Executive Summary: The applicant, Liz Bolar of Holman Ranch Estate Tasting Room, is
requesting a use permit to establish a new wine tasting room. Staff is recommending denial
because the proposed location is south of Ocean Avenue, which is discouraged by the Citys
Wine Tasting Policy. The proposed tasting area also exceeds the Policy recommendation of
30% of the floor space.

Recommendation:
Deny the Use Permit (UP 17-442) application subject to the attached findings.

Background and Project Description:


The applicant, Holman Ranch Estate, has applied to establish a new wine tasting room in a
commercial business space located at the southwest corner of 7th Avenue and San Carlos
Street in Hampton Court. The proposed tasting room would feature wines exclusively from
Holman Ranch Estates, which grows its grapes and produces its wine in Monterey County at the
northeastern tip of Carmel Valley. Holman Ranch Estate Vineyard and Winery currently has one
Type 02 Alcohol and Beverage Control (ABC) license as well as one Type 02 Duplicate license
for the off-site sales of wine. Holman Ranch closed a wine tasting room in May 2017 located at
19 E. Carmel Valley Road Suite #C and would transfer this duplicate Type 02 license to the

proposed wine tasting space in Carmel. Background information on Holman Ranch is included in
the applicants project description letter (Attachment E). A floor plan depicting the percentage
of floor area devoted to wine tasting as compared to the floor area devoted to retail is included
in Attachment A. The applicant is proposing a total of 22 seats; including a bar with 4 seats, and
table and bench seating with a total of 18 seats.

Staff is recommending denial of the application because the proposed location is south of
Ocean Avenue and violates the Citys Wine Tasting Policy. The applicant was notified of this
issue, but chose to proceed with the application. Because the proposal is inconsistent with a
policy guideline, and not a Municipal Code requirement, the applicant is still permitted to apply.

Staff analysis:

Use Permit: CMC 17.14.030 requires that a Use Permit to be obtained for the establishment of
a wine tasting shop. A wine tasting shop is defined as (CMC 17.68.030): Establishments
primarily engaged in the retail sale of wine for off-site consumption and as an ancillary use
includes the service of wine for on-site consumption.

Revised Wine Tasting Policy: The City Council adopted a Wine Tasting Policy on March 3, 2015,
which is included as Attachment B. Below is a summary of the key components of the adopted
wine tasting policy followed by an analysis of the proposals compliance with the policy.

Wines originating from Monterey County Vineyards and Wineries and locating their off-
site tasting rooms in Carmel are desired and strongly encouraged. The tasting room
should have a Duplicate Type 02 ABC license of a primary Type 02 ABC licensed winery
located within Monterey County. All wines stored, displayed, and offered for sale and
tasting should have been produced in a Type 02 Bonded Winery located in Monterey
County with the vast majority (i.e. 75% or more) from grapes grown in Monterey County.

Analysis: The Citys Wine Tasting Policy encourages the Type 02 license because it promotes
local wineries rather than general wine brokers. Holman Ranch Estate Vineyard and Winery is
based in Carmel Valley and is licensed and bonded as a Type 02 winery. The applicant is
proposing to offer only Holman Ranch Estate-grown wines for sale and tasting. Holman Ranch
would transfer an existing Duplicate Type 02 ABC license from a previous wine tasting room
that had closed to the proposed new tasting room in Carmel.

No more than three wine tasting Use Permits for new locations shall be issued within any
12-month period. To encourage diversity in the Commercial District, retail wine tasting
shops located north of Ocean Avenue are strongly encouraged.

Analysis: Within the last 12 months, the City issued two new use permits for the relocation of
two existing wine tasting rooms: one for the relocation of the Blair Vineyard tasting room and
the other for the relocation of the Albatross Ridge tasting room. The proposed tasting room
would be the first use permit issued for a new wine tasting room within the past 12 months.

Staff notes that the tasting room is proposed to be located at the southwest corner of 7th
Avenue and San Carlos Street, which does not comply with the Wine Tasting Policy regarding
wine tasting room location. The intent of this policy is to encourage an even distribution of
wine tasting rooms. Dawn's Dream Wine Tasting Room and Sylvestri Vineyards Tasting Room
are located on the north side of 7th Avenue, across the street from the project site, and Scheid
Vineyards Tasting Room is located across the street at the southeast corner of 7th Avenue and
San Carlos Street. At present, there are 14 wine tasting rooms south of Ocean Avenue and only
5 wine tasting rooms north of Ocean Avenue. A list and map of existing wine tasting rooms in
the City is included as Attachment C.

A wine tasting room may be permitted a limited number of special events specified
through the Use Permit for the purpose of marketing and educating current and
potential customers on wine.

Analysis: On August 10, 2016, the Planning Commission adopted an addendum to the Citys
Wine Tasting Policy addressing wine tasting room events. As a Routine Event tasting rooms
are allowed a maximum of 2 events per month. These events generally do not involve a large
number of attendees, live music, or any activities outside of the building, and are strictly for the
purpose of promoting wine sales.

As a Special Event tasting rooms are permitted live music and can be held for general social
functions that may or may not be for the purpose of promoting wine sales. Pursuant to
Municipal Code Section 9.16.030, the business is allowed a maximum of 4 special events per
year, subject to written authorization from the Community Planning and Building Director upon
review of each specific request.

In order to avoid the appearance of a bar, the wine tasting service and seating area
should generally be limited to no more than 30% of the floor area of the retail space. The
remaining area should primarily consist of wine-related retail display.
In general, the size of the retail and wine tasting area combined (office and storage
excluded) should be no larger than 1,000 square feet.

Analysis: The primary intent of the above referenced guidelines is to ensure that tasting rooms
are not operating as a bar or taking on such an appearance. The applicant is proposing 22 total
seats including 4 seats at a bar and 18 seats composed of table and bench seating. Staff's
primary issue is the amount of floor area that will be occupied by the tasting room seating. The
policy requires that the wine tasting area (including the tasting counter) shall occupy no more
than 30% of area of the retail space and not the entire building. The applicant states that the
tasting room will occupy 29.8% of the entire building. Additionally, the applicant has included
the wine tasting counter in the wine-related retail display rather than in the wine tasting service
and seating area. The square footage amounts provided by the applicant do not appear to be
accurate; however, in staff's estimation, after deducting the tasting counter from the retail area
and adding it to the tasting room floor area, the tasting room would constitute approximately
70% of the total combined retail and wine tasting area (excluding office and storage) (See Floor
Plan in Attachment E.)

Since the wine tasting and seating area exceeds the 30% allowed by the wine tasting policy, this
business does not comply with the limits set by the City's wine tasting policy. The majority of
the retail floor area is proposed to be occupied by the tasting room and large tasting counter
while only a small area will be devoted to the sale of wine-related retail. While wine tasting
rooms often do not need large display areas, as the wine is often stored in a climate sensitive
environment, and marketing occurs via tasting, staff cautions against allowing the use of
unoccupied retail area for seating as this would create the appearance of a bar. If the
Commission supports approving the business at the subject location, it should require a
reduction in the number of seats and/or tasting area.

Tasting should only involve traditional wine based products such as still wines, sparkling
wines or Port-type products, no other alcoholic beverages should be permitted to be
tasted or purchased.
The maximum serving size should be 2 ounces per serving. Customers should not be
permitted to drink bottles of purchased wine in the store and no wine tasting should take
place on public property.

Light snacks such as cheese, crackers, and bread may be served; however, meals are not
permitted.

Analysis: The applicant has not indicated if they will comply with the maximum serving amount
or whether they will serve light snacks. If the Commission decides it can support a tasting room
in this location, the Use Permit can be conditioned so that all activities would be conducted in
compliance with the adopted Wine Tasting Policy.

In order to encourage diversity and maintain a balanced mix of uses, no more than five
establishments offering tasting should be permitted within any standard two-block area.

Analysis: There is one other wine tasting room in the subject two-block area: Scheid Vinyards,
which is located at the southeast corner of San Carlos and 7th Avenue.

Night time hours should generally be limited to no later than 9:00 p.m.

Analysis: The applicant is proposing hours of operation from 12:00 pm to 7:00 pm daily. The
proposed hours comply with the city's wine tasting ordinance.

Environmental Review: The application qualifies for a Class 3 Categorical Exemption from the
provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15303 of the
State CEQA Guidelines. Class 3 exemptions include projects involving limited new construction
projects and conversion of small structures. The proposed project does not present any unusual
circumstances that would result in a potential significant environmental impact.

Purpose

To establish guidelines for the review and approval of wine tasting facilities in the Central
Commercial and Service Commercials Districts in the downtown.

Policy

The General Plan encourages a balanced mix of uses that serve the needs of both local and non-
local populations. The Planning Commission recognizes the demand for establishing wine
tasting facilities but also recognizes that their proliferation could impact the balanced mix of uses
that the General Plan encourages.

Definition

A wine tasting room is a stand-alone establishment with a Duplicate Type 02 ABC license, in
which the primary purpose to encourage patrons to purchase wine for off-site consumption.
Establishments should not operate as a wine bar, where the primary purpose would be for patrons
to consume wine on premise other than for the purpose of wine tasting. It is recognized that
tasting rooms host occasional promotions and special events to encourage sales and marketing of
wine for the education and development of current and potential customers.

The following standards are recommended and shall be considered by the Planning Commission
in its review of wine tasting permits:

1. Wines originating from Monterey County Vineyards and Wineries and locating their off-
site tasting rooms in Carmel are desired and strongly encouraged. The tasting room
should have a Duplicate Type 02 ABC license of a primary Type 02 ABC licensed
winery located within Monterey County. All wines stored, displayed, and offered for sale

consider proposals on a case by case basis that meet the intent of this density limitation.
10. Night time hours should generally be limited to no later than 9:00 p.m.
11. Wine tasting associated with other uses such as retail food, art galleries, clothing stores,
and the like is discouraged.

*For the purposes of this policy a standard two-block area would include all commercial spaces on both sides of a
street located between the next two cross streets. The cross streets at the end of the blocks are also included up to
the mid-point of each block.

Wine Tasting Room Events

Routine Events: These are normal business activities that are strictly for the purpose of
promoting wines sales. These events generally do not involve a large number of attendees, live
music, or any activities outside of the building. Wine tasting rooms are allowed e a maximum of
2 routine events per month and a total of 24 routine events per year. Routine events include
activities such as wine club events, library tastings, and pairing functions, such as wine and
chocolate, wine and cheese, or pairings with other food products that are not classified as full
meals.

Special Events: Special events are permitted live music and can be held for general social
functions that may or may not be for the purpose of promoting wine sales. Pursuant to
Municipal Code Section 9.16.030, the business is allowed a maximum of 4 special events per

CONSIDERATION:
Consideration of findings for the denial of Use Permit (UP 17-442) to establish a new wine

RECITALS:

1. The commercial space is located within Hampton Court on 7th Avenue at the southwest
corner of San Carlos Street and 7th Avenue.

2. The proposed uses are classified as follows according to the North American Industrial
Classification System (NAICS):

Primary Use
Wine Tasting 73% of the floor area of the retail space
Retail Sales 27% (wine, wine related merchandise)

Ancillary Use

3. Carmel Municipal Code (CMC) Section 17.14.040 requires a Use Permit issued by the
Planning Commission for the establishment of all wine tasting rooms.

4. The applicant, Holman Ranch Estate Vineyard, applied for a Use Permit for a wine
tasting business on November 16, 2017.

5. Holman Ranch Estate Vineyard is a Type 02 bonded winery based in Monterey County.

6. The City Council adopted a revised Wine Tasting Policy on March 3, 2015. The revised
policy strongly discourages new wine tasting establishments south of Ocean Avenue.

FINDINGS FOR DECISION

1. Finding: The proposed wine tasting room is inconsistent with Standard #2 of the Wine
Tasting Policy, which states:

To encourage diversity in the Commercial District, retail wine tasting shops located north
of Ocean Avenue are strongly encouraged.

Evidence: The proposed location of the wine tasting room is south of Ocean Avenue
and is thus inconsistent with this policy.

2. Finding: The proposed wine tasting room is inconsistent with Standards #4 and #5 of
the Wine Tasting Policy, which states:

In order to avoid the appearance of a bar, the wine tasting service and seating area
should generally be limited to no more than 30% of the floor area of the retail space. The
remaining area should primarily consist of wine-related retail display.

Evidence: The proposed wine tasting service and seating area constitutes
approximately 70% of the total 733 sq. ft. retail floor area. The proposed floor area
would, in staff's opinion, present the appearance of a bar and would not comply with
the requirement limiting the percentage of floor area devoted to wine tasting.

Project Description

Nearly twelve years ago, Tom and Jarman Lowder purchased the historic Holman Ranch in Carmel
Valley. As long-time residents of Cannel-by-the-Sea, they saw an opportunity to not only restore and
honor the storied ranch, but to also fulfill one of their lifelong dreams, producing their very own
estate-grown wine.

After purchasing the ranch, Tom and Jarman spent two years refurbishing the property and planting the
vineyards. In 2009, the Lowders produced their very first vintage~ While it should have been a joyous
time for the Lowder family, sadly it was not. Jarman had been diagnosed with early onset alzheimer's
and the family was dealing with the heartbreak.

In 2011, Jarman passed away. With her memory at the heart of all our operations, Holman Ranch has
continued to grow and produce outstanding estate-grown wine and olive oil. Ten years after the first
harvest, Holman Ranch is now producing 150 barrels per year. The ranch also hosts numerous weddings
and events each year, helping to boost the region's popularity and economy.

To honor Jarman's dream of sharing Holman Ranch's estate wine with as many people as possible, we
hope to open a tasting room in Carmel-by-the-Sea. Our Tasting Room design concept was created to
honor and reflect the historical Carmel-by-the-Sea style; with terracotta inspired tile flooring, rich
wooden bam doors and zinc countertops. We have no plans to change the existing exterior of the
building, other than to hang a modest sign in front of our space.

Many of our employees live in Cannel-by-the-Sea and we all enjoy the unique nature of the town and all
it has to offer. We would take great pride in joining the many beloved business already there. In
bringing our tasting room to Carmel-by-the-Sea, we hope to share with the public our elegant estate
wines, along with the iconic story of Holman Ranch. Most importantly we hope to be a part of a
community we are proud to call home.

the 7th and San Carlos location in Carmel-by-the-Sea. Holman Ranch currently operates
a duplicate 02 license at the Tasting Patio located at 18 W. Cannel Valley Road, that
