Subject: Request for expediting action on TEP and Copy of complain to Finance Ministry regarding
inaction of Income Tax department Kolkata On TEP, investigation on TEP, Tax Recovery and sharing
information on outcome of investigation.

Honorable Sir,

We support respectable Prime Ministers and respected Finance Ministers endeavor in the fight
against black money , hence request your help for the below.

Kindly request you to intervene for instructing the Income Tax Department of Kolkata to expediently
complete investigation on TEP(Tax Evasion Petition) as there is no effort from Income Tax Department
Kolkata in completing the investigation expediently, subsequent recovery of Taxes from black money
holders and punishments to them(wherever applicable) . And supply the requested information on
the outcome of TEP.

Please find the Copy of complain to Finance Ministry regarding inaction of Income Tax department
Kolkata On TEP, investigation on TEP , Tax Recovery and disclosure of information on TEP Outcome.

Ground For Complaint:

Tax Evasion petition(TEP) has been filed on 01.08.2017 and 22.08.2017 (annexure-12)and RTI on the
TEP filed on 04.09.2017 (attached as annexure-11)and First Appeal on RTI on 14.09.2017 (attached as
annexure-10)yet my RTI application on the TEP are being forwarded from department to department
without any concrete action being taken on the information provided through my TEP.

No replies were received from Principal Chief Commissioner of Income Tax West Bengal and Sikkim on
my RTI.

After my First Appeal (attached as Annexure-10) to Additional Commissioner of Income Tax


(ACIT)Kolkata my RTI application on TEP was forwarded to Principal Director of Income Tax (Inv.) West
Bengal and Sikkim,( attached as Annexure-8), [from the date on the envelope of the order
of A.C.I.T it clearly shows that this order was made only after receipt of my first
appeal since the stamp date of post office on the envelope shows as 21.09.2017
and 22.09.2017(attached as annexure-9), whereas date mentioned in the letter
is 15.09.2017(attached as annexure-8)].This makes it evident that they (Principal
Chief Commissioner of Income Tax West Bengal and Sikkim, Additional Commissioner of Income Tax
Kolkata,)are covering up their lies and using different tactics to delay the
investigation process and deny the information based on the outcome of the
TEP investigation.
DDIT(Deputy Director of Income Tax)Inv.Admn., Kolkata rejected points(1,15 and 17) in my RTI
application and forwarded my RTI Application on TEP to ITO Ward 50(1) and ITO Ward 29(1).
(attached as Annexure-7)

ITO Ward 29(1) has forwarded section relevant to Prasanta Sircar to ITO Ward 50(1) attached
as Annexure-6

It may be noted that as per reply of ITO Ward 50(1) Kolkata


which was received earlier on 08.05.2017 -No income tax
returns were ever filed by Prasanta Sircar between 2000-2014
(attached as annexure-16)
ITO Ward 50(1) has now forwarded the RTI relevant to Prasanta Sircar to ITO Ward 28(1),
citing change of jurisdiction (attached as Annexure-4).

Joint Commissioner of Income Tax kolkata has malafidely and without


application of his mind Rejected my First appeal u/s 7(1) of RTI Act(Right to life and
liberty in spite of me being under arrest and out on court bail for a case in which
charge-sheet also has been presented wherein it has been stated
and admitted by all 3 i.e Sirsha Sircar, Prasanta Sircar and
Moumita Sircar that :articles worth 40 lakhs were given at the
time of marriage i.e 26th January 2011, and were stolen by me
and my family members .This rejection of my First Appeal further
shows the collusion between J.C.I.T Kolkata, A.C.I.T Kolkata and Principal
Chief Commissioner of Income Tax West Bengal and Sikkim in their effort
to delay and derail the TEP investigation and deny information on TEP RTI
and provide false information using different tactics even after First Appeal on
my RTI(attached as annexure-3) where Life and Liberty is concerned and thereby in
total violation of Article 21 of the constitution of India r/w judgement in case of
SheelaBarse V. State of Maharashtra AIR 1983 SC 378.
CBDT has also rightly forwarded the First Appeal u/s 19(1) of RTI Act to Principal
Chief Commissioner of Income Tax West Bengal And Sikkim for further
necessary action but till date no action has been taken based on the
same.(attached as annexure-20).

Additional Director of Income Tax has rightly forwarded the First Appeal u/s
19(1) of RTI Act to Principal Chief Commissioner of Income Tax West Bengal And
Sikikim for necessary action on the same after upholding my First Appeal.
(attached as annexure-21).

Till date no news regarding completion of investigation on TEP, assessment


/reassessment based on TEP , information on the outcome of TEP has been
received from either of the aforementioned (Joint Commissioner of Income
Tax Kolkata, Additional Comissioner of Income Tax Kolkata, Principal Chief
Commissioner of Income Tax West Bengal And Sikkim, ITO Ward 28(1) ,ITO
Ward 50(1),and ITO Ward 29(1))departments/offices , which also shows the
highly lackadaisical and negligent way of handling such applications being
highlighted even in the comments of CIC decision (attached as annexure-17)
given for the RTI related to Prasanta Sircars income Tax returns.
Relief Sought:

I request you to kindly intervene for instructing the Income Tax Department of Kolkata to
expediently complete investigation on TEP(Tax Evasion Petition) as there is no effort from
Income Tax Department Kolkata(Joint Commissioner of Income Tax Kolkata ,Additional
Comissioner of Income Tax Kolkata, Principal Chief Commissioner of Income Tax West Bengal
And Sikkim, ITO Ward 28(1),and ITO Ward 29(1)) in completing the investigation expediently,
subsequent recovery of Taxes from black money holders and punishments to them(wherever
applicable) . And supply the requested information on the outcome of TEP which is also
required in the interest of Justice for proving innocence of 4 people (me and my family
members) in a case( Case no.550/13-Lake P.S-FIR Copy enclosed as annexure-1) filed by my
wife Smt.Sirsha Sircar in which chargesheet (copy of chargesheet-attached as annexure-
15)has also been submitted wherein it has been stated and admitted by all 3 (Sirsha
Sircar,Moumita Sircar and Prasanta Sircar)that items worth 40 lakhs were given by Sirsha
Sircars Parents i.e Prasanta Sircar and Moumita Sircar.
