COMPLANT AFFIDAVIT
I, MS. A, Filipino, of legal age, residing at 123, Quirino Ave., Manila, after having sworn to,
states that:
1. On Nov. 24, 2017, at around 7:30 in the evening, after my Practice Court 1 class in Arellano
University School of Law, I went to Harbor Square.
2. After dinner, I left Harbor Square at around 11 oclock in the evening. While I was walking
on my way home, I was approached by a certain male person, whom I later on learned to
be Mr. B.
3. After approaching and talking to me, Mr. B invited me to have coffee with him. Since I dont
know him, I declined his invitation.
4. Suddenly, he grabbed my shoulders and forced me to go to the dark alley along Taft Ave.
He pushed me against the wall and started kissing me. When I resisted, he pointed to me
a knife, and threatened to slash my throat if I will not give in to his request to have carnal
knowledge with me.
5. He started to unbuttoned my pants and took my underwear off. He covered my mouth and
he unbuttoned his pants. He then inserted his penis into my vagina. I tried to shout but
he threatened to kill me.
6. After succeeding to have carnal knowledge with me, he immediately ran away.
7. I shouted for help, and the Barangay Tanod was able to apprehend him.
8. I was immediately bought to Quirino Medical Hospital for the conduct of a physical
examination. A copy of the Medical Certificate is hereto attached as Annex A.
9. I am executing this Complaint-Affidavit to charge Mr. B of the crime of Rape punishable

under Art. 266-A of the Revised Penal Code.
10. Affiant has nothing further to say.

Petitioner, thru counsel, respectfully states that:
1. Petitioner is a Filipino citizen, of legal age, single, and a resident of 1234 Quirino Ave., Manila City.
2. Respondent government agency (description) charged with the repository of Transfer Certificate
of Titles, with address at 4567 Quirino Ave., Manila City, where summons may be served.
3. Petitioner is the registered owner of a parcel of land located at 5678 Malate Manila, covered by
TCT No. 12356 issued by the Register of Deeds of Manila. A copy of TCT No. 12356 is hereto
attached as Annex A.
4. Sometime in December 2, 2016 a fire occurred at my house and all my belongings were burnt,
including the cabinet where TCT No. 12356 was kept.
5. On January 2, 2017, petitioner executed an Affidavit of Loss to attest to the loss of TCT No. 12356.
A copy of the Affidavit of Loss is hereto attached as Annex B.
6. That petitioner cause the annotation of the fact of loss at the back of TCT No. 12356 with Entry No.
789 at the Register of Deeds of Manila.
7. The property is not mortgaged, sold, transfer to any person, nor subject to any encumbrance.
8. This Petition is being filed pursuant to Sec. 109 of Presidential Decree No. 1529.
PRAYER
WHEREFORE, premises considered, petitioner respectfully prayed before this Honorable Court that
after due notice and hearing, a new owners duplicate of TCT No. 12356 registered under the name of Mr. X,
shall be issued in favor of the petitioner.
