OSH LEGISLATION CASE STUDY

QUESTION 1

Clean Water Sdn. Bhd. is a Water Treatment Plant company in Selangor. It has 44
workers; 30 are permanent workers while 14 are workers from it sub-contractor Sure
Clean Sdn. Bhd.

Clean Water Sdn. Bhd. has been in operation since 1998. The activities cover from
filtering process, treatment and supply the clean water to the residential area within
Bandar Api-Api.

The Water Treatment Plant covers an area of 1 hectare. In the plant there are 4 water
pumps, 2 electric gantries crane 5 tones, 1 forklift, 1 generator and 3 air compressor.
There is also a chemical store storing few containers of liquid chlorine, each weight 30
kg. There are also other chemicals stored in the chemical store mainly chemicals for the
purpose of water treatment.

12 Jan 2001, 9.30 pm, 1 of the 3 air compressor burst and causes a serious damage to
the chemical store. DOSH officer who investigate the accident found that the air
compressor is just undergo maintenance work by Renti Sdn. Bhd another sub-contractor
for Clean Water Sdn. Bhd. Records showed that the sub-contractor just placed a piece of
metal and weld it to cover the damage area of the air compressor.

The overall investigation found that a there were few serious accidents and poisoning
cases happened 2 years ago but not being reported as the injured workers were not
their workers.

Inspection also found that all the machines installed in the plant are not approved by
DOSH and some of them which require Certificate of Fitness do not have it.

There is also no complete inventory on the chemicals and the containers are without
label. Interviews have been conducted among the workers and they express that they
are not given any training and information about the health effects of the chemicals they
used in operation.

Question

1) Please list all the non-compliance of OSH Legislation in this scenario.

2) As a Safety and Health Officer of the company please recommend control


measure as to prevent the recurring of the accident.

Selamat Jalan Sdn. Bhd. is a bus transportation company and has been serving the
community since 1977.

The company has branch offices in Alor Setar and Kota Bahru. At present the company
hires 320 staff.

The head office in Kuala Lumpur has 146 staffs while the branch offices have 100 staffs in
Alor Setar and 74 staffs in Kota Bahru.

This giant company has 60 buses and also its own workshop to conduct maintenance
work. However the workshop in under the responsibility of it contractor; Renti Sdn. Bhd.

Renti Sdn. Bhd. has 20 staffs and a manager in the head office and 18 staffs in Alor Setar
branch office and 10 staffs in Kota Bahru branch office.

Selamat Jalan Sdn. Bhd. allows Renti Sdn. Bhd. to operate in their premise as to ensure
the work for maintenance runs smoothly.

Question

You as the Advisor of Safety and Health has been request by Selamat Jalan Sdn. Bhd. to
form a Safety and Health Committee for them in accordance to Occupational Safety and
Health (Safety and Health Committee) Regulations 1996.

Please provide your recommendations to Selamat Jalan Sdn. Bhd.

Case:

A worker who was working on a stepladder to replace a fluorescent lamp fell because he
lost his balance when goods on a hand truck being transported by another worker
dropped and hit the stepladder.

Conditions at the time of the occurrence of the accident

A brief meeting was held from 8.30 am (working start time) and the work started
immediately after the meeting.

Mr. A overslept and did not able to eat breakfast rushed to work by car. On the way, he
was trap in traffic and came to work at 8.50 am. The briefing meeting was over at that
time.

Mr. B, Supervisor, instructed Mr. A to transport goods that were prepared on the
previous day. In order to carry the goods quickly, Mr. A was hastily pushing a hand truck
loaded with more goods than usual (goods were stacked so high that he could not see
ahead very well). Mr. C from maintenance department, was working on the stepladder
(150 cm in height) to replace a fluorescent lamp that had burned out. He was standing
on the top plate of the stepladder as he could not reach the fluorescent lamp. When Mr.
As hand truck passing by Mr. C, it got stuck on waste materials (made of metal) left in
the passageway, and the goods on the hand truck fell and hit the stepladder, making the
stepladder swaying. Mr. C lost his balance and fell from the stepladder, striking his back
and head against the floor. When Mr. C fell from the stepladder, he lost his safety
helmet.

Mr. B rushed to Mr. C and asked him about the condition of his injury. He said, Ill be all
right if I take a rest for a while and apply a compress to my back. Mr. C engaged in his
office work until closing time. Mr. C than returned home, and he had a severe headache
late at night, and was send to a hospital by ambulance, and was immediately
hospitalized for examinations. He has been hospitalized since then.

Specifications of stepladder

Materials: Made of aluminium, with clampers and stoppers, which had been fully
engaged during the work performed by Mr. C.

State of management

1) Working clothes to be worn while working: designated working clothes, safety shoes
and safety helmet.

2) Before starting work, they do exercise, hold a meeting win which work details of the
day are briefly explained.

3) While working at this warehouse, they do not use extremely hazardous machines and
facilities, so sufficient safety education has not been provided to employees.
Especially, Mr. B, who used to be in a supervisory position at the parent company has
not received any training at all.

4) There is a work procedure manual for the stepladder, but there is no manual for
transport work using the hand truck, and work has been performed based on
individual judgement of workers.

Beauty Clothing Sdn. Bhd. is a company which hiring 600 workers. The distribution of
the workers is as stated below:

1. Headquarters Office 250 workers


2. Branch Office A 200 workers
3. Branch Office B 150 workers

This company produces kids apparel to be exported and it has been in operation since
1990. The activities cover from cutting, sewing and knitting. 70% of the workers are
female aged in the range of 16 50 years old. However due to high demand, the
company hire contract workers aged range of 15 to 25 years old.

Headquarters Office and Branch Officer A operates at 4 storey shop houses while the
Branch Office B operates at 2 storey shop houses. All the location situated in the
residential area. There are lots of equipments and machineries used in this company
such as:

1. Electrical Steam Boiler;


2. Electrical Steam;
3. Air compressor;
4. Manual and electrical sewing machines;
5. Cloth cutting machines;
6. Knitting machines; and
7. Lifting machines

Recently, the Headquarters office receives notification notice on inspection at the


workplace from DOSH. According to the notice the inspection will be conducted early
next month.

The company request advice from you as a Safety and Health Consultant to assist him in
compliance with OSH Legislation.
