AFFIDAVIT OF DESISTANCE
I, ANTONNETH D. GABALFIN, Filipino, single, of legal age and a
resident of Lily St., Brgy. Anayan, Pili, Camarines Sur, do hereby, under oath,
states that:

1. I am the Private Complainant in Criminal Cases Nos. P-4940, P-4941, and P-

4942 all entitled and docketed as People of the Philippines versus Archie
Tormes y Doe, filed before the Regional Trial Court of Pili, Camarines Sur
Branches 31, 32, and 33, respectively;

2. I am no longer interested in the further prosecution of the above-entitled cases

and have decided to withdraw the same considering the fact that I was not
raped by said Archie Soliman Tormes, the truth being that when we engaged
in sex, we were sweethearts, hence, what happened was consensual;

3. The above-entitled cases were filed without my consent because my parents

were against our relationship because at that time I was only sixteen (16) years
old and was third year high school student;

4. Because I was minor then, I was not able to do anything to prevent the filing of
the case against my then boyfriend Archie Soliman Tormes;

5. I am aware and have full knowledge that in executing this Affidavit of

Desistance and in deciding to withdraw the case I filed against Archie Soliman
Tormes, I cease to have any right to pursue this action in court;

6. Nobody forced nor coerced me in the execution of this Affidavit of Desistance.

IN WITNESS WHEREOF, I have hereunto affixed my signature this 12th

day of December 2017 at Naga City, Philippines.
