COOPERATION IN THE MAKING

( STUDY RESEARCH DEPARTMENT OF COOPERATION AND SMALL
MEDIUM BATAM CITY GOVERNMENT )

Notary is a semi public profession. A notary holds a public position but the
scope of his/her work is in the construction of private law. After the issuance of the
Ministerial Decree No. 98/KEP/M.UKM/IX/2004, a notary has an authority to
make/issue a cooperative act (notarial document). The involvement of notary not only
helps the process of the making of cooperative acts but also cares for the development
prospect of the cooperative which becomes his/her client and is ready to provide
supervision and legal consultation related to the making of cooperative act in order
that those who are active in cooperative movement and the cooperative community
can more understand legal matters.
This study aims to determine the juridical analysis tasks and functions of a
notary in the deed of cooperatives in the department of cooperatives and small and
medium businesses in Batam. This research uses descriptive method by using the
normative approach (legal research) to obtain secondary data as well as empirical
pendekataan, to obtain primary data through field research.
The results showed that the duties and functions of a notary in the deed of
cooperatives in the department of cooperatives and small and medium enterprises
Batam is not effective because there are still quite a lot of notaries who do not
understand the ins and outs of cooperatives and their requirement for a notary a
certificate of proof has followed a briefing in the field of cooperatives considered
burdensome.
For it is expected the government together with department of cooperatives
and small and medium enterprises Batam to always socialize deed cooperatives and
amendments through the services of a notary and make changes to the Law of the
Republic of Indonesia Number 25 of 1992 concerning Cooperatives.
