AFFIDAVIT OF DESISTANCE

I, HARVEY REGINALD SPECTER, of legal age, Filipino, married, with address at

Purok 6, Bogtong, Legazpi City, Albay, after having been duly sworn to in accordance with law,
do hereby depose and state that:

1. I own an unfinished single-storey house located at Purok 6, Bogtong, Legazpi City;

2. On December 10, 2017 around 5:30 oclock in the afternoon, I was informed by the Punong
Barangay of Purok 6, Bogtong, Legazpi City that a certain Hino Wing Van Truck with
Plate No. ABC123 driven by Louis Litt accidentally bumped the concrete side portion of
my house. Such accident resulted in crack and slight damage to my property;

3. Subsequently, a certain Michael James Ross, approached me representing himself from

Pearson Hardman Trucks Logistics owned by Jessica Pearson with office address at Mason
St., Filinvest II, Batasan Hills, Quezon City and the duly registered owner of Hino Wing
Van Truck which accidentally bumped my house;

4. Subsequently, I and Mr. Ross have made an amicable settlement regarding the payment of
the damages incurred to my house in the amount of FIFTY SEVEN THOUSAND PESOS
(Php57,000.00);

5. Hence, I hereby hold Pearson Hardman Trucks Logistics free from any civil or criminal
liability insofar as the vehicular incident referred to in paragraph 2 above;

6. That I executed this Affidavit of Desistance with my own freewill and I was not forced,
intimidated nor pressured in signing this document. I also fully understand the
consequences thereof.

7. That I executed this Affidavit of Desistance in order to attest to the truthfulness of the
foregoing and declaring that I am no longer interested in pursuing any complaint against
Pearson Hardman Trucks Logistics.

IN WITNESS WHEREOF, I have hereunto affixed my signature this 15th day of
