1. Who are Persons with Disability?

Sec 4 (a) of RA 7277 Defines

(a). Disabled Persons are those suffering from restriction of different abilities, as
a result of a mental, physical or sensory impairment, to perform an activity in the
manner or within the range considered normal for a human being;
(b). Impairment is any loss, diminution or aberration of psychological, physiological,
or anatomical structure of function;
(c). Disability shall mean
(1) a physical or mental impairment that substantially limits one or more
psychological, physiological or anatomical function of an individual or
activities of such individual;
(2) a record of such an impairment; or
(3) being regarded as having such an impairment;
National Council on Disability Affairs - Disability refers to any restriction or lack of
ability (resulting from impairment) to perform an activity in the manner or within
the range considered normal for a human being. Impairment associated with
disability may be physical, mental, or sensory motor impairment such as
Partial or total blindness
Low vision
Partial or total deafness
Oral defect (deaf-mutes)
Having only 1 hand/no hands
One leg/no legs
mild or severe cerebral palsy
retarded
mentally ill
metal retardation
multiple impairment

2. What is the proof of entitlement for the privileges?

(i) An identification card issued by the city or municipal mayor or the barangay
captain of the place where the PWD resides;
(ii) The passport of the PWD concerned; or
(iii) Transportation discount fare Identification Card (ID) issued by the National
Council for the Welfare of Disabled Persons (NCWDP).

3. What is the rule on No Double Discount?

Section 12 of Implementing Rules of R.A. No. 10754 provides that the


purchase of goods and services which are on promotional discount, persons with
disability can avail of the establishments offered discount or the 20% discount
provided herein, whichever is higher and more favorable. In cases where the
person with disability is also a senior citizen entitled to a 20% discount under
his/her valid senior citizen identification card (ID), the person with disability shall
use either his/her PWD ID Card or Senior Citizen ID card to avail of the 20%
discount.

4. Who are those Qualified Individual with a Disability? are they entitle the
same term and condition with other employee?

Persons with disability, if qualified, are entitled to the same terms and
conditions of employment and the same compensation, privileges, benefits, fringe
benefits, incentives or allowances as qualified able-bodied persons.
Qualified Individual with a Disability shall mean an individual with disability
who, with or without reasonable accommodations, can perform the essential
functions of the employment position that such individuals holds or desires.
However, consideration shall be given to the employers judgment as to what
functions of a job are essential, and if an employer has prepared a written
description before advertising or interviewing applicant for the job, this description
shall be considered evidence of the essential functions of the job. (Section 1, Rule 1,
Rules Implementing the Magna Carta of Person with Disability)

5. What are the acts of Discrimination against Disabled Person?


a. Limiting, segregating or classifying a disabled job applicant
b. Using qualification standards, employment tests other selection criteria that
rule out person with disability
c. Providing lower compensation or other forms of remuneration, benefits to a
qualified employee with disability
d. Favoring an able-bodied employees over a qualified employee
e. Re-assigning him to a job he cannot perform
f. Termination by reason of disability
g. Failing to select in the most effective manner employment tests
h. Excluding them from labor union membership or similar organization

6. Difference between Acts Ridicule and Vilification of person with disability?

Act of making fun or contemptuous imitating or making mockery of persons


with disability whether in Writing, Words, or Action due to their impairment while
Vilification is the act of a.) The utterance of slanderous and abusive statements
against a person with disability such as but not limited to: (1) calling a person by
his disability in public which results to humiliation; (2) using the disability of a
person as an example in a manner that is embarrassing and humiliating to the
dignity of persons with disability. b.) An activity in public which incites hatred
towards, serious contempt for, or severe ridicule of persons with disability. c.)Any
individual, group or community is hereby prohibited from vilifying any person with
disability which could result into loss of self-esteem of the latter.

7) What are the rights and Privileges of PWD?


a. At least twenty percent (20%) discount and exemption from the value-added tax
(VAT), if applicable, on the following sale of goods and services for the exclusive use
and enjoyment or availment of the PWD:
1. On the fees and charges relative to the utilization of all services in hotels
and similar lodging establishments; restaurants and recreation centers
2. On admission fees charged by theaters, cinema houses, concert halls,
circuses, carnivals and other similar places of culture, leisure and
amusement;
3. On the purchase of medicines in all drugstores; This shall apply to the
purchase of prescribed generic and branded drugs / medicines as well
as foods for special medical purposes in all drugstores for the exclusive
use or availment of persons with disability.
4. On medical and dental services including diagnostic and laboratory fees,
and professional fees of attending doctors in all government facilities and
in all private hospitals and medical facilities, subject to the guidelines to be
issued by the Department of Health (DOH), in coordination with the
Philippine Health Insurance Corporation (PhilHealth);
5. On fare for domestic air and sea travel; For promotional fares, the Section
on No Double Discounts should apply.
6. On actual fare for land transportation travel;
7. On funeral and burial services for the death of the PWD. Such expenses
shall cover the purchase of casket or urn, embalming, hospital morgue,
transport of the body to intended burial site in the place of origin, but shall
exclude obituary publication and the cost of the memorial lot.
b. Educational Assistance
c. Provision of express lanes for PWD in all commercial and government
establishments.
d. Right to Barrier- Free Environment.
e. Free Postal Charges
f. Right to Opportunity for suitable employment
g. Right to Equal Terms and Conditions of Employment
h. Right to Sheltered Employment
i. Right to be Hired as Apprentices or Learners
j. Right to Quality Education
k. Right to Educational Assistance
l. Right to Health Services

8. Who are those marginalized disabled person?


Section 4(k) of R.A. No 7277 define Marginalized Disabled Persons which
refer to disabled persons who lack access to rehabilitative services and
opportunities to be able to participate fully in socioeconomic activities and who
have no means of livelihood or whose incomes fall below poverty threshold;

9. Are PWDs entitled for 20% discount on fare on Grab, Uber or even in LRT?
Yes, Sec 1 of R.A. No. 10754 as expanding benefits and privileges provided in
Sec 32 of R.A. No. 7277
At least twenty percent (20%) discount and exemption from the value-added
tax (VAT), if applicable, on the following sale of goods and services for the exclusive
use and enjoyment or availment of the PWD on actual fare for land
transportation travel; which shall apply to actual fare for land transportation
travel such as, but not limited to, public utility buses or jeepneys, taxis, Asian Utility
Vehicles (AUVs), shuttle services, public railways including Light Rail Transit, Metro
Rail Transit and Philippine National Railways and Transportation Network Vehicle
Services (TNVS) such as Grab, Uber and the like.
Provided that person entitled with discount present ID issued by barangay or
password or Transportation discount fare Identification Card (ID) issued by the
National Council for the Welfare of Disabled Persons (NCWDP).

10. Are they entitle on Discount for International Flight?

No, Sec 1 of R.A. No. 10754 as expanding benefits and privileges provided in
Sec 32 of R.A. No. 7277 that only fare for domestic air and sea travel; For
promotional fares, the Section on No Double Discounts should apply.
