PREAMBLE

Govt. of Maharashtra has decided to conduct a single Combined Common


Entrance Test for selection to all degree courses in Health Science, BVSc & AH,
Engineering and Pharmacy courses. The Entrance Test will be held on Thursday
6th May 2010 at all the district headquarters in Maharashtra.

The Competent Authority for the ‘MHT-CET-2010 Examination’ is Director


of Medical Education and Research, Mumbai. However for the selection process
there will be two separate Competent Authorities. For selection to Health Science
courses, Director of Medical Education and Research, Mumbai will be the
Competent Authority. For selection to Engineering and Pharmacy courses
Director, Technical Education, Mumbai will be the Competent Authority.

The application form for MHT-CET-2010 is common for all the above said
courses. However, the information brochures for Health Science Courses,
Engineering courses and Pharmacy course are separate. The results of MHT-CET
2010 will be made available at the website of Directorate of Medical Education
and Research (http://www.dmer.org) and of the Directorate of Technical
Education (http://www.dte.org.in).

CLARIFICATION
The Hon’ble Supreme Court (Bench of Hon. 7 judges) has delivered a judgment on
12/8/2005 in Civil Appeal No.5041/2005 in SLP (C) No.9932/2004 in respect of ‘rights and
entitlement’ of Government as against Private Professional Educational Institutions (including
Colleges conducting graduate and postgraduate Health Science courses). This judgment
expects enactment of legislation by Central Government and in its absence, by State
Government in this regard. This process has been initiated. However it is not certain, as of
this date, as to when such legislation will come into force, as also its provisions.

In the meanwhile, in terms of the observations of the Hon’ble Supreme Court from
the aforesaid judgment, at least at this stage, it appears that State Government cannot claim
any quota/seats in these colleges/institutions and consequently cannot effect admissions in
these Private Medical Colleges/institutions, except to the extent agreed by certain
institutions, if any.

It is therefore made clear that on the aforesaid interpretation and advice given to the
State Government, this Brochure will not apply to the admissions to be effected in the
academic year 2010-2011 at the Private Health Science Colleges/Institutions, in so far as
undergraduate courses are concerned, with the above exception.

However, it is made expressly clear that if, after issuance of this Brochure, either on
account of any legislation or on account of any different interpretation/opinion/advice or due
to any judgment/order passed by any court of law or even otherwise, the State Government
is found entitled to any seat(s) in the Private Health Science Colleges/Institutions and
consequently entitled to effect the admission(s) to such seat(s), the rules and regulations set
out in this Brochure will be made applicable to such seat(s) and admission(s). In such event,
a separate intimation will be issued with appropriate details.

It is further clarified that separate information brochure will be issued at the time of
filling of preference form giving details as to availability of number of seats, their institution
wise, category wise distribution as also rules and regulations governing such distribution and
consequent allotment of seats of Government as also Private Health Science Colleges /
Institutions, if any. It is also made hereby clear in no uncertain terms that the same
‘Common Entrance Test (MHT-CET-2010)’ that is proposed to be conducted in terms of this
Brochure will govern such admission(s), if any.

GOVERNMENT OF MAHARASHTRA
RULES OF ELGIBILITY FOR MHT-CET 2010 AND FOR ADMISSION TO FIRST
YEAR OF FOUR YEAR FULL TIME DEGREE COURSE IN PHARMACY FOR THE
ACADEMIC YEAR 2010 – 2011

1.0 Introduction

The entrance examination for the selection to all Health Science Courses, Engineering and
Pharmacy degree courses in State of Maharashtra for the academic year 2010-11 shall be
conducted by the Competent Authority appointed by Government of Maharashtra. The Entrance
Test will be held on Thursday, 6th May 2010 at all the district headquarters in State of
Maharashtra.

The Selection Process shall however be separate for degree courses in Health Sciences,
Engineering and Pharmacy. The respective Competent Authorities shall devise the system of
Counseling/Allotment. This procedure shall be governed by the regulations and directions
specified by the Govt. of Maharashtra from time to time.

This brochure gives the rules for the eligibility for appearing to the Maharashtra Health–Technical
Common Entrance Test 2010 i.e. MHT-CET 2010, the eligibility for admission to first year of
Degree course in Pharmacy in the State of Maharashtra and also gives definition of various types
of candidatures. These rules govern only the aspect of the ‘Common Entrance Test’ and the
eligibility of the candidates to appear at this examination.

The rules and information regarding the Distribution of seats under various heads i.e. Home
University, Outside Home University, Institute Level seats, Minority seats, OMS seats etc.; details
of the Reservation of seats, Fees concession offered to eligible candidates, details of the
Centralized Admission Process (CAP), details of the Admission rounds, Institute/course wise
Information etc. shall be provided in a separate Information Brochure which will be made
available to the aspiring candidates at the time of filling up of the option/preference form

1.2. Definitions:
• “State Government” means the Government of Maharashtra.
• “Director” means the Director of Technical Education, Maharashtra State.
• “Application Form” means prescribed form filled up by the candidate for appearing for MHT-
CET 2010.
• “Appeal Committee” means the Committee setup under the chairmanship of the Competent
Authority, it shall deal with the representations submitted by the candidates/parents relating to
grievances of the candidates with regard to MHT-CET-2010 examination and the selection
process.
• “Competent Authority” means the Authority designated or appointed by Government of
Maharashtra to conduct MHT-CET 2010, and declare the results. However, the respective
Competent Authorities will supervise and control the selection process for the admission to Health
Sciences, Engineering and Pharmacy degree courses and act as a chairperson of the Appeal
Committee for representations submitted by the candidates. The Competent Authority will issue
necessary executive instructions for implementation and provide relevant information to be
published or communicated.
• “Divisional Authority” means the Dean/Officer(s) of specified Govt. Medical Colleges who will
be responsible to carryout the directions and instructions of the Competent Authority.
• “Notified Colleges” means the colleges/institutions responsible for distribution of information
brochures and application forms for MHT-CET-2010 examination, receipt of the application forms
from the School/Jr. colleges, collection & distribution of admit cards and mark sheets of MHT-
CET-2010 examination.(Annexure - A)
• “Representative of the Competent Authority” means an officer appointed to assist
Competent Authority for smooth conduct of Admission Process as per the directives of the
Competent Authority.

• “Center in-charge of the District” means the District Collector or the officer(s) authorized by
the District Collector.
• “Sub-Center in-Charge” means the officer in-charge of the High School/College where the
MHT-CET 2010 examination is being conducted.
• “Qualifying examination” means examination on the result of which a candidate becomes
eligible to appear at MHT-CET 2010 entrance examination. i.e. HSC(12th standard) or equivalent
examination
• “College’ or ‘Institution” means Pharmacy College or Technological Institution duly approved
by the AICTE and Government of Maharashtra to impart Education in Pharmacy at degree level.
• “Government Pharmacy College” means the Pharmacy College run by the Government of
Maharashtra.
• “Government Aided Pharmacy College” means Pharmacy College run by private
management but which receives financial assistance from the Government of Maharashtra.
• “University Managed Pharmacy College” means Pharmacy College run by a particular
University.
• “University Department” means a department of University which offers four year degree
course in Pharmacy.
• “Autonomous Institute” means the institute for which autonomy is granted by the Govt. of
Maharashtra.
• “Un-Aided Pharmacy College” means Pharmacy College run by private management on self
financing basis.
• “Sanctioned Intake” means the course wise number of seats sanctioned by the Government
Resolution with reference to the AICTE’s approval.
• “Inter se merit” means the order of merit as defined by Maharashtra State Merit list / Home
University area merit list/OMS Merit list as the case may be.
• “Candidate” means an applicant who is an Indian National and desires to appear for MHT-CET-
2010 with an intention to seek admission to first year of four year Degree Course in Pharmacy in
Maharashtra State by submitting the prescribed application form for the year 2010-11.
• “Defence” means services established under the Army Act 1950 / Air force Act 1950 / Navy Act
1957.
• “Persons of Indian Origin (PIO)”: A Person having foreign citizenship (except Pakistan and
Bangladesh) without “NRI” status, who holds a Foreign Passport at the time of sending
application, consideration for admission and during the period of his/her study, and he/she or any
one/both of his/her parents or any one/both of his/her grand parents is (or was)/are (or were)
citizen(s) of India by virtue of the provisions of the Constitution of India or Sec. 2(b) of
Citizenship Act, 1955 (Act No. 57 of 1955).
• “OMS candidate” means Outside Maharashtra State candidate who is an Indian National.

• “Foreign Nationals” means Citizens of all countries other than India, who are not of Indian
origin as defined under PIO.
• “Foreign Student” means Foreign Student in this context shall be defined as the student who
possesses a foreign passport.
• “CAP Seats” These are the seats for which allotment/admission is carried out by the Competent
Authority through CAP
• “NRI” means Non Resident Indian as per the definition given in the section 6 of the Income Tax
Act 1961.
• “NRI Candidate” means a candidate who is a child/ward of the person who has the ‘NRI status’
as defined under section 6 of the Income Tax Act.

2.0 Eligibility Criteria:

2.1. Eligibility of Maharashtra State Candidate and OMS candidate for appearing for
MHT-CET-2010:

Candidate should be an Indian National and should have passed/appeared* the HSC (Std.XII)
examination of Maharashtra State Board of Secondary and Higher Secondary Education or its
equivalent examination with subjects English, Physics, Chemistry and Biology/Mathematics.

Note:

• *Candidates who have appeared for qualifying examination i.e. HSC (Std. XII) or its equivalent
examination during the academic year 2009-10 and whose results are not declared till the last
date of submission of application form are eligible to appear for MHT-CET-2010, however for
admission to first year of degree course in Pharmacy, such candidates must fulfill the eligibility
criteria as mentioned in rules 2.2 to 2.7 as applicable.

• Maharashtra State candidates (defined as per rule no. 3.1) and OMS candidates (defined as
per rule no. 3.2) are eligible to appear for the MHT-CET- 2010 conducted by the Competent
Authority of Government of Maharashtra for the academic year 2010–2010.

2.2. Eligibility criteria for Maharashtra State Candidate and Outside


Maharashtra State Candidate for admission to first year of degree course in
Pharmacy:

Candidate should be an Indian National and should have passed the HSC (Std.XII) examination of
Maharashtra State Board of Secondary and Higher Secondary Education or its equivalent
examination with subjects English, Physics, Chemistry and Biology/Mathematics AND Secured
minimum 50% marks i.e. not less than 150 marks out of 300 marks (minimum 45% marks

i.e. not less than 135 marks out of 300 marks in case of candidates of Backward class categories
belonging only to Maharashtra State) in the subjects Physics, Chemistry and
Biology/Mathematics added together (Maximum of marks obtained in Biology/Mathematics
shall be considered for the purpose of addition) AND Obtained a non zero score at MHT-CET
2010.

2.3. Eligibility Criteria for Foreign National/Foreign student/ PIO/Children of


Indian workers in the Gulf countries/Children of NRI

Candidate should have passed the HSC (Std.XII) examination of Maharashtra State Board of
Secondary and Higher Secondary Education or its equivalent examination with subjects English,
Physics, Chemistry and Biology/Mathematics and secured minimum 50% marks i.e. not less than
150 marks out of 300 marks in the subjects Physics, Chemistry and Biology/Mathematics added
together (Maximum of marks obtained in Biology/Mathematics shall be considered for the
purpose of addition).

• The eligibility of the candidates passing the HSC (Std. XII) or its equivalent exam.
from a school/college/Examination Board situate outside India shall be further
decided by the University Authorities to which the candidate is admitted. Hence
such candidates are advised to get their eligibility verified by the respective
University Authorities before seeking admission to the Pharmacy degree course in
the State of Maharashtra.

• The candidate belonging to this type Stated in rule 2.3, is not required to appear
for the MHT-CET 2010.

2.4. Eligibility criteria for Candidates who are sons/daughters of Defence


service personnel:

In addition to the basic eligibility criterion mentioned in rule no.2.2, candidates who have
appeared & obtained a non zero score in the MHT-CET 2010 and satisfying any one of the
following criterions are eligible to seek admission against seats for sons/daughters of defence
service personnel.

… Candidate is a son/daughter of ex-service personnel who is domiciled in Maharashtra State (Type


Def-1).
… Candidate is a son/daughter of active service personnel who is domiciled in Maharashtra State
(Type Def-2).

… Candidate is a son/daughter of active service personnel (Type Def-3) –

ƒ Who is transferred to Maharashtra State but is not domiciled in Maharashtra State

ƒ Who is not domiciled in Maharashtra State but his/her family is stationed in Maharashtra
State under the provision of retention of family accommodation at the last duty station
on the grounds of childrens’ education, provided further that, such candidate should have
appeared and passed the HSC (Std.XII) examination of Maharashtra State Board of
Secondary and Higher Secondary Education or its equivalent examination from a
school/college situate in the State of Maharashtra.

Note: This provision is NOT available to the children of CIVILIAN STAFF who is working/ who
has worked in the Indian Defence Service.

2.5. Eligibility criteria for Candidates who are Physically Handicapped:

In addition to the basic qualification mentioned in rule no. 2.2, candidate who has appeared &
obtained a non zero score in the MHT-CET 2010 and suffering from any one of the following
disability is eligible to seek admission against seats for Physically Handicapped candidates
[Maharashtra State candidates of Type A, B and D are only eligible to apply for
admission against these seats]

Candidate who is visually impaired (blind) candidate (P1)

• Candidate who is speech & hearing impaired (deaf & dumb) candidate (P2)

• Candidate who is with orthopedic disorders, learning disabilities, Dyslexia, Dyscalculia,


Dysgraphica, Spastic (P3).

Note: The certificate (proforma F/F-1) should clearly state that the extent of
disability is more than 40% and the disability is permanent in nature.

2.6. Eligibility criteria of Candidates who have passed/passing Diploma in


Pharmacy and seeking admission to First Year of Pharmacy:

Diploma holders who have passed the Diploma course in Pharmacy with minimum of 50% marks
and medium of instruction as English from AICTE approved Polytechnics.

Note:

1. To resolve a tie i.e. more than one candidate securing equal aggregate marks in Final
year of the Diploma exam, following order of preference shall be adopted: marks in
Maths at SSC, Grand Total at SSC.

2. Eligible Diploma candidates shall be considered for Admission against the Institute
level seats in Unaided Private Institutes only. The details of the admission process for
filling seats is specified in annexure.
3. Such Diploma candidates are not eligible to appear for the MHT-CET 2010.

General Notes:

1. In case the maximum marks in individual subject is other than 100, convert the marks out of 100
for individual subject but do not round off these marks. If the sum of the converted marks of
three individual subjects without rounding off works out to be a figure with fraction then fraction
up to two decimal places will only be considered

Example: If a candidate obtains 101 marks out of 200 in Physics, 86 marks out of 150 in
Chemistry and 40 Marks out of 100 in Mathematics, then the sum of marks obtained works out to
be 227 out of 450 marks. If it is converted out of 300, it works out to be 151.33. However if the
marks in individual subjects are converted out of 100, then the marks are as 50.5 in Physics,
57.3333 in Chemistry and 40 in Mathematics. It means the sum of converted marks of individual
subject is 147.8333, which is 147.83 upto two fraction. Hence the candidate is not eligible for
admission under OPEN Category.

2. If letter grades are assigned instead of marks at SSC, HSC or its equivalent examination the
candidate must obtain the certificate of conversion of letter of grades into marks from the
competent authority where from the candidate has passed the examination. The candidate should
produce such certificate at the time of submission of application form. The Eligibility shall be
decided based on the equivalent marks submitted by such candidates.

3. If the candidate reappears for the qualifying examination (Std. XII or its equivalent) with all
subjects then the marks obtained in the latest examination will only be considered for
determining the eligibility criterion.

3.0 Type of Candidature:

3.1 Types of Maharashtra State Candidates and Home Universities:

A candidate is considered eligible for admission to the seats of Maharashtra State coming under the
purview of competent authority subject to fulfillment of any one of the eligibility requirements as
listed in the following table.

Note: Type-D Candidates should produce Certificate in the proforma “B” regarding the

3.2 Outside Maharashtra State candidate:


Type of candidature: Outside OMS candidate should be an Indian national, who is not satisfying
Maharashtra State candidate any of the conditions Stated in Sr. No. 1, 2, 3, 4 (i.e. Type A,B,C,D)
(OMS) of rule 3.1.

Note:
¾ For claiming facility under Type A, B, C, D & E, it is binding for the candidates to produce the
documentary proof along with the application form for CAP to claim the facility.
¾ Candidate can claim only one type of candidature while submitting the application form.
e.g. Candidates who are eligible to apply against the provision of Jammu & Kashmir Migrant
Candidate seats as well as against the Maharashtra State seats are only entitled to claim for
one of these seats.
¾ The candidate should submit the applicable certificate in the necessary proforma at the time of
filling up of Application Form for CAP.

4.0 Assignment of merit number:

4.1 Merit Number for Maharashtra Candidates:

ƒ Each eligible Maharashtra State Candidate (Rule 2.2) who has appeared for MHT-CET 2010 and
obtained a non zero score in MHT-CET 2010 and submitted application form on or before the last
date prescribed for the submission of Application Form for Admission to Pharmacy through CAP
will be assigned a provisional merit number.

ƒ Merit of all eligible Maharashtra State candidates will be based on the MHT-CET 2010 score (out
of 200 marks) only; relative merit in case of a tie (i.e. equal marks in MHT-CET 2010) shall be
resolved as per rule no. 5.1.1.

ƒ OMS candidates should note that, a separate merit list of all eligible OMS candidates (Rule 2.2)
shall be prepared based on the MHT-CET 2010 score (out of 200 marks) only, relative merit in
case of a tie (i.e. equal marks in MHT-CET 2010) shall be resolved as per rule no. 5.1.1.

Note:
1. Merit list of Maharashtra State Candidates so prepared shall indicate a State
level General Merit No., State level Category Merit no. (as applicable), Home
University General Merit No., Home University Category Merit no. (as applicable) etc.
2. Assignment of a Merit number does not indicate or ensure admission to any
seat.

4.2 Relative merit in case of a tie:

In the case of candidates securing equal number of marks in MHT-CET-2010, their relative merit
will be fixed on the basis of the following order of preference:

(a) A candidate securing higher marks out of 10 0 in the subject of Biology/Mathematics (whichever
is maximum) in MHT-CET-2010.

(b) A candidate securing higher marks out of 50 in the subject of Chemistry in MHT-CET-2010.

(c) A candidate passing the SSC (Std. X) examination with higher aggregate marks.

(d) Birth Date of the candidate (Elder Candidate will be given preference)

Note: While converting the marks, if the converted marks work out to be a figure with fraction,
fraction up to two decimal places will only be considered.

4.3 Change of Marks due to verification:

If the marks in the qualifying examination are modified due to verification and the same is duly
certified by the Maharashtra State Board of Secondary and Higher Secondary Education or its
equivalent, the same shall be reported to the ARC incharge immediately.

However the effect of the change will be taken into consideration only for the subsequent
round(s) of admission.

5.0 Reservations

All the reservations given below shall be applicable to candidates belonging to Maharashtra State
only subject to the fulfillment of the eligibility criteria specified by respective authorities from time
to time.

5.1 Reservation for Backward Class category Candidates:

The percentage of seats reserved for candidates of backward class categories belonging to
Maharashtra State is as per the details in table given below. The percentages of reservation are
the percentages of the seats available for Maharashtra candidates, which are coming under the
purview of the Competent Authority. These are the minimum percentages of reservation exclusive
of the backward class candidates securing allotment through General Merit by virtue of merit.
Backward class candidates shall claim the category to which they belong to at the time of
submission of application form for Centralized Admission.

Note:
1. The reservation for backward class candidates shall be available in Unaided Non-Minority colleges
and it will be 50% of MS CAP seats.
2. Reservation for backward class candidate i.e. 50% as stated above shall be available in
Government, Government Aided Institutes, University Dept. and University Managed Institutes.
3. Candidates belonging to Special Backward Class (SBC) will be offered reservation up to 2%
seats of the seats available for Maharashtra candidates which are coming under the purview of
the Competent Authority subject to condition that any seats remain vacant in the reserved
category at the end of stage–I of allotment. These seats are carved out during the allotment
stage-I and no separate seats are earmarked before the start of the allotment process. SBC
Candidates having original category OBC will be considered at par with OBC Candidates.
4. Even if the candidate belonging to Backward Class Category secures admission against a seat
belonging to the General category by virtue of merit, such candidate has to produce all the
necessary documents in support of the category claimed both at the time of admission and while
filling up of the CAP admission form.
5. All OMS candidates are treated as GENERAL/OPEN candidates and are not eligible to claim for any
reservations or provisions.

5.2 Reservation for sons/daughters of Defence service personnel:

Five (5) % seats of the total sanctioned intake for an institute, subject to a maximum of five (5)
seats in each institute coming under CAP shall be reserved for

¾ Children of ex- service personnel who are domiciled in Maharashtra State (DEF-1).
¾ Children of active service personnel who are domiciled in Maharashtra State (DEF-2).
¾ Children of active service personnel (DEF-3) –
ƒ Who are transferred to Maharashtra State but are not domiciled in Maharashtra State,
ƒ Who are not domiciled in Maharashtra State but their families are stationed in Maharashtra
State under the provision of retention of family accommodation at the last duty station on
grounds of children’s education provided further that, such candidate should have appeared

and passed the HSC (Std.XII) examination of Maharashtra State Board of Secondary and
Higher Secondary Education or its equivalent examination from a school/college situate in
the State of Maharashtra.
These seats are within the sanctioned intake capacity and are available as State Level seats. A
combined single merit list of all eligible DEF1, DEF2 & DEF3 candidates shall be prepared.
Admission against the Defence category seats will be made strictly on the basis of inter se merit
of combined single merit list of all eligible DEF1, DEF2 & DEF3 candidates. Refer Pro forma C, D
and E for claiming this provision.

Note:

This provision is NOT available to the children of CIVILIAN STAFF who is working/ who has
worked in the Indian Defence Service.

5.3 Reservation for Physically Handicapped Candidates:

As per the provisions in Clause 39 of Equal Opportunities, Protection of Rights and Full
Participation Act 1995, three (3) per cent seats of total sanctioned intake capacity of all the
institutions coming under CAP shall be reserved for physically handicapped candidates under the
following categories:
ƒ visually impaired (blind) candidates (P1)
ƒ speech & hearing impaired (deaf & dumb) candidates, (P2)
ƒ Orthopedic disorders, learning disabilities, Dyslexia, Dyscalculia, Dysgraphica, Spastic (P3).

Allotment of the seats reserved for the Physically Handicapped candidates shall be
done on the basis of a respective inter-se merit of such candidates. These seats are
available in 70% Home University area seats only for Maharashtra Type - A, B and D.

Note:
It should be noted that the physically handicapped candidates on admission to Pharmacy /
Technology degree course will not be given any exemptions or additional facilities in the academic
activities other than those which may be provided by the respective Universities. Further it is
specifically brought to the notice of Physically Handicapped candidates that, they should submit
the certificates strictly as per the Proforma– F/F-1.

5.4 Reservation for Female candidates:

As per the provisions in Govt. Resolution No.GEC-1000/ (123/2000)/ Tech. Edu.-1, dated 17th
April, 2000, 30% seats available for MS-CAP shall be reserved for female candidates in all the
courses of the institutions coming under CAP. This reservation shall be applicable for General, SC,

ST, DT/VJ (NT-A), NT-B, NT-C, NT-D and OBC categories. Seats reserved for Female candidates
are available under both the 70% Home University seats and 30% Other than Home University
seats coming under the CAP. There shall be no reservation for Female candidates under Defence,
Physically Handicapped and SBC categories.

IMPORTANT: All such candidates who fail to substantiate claims made (such as
reservation category, PH, Defence etc.) with supporting necessary documents shall be
converted to GENERAL category and/or such applications will be rejected as the case
may be. Once such candidates are converted to GENERAL category and they will have
to fulfill the minimum eligibility criteria as set out for a GENERAL category candidate.

6.0 Procedure for Centralized Admission Process (CAP) for the academic year 2010-11:

Major Steps in the CET, Admission through CAP are summarized below:

1. Fill in and Submit Application Form for MHT-CET 2010

2. Appear for the MHT-CET 2010 as per the schedule

3. Declaration of the result of MHT-CET 2010

4. Document Verification, Fill in the Online Application Form for Centralized Admission
to Pharmacy i.e. CAP and Confirm it at the Application form Receipt Centers (ARCs) by
eligible MHT-CET 2010 qualified candidates (in June 2010)

5. Display of Merit List of candidates who have confirmed the online Application Form for
Centralized Admission to Pharmacy on website www.dte.org.in/ph2010. (in July
2010)

6. Fill in and confirm the Online Option Form(s) for CAP Round(s) I/II (by candidates
eligible to participate in these CAP rounds) on the website www.dte.org.in/ph2010. (in
July-August 2010)

7. Display of Allotment(s) of respective CAP Round(s) I/II on the website


www.dte.org.in/ph2010. (in July-August 2010)

8. Reporting to respective Institutes as per allotment of CAP Round(s) I/II (in July–
August 2010)

9. Conduction of CAP Round-III by counseling and Reporting to respective Institute. (in


August 2010)

1. A notification giving details such as schedule, procedure of Centralized Admission will be
displayed on the website and published in leading newspapers. Above mentioned schedule &
procedure shall be taken as a suggestive guideline.

2. In order to participate in the CAP, the aspiring & eligible candidate is required to submit and
confirm the “Application Form for Centralized Admission to Pharmacy” (in June 2010) at the
ARC. The list of documents required to be submitted at the time of confirmation is given in
the Annexure-II. Detailed notification in this regard will be issued in the month of June 2010
after the declaration of result of MHT-CET 2010.

3. OMS candidates who have appeared & passed MHT-CET 2010 are eligible to participate in the
CAP rounds for OMS seats on the basis of score of MHT-CET 2010. Such OMS candidates are
permitted to fill Online Application Form & Online Option Forms of CAP rounds.

4. OMS candidate are also eligible to apply separately for the seats coming under the purview of
the Institute Authorities (Institute Level seats/against CAP vacancies) to be filled by the
respective unaided institute at the institute level. For details read the information brochure
carefully.

5. Details of the eligibility for participating in each round of CAP, method of reporting after each
CAP round, availability of seats for each CAP round and other such details will be given in the
separate Information Brochure.

7.0 Conduct and Discipline

¾ Failure of the candidate in making full and correct Statements in the application form
and/or suppression of any information and/or submission of false documents shall lead to
disqualification of the candidate for MHT-CET 2010 or even at later date during the
Admission Process. Such a candidate will be debarred from the examination as well as the
entire selection process. Therefore the candidate is required to make only such claims which
could be substantiated by relevant original documents.

¾ Adopting any unfair means or engaging in malpractice in the examination shall render a
candidate liable for punishment under, “Maharashtra Prevention of Malpractices Act,
Universities, Board and Other Specified Examination Act, 1982” and disqualify him/her for
MHT-CET-2010 examination.

¾ If any person(s) or officer(s) dealing with the conduct of the MHT-CET-2010 are found
engaged in act(s) that would result in the leakage of question paper or attempt to use or help
in the use of unfair means in this examination he/she shall be liable to prosecution under
Indian Penal Code.

¾ Any issue not dealt here-in above will be dealt with, when arising, fully and finally by the
Competent Authority.

• * The candidates belonging to SC, ST, VJ/DT (NT(A)), NT(B), NT(C), NT(D), OBC and SBC
categories should produce “Caste Validity Certificate” issued by Scrutiny Committee of Social
Welfare Department at the time of submission of CAP application form for the Admission. If the
Candidates are not able to submit the caste/Tribe Validity Certificate then they are required to submit

• @ Non-Creamy Layer Certificate:-
A candidate belonging to ‘Creamy Layer’ amongst the categories VJ/DT-NT(A), NT(B), NT(C), NT(D),
SBC and OBC must note that the provision of reservation is NOT applicable to him/her. A candidate
claiming benefit of reservation under the categories VJ/DT-NT(A), NT(B), NT(C), NT(D), SBC and OBC
above will be required to produce “Non-Creamy Layer Certificate” in the name of the candidate
as specified in the Government Resolution No. CBC-10/2008/C.R.697/BCW-5, dated 27th
February 2009. This certificate should be valid upto 31st March 2011. However, such a Non-
Creamy Layer Certificate shall be produced in any case on or before the last date of filling up of
Application Form for Admission to Pharmacy, failing which the category claim, will not be granted.
• Certificate of the Indian Nationality:-
The certificate of Indian Nationality, which is usually issued by the Tahshildar/Executive
Magistrate/Dy. Collector of the concerned Taluka/District wherein the candidate ordinarily resides. In
lieu of the “Certificate of Indian Nationality” any one of the following certificate will also be
acceptable-
¾ The School leaving Certificate indicating the Nationality of the candidate as ‘Indian’.
¾ Indian Passport in the name of the candidate, issued by appropriate authorities.
¾ Birth Certificate of the Candidate indicating the place of birth in India.
If the Candidate fails to produce any one of the above mentioned certificate/documents indicating
nationality then such candidates Nationality shall be considered based on the undertaking given in
Proforma-I on Rs. 100 Non-Judicial Stamp Paper at the time of submission of CAP application form
for the Admission.

• ** Domicile certificate:
Domicile certificate issued by the Maharashtra State’s appropriate authorities, clearly indicating
domicile by permanent residence will be considered valid. The domicile certificate indicating domicile
“By Choice” or “Education Purposes” or “intends to stay” will not be valid. The domicile certificate of
Mother of the candidate should have been issued after her marriage, such certificate issued before
her marriage will not be valid. In case of mother’s domicile certificate, the candidate shall submit an
affidavit on Rs.100/- stamp paper, stating that the person in whose name the domicile certificate is
issued is the mother of the candidate.
• No documents are needed at the time of filling up of online form for MHT-CET 2010. However no
change in the information once filled is permitted at a later date.
• Candidates are required to keep the documents ready at the time of filling up of “Application Form for
Admission”. (Tentatively scheduled in the month of June 2010)

• Cut off date for the eligibility and/or submission of claim(s):


The eligibility and/or submission of claim(s) of the candidate shall be determined and/or decided for
all purposes including for applicability of all these Rules and Regulations by considering the last date
of submission of “Application form for Admission to Pharmacy” as the cut off date.
It is made abundantly clear that if a candidate is found ineligible and/or fails to produce documents in
support of claim(s) on the last date of submission of Application Form for Admission to Pharmacy, in
terms of these Rules and Regulations, and if such an ineligible candidate acquires the requisite
eligibility and/or produces documents after the aforesaid cut off date, such subsequent acquisition of
eligibility will not make an ineligible candidate eligible for any purpose whatsoever, muchless for the
purpose of admission.

IMPORTANT NOTE: Admission under constitutional reservation seat will be governed by the
Maharashtra Schedule Castes, Scheduled Tribes, Denotified Tribes (Vimukta Jatis), Nomadic Tribes,
Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of)
Caste Certificate Act, 2000 (Mah. Act No.XXIII of 2001) as below:

Para 10: (Benefits secured on the basis of false Caste Certificate to be withdrawn)
(1) Whoever not being a person belonging to any of the Scheduled Castes, Scheduled Tribes,
Denotified Tribes, De-notified tribes, (Vimukta Jatis), Nomadic Tribes, Other Backward Classes or
Special Backward Category secures admission in any educational institution against a seat reserved
for such Castes, Tribes or Classes, or secures any appointment in the Government, local authority or
in any other company of Corporation, owned or controlled by the Government or in any Government
aided institution or Co-Operative Society against a post reserved for such Castes, Tribes or Classes by
producing a false Caste Certificate shall, on cancellation of the Caste Certificate by the Scrutiny
Committee, be liable to be debarred from the concerned educational institution, or as the case may
be, discharged from the said employment forthwith and any other benefits enjoyed or derived by
virtue of such admission or appointment by such person as aforesaid shall be withdrawn forthwith.
(2) Any amount paid to such person by the Government or any other agency by way of scholarship,
grant, allowance or other financial benefit shall be recovered from such person as an arrears of land
revenue.
(3) Notwithstanding anything contained in any Act for the time being in force, any Degree, Diploma
or any other educational qualification acquired by such person after securing admission in any
educational institution on the basis of a Caste Certificate which is subsequently proved to be false
shall also stand cancelled, on cancellation of such Caste Certificate, by the Scrutiny Committee.
(4) Notwithstanding anything contained in any law for the time being in force, a person shall be
disqualified for being a member of any statutory body if he has contested the election for local
authority, Co-operative Society or any statutory body on the seat reserved for any of Scheduled
Castes, Scheduled Tribes, De-notified Tribes, (Vimukt jatis), Nomadic Tribes, Other Backward Classes
or Special Backward Category by procuring a false Caste Certificate as belonging to such Caste, Tribe
or Class on such false Caste Certificate being cancelled by the Scrutiny Committee; and any benefits
obtained by such person shall be recoverable as arrears of land revenue and the election of such
person shall be deemed to have been terminated retrospectively.

Para 11: (Offences & Penalties)


(1) Whoever,-
(a) Obtains a false Caste Certificate by furnishing false information or filing false statements or
documents or any other fraudulent means ; or
(b) not being a person belonging to any of the Scheduled Tribes, De-notified Tribes, (Vimukt jatis),
Nomadic Tribes, Other Backward Classes or Special Backward Category secures any benefits or
appointment exclusively reserved for such Castes, Tribes or Classes in the Government, local
authority or any other company or corporation owned or controlled by the Government or in any
Government aided institution, or secures admission in any educational institution against a seat
exclusively reserved for such Castes, Tribes or Classes or is elected to any of the elective offices of
local authority or Co-operative Society against the office, reserved for such Castes, Tribes of
Classes by producing a false Caste Certificate; shall, on conviction, be punished , with rigorous
imprisonment for a term which shall not be less than six months but which may extent up to two
years or with fine which shall not be less than two thousand rupees, but which may extend up to

(2) No court shall take cognizance of an offence punishable under this section except upon a
complaint, in writing, made by the scrutiny Committee or by any other officer duly authorized by
the Scrutiny Committee for this purpose.

Para 12: (Offences under Act to be cognizable & nonbailable)


Notwithstanding anything contained in the Code of Criminal Procedure; 1973 -
(a) offence punishable under section 11 shall be cognizable and non-bailable;
(b) every offence punishable under this Act, shall be tried by any Magistrate of First Class in a
summery way and provisions of sections 262except sub-section(2) to 265 both inclusive of this
Code shall as for as possible may be applied to such trial.

Para 13: (Penalty for issuing false Caste Certificate)


(1) Any person or authority performing the functions of Competent Authority under this act, who
intentionally issues of false Caste Certificate shall earn conviction, be punished with rigorous
imprisonment for a term which shall not be less than six months but which may extend up to two
years or with fine which shall not be less than two thousand rupees, but which may extend up to
twenty thousand rupees or both.
(2) No court shall take cognizance of an offence punishable under this section except with the
previous sanction of the Government.

Para 14: (Penalty for abatement)


Whoever abets any offence punishable under this Act shall be punished with the punishment
provided for in this Act for such offence.

SCHEME OF MHT-CET 2010 EXAMINATION


• Date of Examination: The examination will be conducted at various centers in Maharashtra on
Thursday, 6th May 2010
• Schedule & Test Design: The MHT-CET 2010 will consist of three question papers. Each paper is
of 100 marks.
• Paper I : Physics & Chemistry (50 marks each)
• Paper II : Biology (Botany & Zoology - 50 marks each)
• Paper III: Mathematics (100 Marks)
• There is no choice among the questions, i.e. all questions have to be answered. The candidate
desirous of selection to Health Science courses and BVSc & AH should appear for Paper I & Paper
II. The candidate desirous of selection to Engineering degree courses should appear for Paper I
and Paper III and the candidate desirous of selection to Pharmacy degree course should appear for
Paper I & Paper-II and/or Paper-III. Those Candidates appearing only for Paper I and Paper II will
be provided with one single OMR answer sheet for both papers: those appearing only for Paper I
and Paper III will be given separate OMR answer sheets with each question paper and those
candidates appearing for all the three papers will be given one single OMR answer sheet for Paper I
& Paper II and a separate OMR answer sheet for Paper III. At the end of paper/session student will
handover the OMR Answer sheet and Question booklet to the invigilator.
• The candidate will be required to mark the correct answer by blackening the corresponding circle
against the serial number of the question in the answer sheet with black ink ballpoint pen only.
Out of four circles provided for selection of an answer against a question, the candidate should fill
up one circle only. Each correct answer will be given mark/(s). There shall be no negative marking
for wrong answers.
• CHANGING AN ANSWER IS NOT ALLOWED: The candidates must fully satisfy themselves
about the accuracy of the answer before darkening the appropriate circle, as no change in the
Answer once marked is allowed. The answer once marked is final; any change in the option once
marked, done by any method, will amount to an invalid/incorrect response.
• Scratching, overwriting, tick mark and multiple answers will be considered as wrong
answers and no marks will be allotted to them.
• Syllabus of Examination: Syllabi of Physics, Chemistry, Biology and Mathematics for the MHT-
CET 2010 will be the same as for the current year for HSC Examination (i.e. March 2010) of HSC
Boards of Maharashtra.
• Time & duration of Examination: There will be three papers of one and half hours each.
Schedule of examination is given on backside of index page.
• Language of Question Paper: The medium for examination shall be English or Marathi or Urdu
for Physics, Chemistry and Biology. However, Mathematics paper shall be in English only. The
option once exercised about the medium by the candidate shall be irrevocable.
• Examination Centre: The MHT-CET 2010 will be conducted at all the district headquarters of the
State of Maharashtra. The MHT-CET examination center will be within the same district from where
the candidate has passed / is appearing at the qualifying examination i.e. HSC/12th Standard
examination. For the eligible candidates passing qualifying examination from outside the state of
Maharashtra, the Competent Authority shall allot the examination center. The centre of examination
for candidates who have passed their HSC (12th Std) or equivalent examination from an institution
situated outside the state of Maharashtra (Candidates eligible under Rule 2.1 and Rule 2.2 of this
Brochure and Type B, Type C, Type D and Type E of Engineering and Pharmacy Brochures) shall
be the district/headquarter of the Divisional Authority where he/she has submitted MHT-CET 2010
Application Form. The center once allotted by the Competent Authority shall not be
changed under any circumstances.

SALE OF APPLICATION FORM, INFORMATION BROCHURES, ADMIT CARD RESULT OF MHT-


CET 2010 etc.:

• Mode of Sale:
A single Application form and three information Brochures for MHT-CET 2010 (Health Science,
Engineering and Pharmacy) will be available at Junior College/High School where student has studied
for HSC (12th Std examination). Prescribed application forms as per the requirement shall be obtained
by Head Master/Principal of the college from the Principal/Dean of the notified college in the district
as shown in Annexure-A. The cost of application form along with the Information Brochures of
MHT-CET 2010 and the Examination fee is Rs.700/- for open category, and Rs.500/- for
reserve category candidate. This amount is not refundable. The School/Junior College should
submit two separate demand drafts / pay orders, one for open category candidates, another for
reserve category candidates drawn in favour of “Competent Authority (MH-CET), Mumbai,” on
any scheduled commercial Bank, payable at Mumbai, to the Notified College while collecting
application forms. Duly filled application form should be submitted by the candidate to the same
Junior College/School, from where he/she has passed / appearing for HSC or equivalent examination,
on or before the prescribed date.
All the Defence category candidates who are appearing/have appeared for qualifying examination
(HSC or equivalent) from outside Maharashtra State and are otherwise eligible as per the rules to
appear at MHT-CET 2010, should obtain the brochures and application form on payment of fee of
Rs.700/- by Demand Draft/Pay order drawn on any scheduled commercial Bank in favour of
‘Competent Authority, MH-CET, Mumbai’ payable at Mumbai, from respective Divisional
Authorities.
• Instructions for filling and submission of application form (refer Annexure “M”):
The application form must be filled by the candidate in his/her own handwriting using black ink ball
point pen. Filling up of application form by the candidate shall be done under active guidance of the
Principal or teacher authorized by the Institution. The application should be submitted by the
candidate on or before the prescribed date, to the Principal of concerned Jr. College/ High school.
The application forms complete in all respects shall be submitted by the Principal of School/Junior
College to the Dean / Principal of the notified College of the concerned District as shown in
‘Annexure-A’ on or before the last date prescribed for the same.
It will be responsibility of the Head Master/Principal of High School/Junior College to verify and certify
that the information provided in the application form by the candidate is correct.
For Candidates who have passed HSC or Equivalent exam from outside Maharashtra, the place of
submission of application form, receiving of Receipt cum Identity card, Admit Card and Mark sheet
shall be as given in the following table.

• All the Outside Maharashtra State (OMS) candidates mentioned in above table should show relevant

claimed the same in the original application form of MHT-CET 2010, failing which the claim will not be

• Incorrect/incomplete Application Form will be rejected.
• Application forms sent by post/courier will be rejected.
• A Candidate shall submit only one and only one Application Form. In case, the candidate submits
more than one application form, he/she shall be disqualified.
• MHT-CET- 2010 Admit Card & Receipt-cum-Identity Card: The Principal/Head of the institute
where the application form is submitted shall issue Receipt-cum-Identity card attesting the
photograph of the candidate with his/her signature and stamp. The candidate must preserve the
Receipt-cum-Identity-card and must bring it at the time of MHT-CET 2010 examination as well as at
the time of filling up of the preference form and admission.
• The Admit Cards for the MHT-CET 2010 will be distributed by the Principal/Head of the institute
where the Application form was submitted. In case the candidate does not receive Admit Card on or
before the prescribed date (or if he/she has lost his/her admit card), he/she should approach the
Center Incharge of the district with the original Receipt cum Identity Card for getting a Duplicate
Admit Card. Please note that the issue of Admit Card is just an enabling provision for appearing at
MHT-CET and does not imply that the candidate is eligible for admission.
• Bonafide certificate / Affidavit stating Gap in the Education (Not required for the candidates appearing
for H.S.C. or equivalent examination in March 2010):-
1. Bonafide Certificate:- This is for those candidates who have passed HSC/12th Standard in
March 2009 or before and presently studying in a course/institution not affiliated to Maharashtra
University of Health Science, Nashik. (to be issued by the concerned institution).
2. Affidavit (Gap Certificate):- This is for those candidates who have passed HSC/12th Standard
in March 2009 or before and presently not studying in any course/institution.
REVALUATION OF HSC OR EQUIVALENT EXAMINATION MARKS
• If the marks of a candidate at HSC (or equivalent) examination have been revised on revaluation,
the eligibility of the candidate may be altered. The candidate will be permitted to avail the benefit
of revised marks upto the last date of filling up of option Form, subject to his/her representation

to that effect to the Competent Authority and production of necessary proof to the satisfaction of
the latter. However the benefit of revised marks will be effected from the date of permission by
the Competent Authority.
DECLARATION OF RESULT
• The Competent Authority will conduct the examination, evaluate the answer sheets and declare
the result. The result will be declared on websites of DMER i.e. www.dmer.org and DTE i.e.
www.dte.org.in on or before 14/6/2010.
• All the candidates who have appeared for MHT-CET 2010 will receive their mark sheet from the
office of the Principal of their Jr. College/High School, who in turn shall collect the same from the
Dean/Principal of notified college of the district. The candidates, who have submitted their
application form directly to Divisional Authorities, will collect the mark sheet from the same office.
• In case of loss of original MHT-CET 2010 mark sheet, a duplicate mark sheet can be obtained
with a application addressed to the Competent Authority along with a demand draft/pay order
drawn on any scheduled commercial bank of Rs.100/-, in favour of ‘Competent Authority, MH-
CET, Mumbai’ payable at Mumbai.
• Verification of Marks Obtained at MHT-CET 2010:
• If the candidate desires to get his/her Answer sheet evaluation verified, an application in
prescribed proforma (Annexure ‘L’), along with self addressed unstamped envelope (9”X 4.5”)
should be submitted to any Divisional authority, within 4 days of declaration of the result of MHT-
CET 2010, along with Demand Draft/Pay Order of Rs.500/- (Rs.Five Hundred only) drawn on any
scheduled commercial bank in favour of “Competent Authority, MH-CET, Mumbai”, payable at
Mumbai.
• The candidate will be sent photocopy of the Answer sheet and model answer key, after due
verification by the Competent Authority through registered post.
• Representations received after the specified period will not be entertained. The change if any,
shall be communicated to the candidate. The decision of the Competent Authority in this matter
shall be final and binding.
• The Rules and Regulation/procedure stated herein is applicable for MHT-CET 2010 examination
and selection for the academic year 2010-11. No promise is implied herein for the subsequent
years and no expectation should be based on this for future.

Legal jurisdiction: All disputes pertaining to the conduct of examination and selection shall fall within
the jurisdiction of Courts, at Mumbai only. The Competent Authority shall be the legal person in whose
name the Government of Maharashtra may sue or may be sued.

Instructions to Candidates
1. This question booklet contains 100 Objective Type Questions in the subjects of Physics (50) &
Chemistry (50).
2. The question paper and OMR (Optical Mark Reader) Answer Sheet is issued separately at the start of
the examination.
3. Section ‘A’ contains 50 questions in the subject of Physics, Section ‘B’ contains 50 Questions in the
subject of Chemistry.
4. Choice and sequence for attempting questions will be as per the convenience of the candidate.
5. Candidate should carefully read the instructions printed on the Question Booklet and Answer Sheet
and make the correct entries on the Answer Sheet. As Answer Sheets are designed to suit the
OPTICAL MARK READER (OMR) SYSTEM, special care should be taken to mark the entries correctly.
Special care should be taken to fill QUESTION BOOKLET VERSION, SERIAL No. and MHT-CET Roll
No. accurately. The correctness of entries has to be cross-checked by the invigilators. The candidate
must sign on the Answer Sheet and Question Booklet.
6. Read each question carefully.
7. Determine the correct answer from out of the four available options given for each question.
8. Fill the appropriate circle completely like this •, for answering a particular question. Mark with Black
ink ball point pen only.
9. Each answer with correct response shall be awarded one (1) mark. There is no Negative Marking.
No mark shall be awarded for marking two or more answers of same question, scratching
or overwriting.
10. Use of whitener or any other material to erase/hide the circle once filled is not permitted.
11. Avoid overwriting and/or striking of answers once marked.
12. Rough work should be done only on the blank space provided on the Question Booklet. Rough work
should not be done on the Answer Sheet.
13. The required mathematical tables (Log etc.) will be provided along with the question booklet.
14. Immediately after the prescribed examination time is over, the Question Booklet and Answer sheet is

Important Instructions - How to Mark In The ‘OMR Answersheet’

1. Use only BLACK ink ball point pen to darken/mark the appropriate circle.
2. Mark should be dark and should completely fill the circle.
3. Mark/darken only one circle for each entry. The answer once marked is final, any change in the
option once marked, done by any method, will amount to a invalid/incorrect response.
4. A lightly/faintly marked/darkened circle may also be treated as a incorrect/wrong
method of marking and may not be read by the Optical Scanner.
5. Marking should only be done in the space provided.
6. Please do not fold the answer sheet and do not make any stray marks on it.

Marking of Responses:-
There will be four answer options for each question. The candidate will indicate his/her response to the
question by darkening the appropriate circle completely with BLACK ink ball point pen.

For example Question No.152 in the Question Paper reads as follows:-
