Supplemental Request for Notice to Proceed with Tree Clearing

Dear Ms. Bose:

On November 28, 2017, the Federal Energy Regulatory Commission (Commission)


issued an Order Issuing Certificate (Order), in the above-referenced docket authorizing
Millennium Pipeline Company, L.L.C.s (Millennium) Eastern System Upgrade Project. 1 On
December 5, 2017, Millennium accepted the certificate and filed a written statement affirming
that it had executed firm contracts for the capacity levels and terms of service represented in
signed precedent agreements. In accordance with Ordering Paragraph (B)(3) and Environmental
Condition No. 6 attached to the Order, Millennium filed its Implementation Plan for the Project
on December 7, 2017. On December 15, 2017, Millennium filed supplemental information in
support of its Implementation Plan requested a Notice to Proceed (NTP) with construction.

On December 19, 2017, the Commission granted Millenniums request for an NTP and
authorized Millennium to commence construction of the Project, with the exception of the
pipeline facilities located on the Huckleberry Ridge State Forest parcel. The Commissions NTP
required Millennium to file its Temporary Revocable Permit/easement agreement from the New
York State Department of Environment and Conservation and request a separate notice to
proceed before work can begin at that location. Millennium has obtained the Temporary
Revocable Permit approved by the New York Department of Environmental Conservation
(NYSDEC) to begin tree clearing in the Projects temporary and permanent workspaces in the
Huckleberry Ridge State Forest, attached hereto. The Temporary Revocable Permit contains
privileged and confidential information and is marked as CUI/PRIVCONTAINS
PRIVILEGED INFORMATIONDO NOT RELEASE and should be treated as
confidential for use by Commission Staff only and should not to be released to the public.

In furtherance of the Commissions December 19, 2017 NTP, Millennium respectfully


requests Commission approval for a Notice to Proceed with tree clearing in the Huckleberry
