INTRODUCTION

NAME OF MOVING PARTY, herein submits their memorandum of points and authorities

in support of their order to show cause to enforce the settlement agreement pursuant to Code of Civil

7 Procedure 664.6. The settlement agreement should be enforced against NAME OF OTHER

8 SPOUSE because they have failed to cooperate in signing a written settlement agreement.

On or about DATE OF HEARING a hearing was held before the Honorable NAME OF
10
JUDGE OR COMMISSIONER. At said hearing both Petitioner and Respondent entered into a
11
settlement agreement on the record in open Court that settled all issues of STATE ISSUES
12

13 COVERED IN THE SETTLEMENT AGREEMENT in this case. See the Transcript of said

14 hearing lodged with the Court, and a copy of which is attached as Exhibit __ to the Declaration of
15
STATE NAME OF PARTY SIGNING DECLARATION.

The terms of the settlement agreement were that LIST ALL TERMS OF THE
17
SETTLEMENT AGREEMENT ENTERED INTO IN OPEN COURT HERE.

19 Counsel for NAME OF COUNSEL FOR OTHER SPOUSE, stated on the record that he

20 would work with counsel for NAME OF MOVING PARTY in preparing a settlement agreement.

See page __, lines __ through __. Yet so far ______ has not cooperated in preparing a settlement

agreement.

Respondent requests that the Court enforce the settlement agreement pursuant to Code of
24

25 Civil Procedure 664.6 and enter a judgment of dissolution of marriage based on the terms as

26 specified in the settlement agreement.
