
in which to intimidate the AMs. Additionally, the witness stated that having the
AMs line up outside and come in one at a time and writing on their shirts was
purposeful in order to scare them and make them nervous. Two witnesses both
indicated that nothing bad will happen to them.
o In the initial report, it was shared that the AMs were told it (hazing) would get
worse and that more was coming. One witness clarified they were never scared
as part of the process.

o.3. Alcohol: Providing to Minors


o As stated in the preceding t. Hazing charge, the initial report stated that one
witness was made to consume alcohol while doing wall sits including shot
gunning a beer, chugging a beer, and then taking four jello shots. The initial
report also stated that everyone was given a jello shot as they were left over from
a previous event. Four witnesses corroborated jello shots were given out at an AM
Event. One witness admitted to giving out jello shots to AMs. One witness
admitted to giving another witness a beer to chug and shotgun at an AM Event.
One witness also admitted that alcohol was provided to two witnesses but that one
of those witnesses refused.
o As stated in the preceding t. Hazing charge, the initial report stated that the AMs
were iced at an AM Event. Through the investigation it was determined that as

corroborated by three witnesses. One witness added this might have happened.
Four witnesses were present for this event in addition to other brothers whose
names were not disclosed. One witness indicated he told the brothers to not do the
activity but they did it anyways.
o Eight witnesses indicated that alcohol is purchased via a slush fund and handed
out to anyone who attends the chapter parties. Ten dollars is charged to any male
attendee including brothers and AMs. Witnesses indicated the money is used to
purchase 8-10 cases of beer and 2 bottles of vodka. The brother and/or AM
assigned as the bartender for the evening is responsible for giving out the PJ and
the beer. The witnesses indicated that people are not carded and those under 21
are reasonably consuming alcohol, including the AMs. One witness clarified that
people are checking IDs as far as he knows. One witness stated theyre supposed
to card but probably do not. One witness also confirmed that people are not
carded at the parties.
