TRUE BILL OF INDICTMENT

IN THE NAME AND BY AUTHORITY OF THE STATE OF TEXAS, the Grand Jury of Bexar County, State of
Texas, duly organized, empaneled and sworn as such at the November term, A.D., 2017, of the
Judicial District Court of said County, in said Court, at said term, do present in and to said Court that in the
County and State aforesaid, and anterior to the presentment of this indictment:

Count 1: OFFICIAL OPPRESSION

on or about the 15th Day of June, 2016, MICHAEL FERNANDEZ, as a public servant, namely: a Bexar County
Sheriffs Deputy, acting under color of his employment or office, did intentionally subject GILBERT RAMOS to
mistreatment, to-wit: by striking Gilbert Ramos with the hand of the defendant and pulling Gilbert Ramos with the
hand of the defendant, knowing said mistreatment was unlawful;
COUNT 2: VIOLATION OF THE CIVIL RIGHTS OF PERSON IN CUSTODY

on or about the 15th Day of June, 2016, MICHAEL FERNANDEZ, hereinafter referred to as -defendant, an
employee of a correctional facility, namely, the Bexar County Adult Detention Center, knowing his Conduct was
unlawful, did intentionally deny or impede a person in custody, namely: GILBERT RAMOS, in the exercise and
0 enjoyment of any right, privilege, or immunity, to-wit: the right to be free from unlawful mistreatment, by striking

Count 4: TAMERING WITH RECORD

on or about the 15th Day of June, 2016, MICHAEL FERNANDEZ, hereinafter referred to as defendant, in his
capacity as a public servant, did then and there knowingly make a false entry in a governmental record, to-wit: a
Bexar County Adult Detention Center Incident Report, the false entry being, that defendant inadvertently struck
GILBERT RAMOS' face with defendant's hand;
