PROPOSAL OF PROTOCOL FOR THE EXPORTATION OF AVOCADO

(Persea americana P. Mill.)FRUITS VARIETY 'Hass' FROM PERU TO


JAPAN (Draft Prepared by Japanese Side)

1. BACKGROUND
Servicio Nacional de Sanidad Agraria (SENASA-Peru) requested the
exportation of ‘Hass’ avocados from Peru to Japan.

According to the study on "Status of ‘Hass’ avocado (Persea americana) as


non-host of Ceratitis capitata,Anastrepha fraterculus and Anastrepha
striata (Diptera: Tephritidae) in Peru", the ‘Hass’ avocado is, a conditional,
non-host of the mentioned fruit flies.

In the case of A.striata, the 'Hass' avocado is a natural non-host.

Based on the request by SENASA, the Japan Plant Protection


Organization (Ministry of Agriculture, Forestry and Fisheries: MAFF)
stated that compliance with the following conditions should be ensured
when removing the ban on the import of Peruvian 'Hass' avocados.
- Only fruits of the ‘Hass’ avocado shall be exported to Japan
- Overripe fruits shall not be mixed in the lots to be exported

As the result of the consultations between SENASA and MAFF on the


phytosanitary measures required for compliance with the
above-mentioned conditions, the relevant regulations such as Standards
Concerning ‘Hass’ Avocados Imported Directly from Peru Specified by the
Minister of Agriculture, Forestry and Fisheries (Public notice of Ministry
of Agriculture, Forestry and Fisheries No. X of X X, 20XX) (Tentative)
were prepared.
Those regulations enabled ‘Hass’ avocado fruits to be exported from Peru
to Japan.

2.OBJECTIVE
Based on the agreement between Plant Protection Organization in Peru

and Japan (hereinafter referred to as the Agreement), this Protocol aims
at ensuring the proper implementation of the exportation of ‘Hass’ avocado
fruits from Peru to Japan through clarifying the related operations and
procedures.

3.PESTS
- Ceratitis capitata
- Anastrepha fraterculus
- Other quarantine pests regulated by MAFF

4.PARTICIPATING ORGANISATIONS
- Plant Health Division, Ministry of Agriculture of Peru (SENASA)
- Place of production and packing houses which are approved and
registered by SENASA, and exporters engaged in export to Japan
- Ministry of Agriculture, Forestry and Fisheries of Japan (MAFF)

5.RESPONSIBILITIES
5.1 SENASA
5.1.1 To coordinate, perform and supervise all the activities specified
in this Protocol. To report to MAFF without delay and discuss
the matter, in the case of detecting a serious problem related to
the activities in the places of production and packing houses and
the activity conducted by SENASA officers.
5.1.2 To ensure that SENASA officers who work in the exportation
program are properly trained and supervised.
5.1.3 To approve, register, and report to MAFF all the places of
production and packing houses that comply with the Protocol
and that are eligible to export to Japan.
5.1.4 Before the start of the exportation season, or if there is any
change, to provide MAFF with the information on the approved
and registered places of production and packing houses,
including their registration codes.
5.1.5 To inspect whether the approved places of production and

packing houses observe this protocol.
5.1.6 To suspend or cancel the approval of any place of production or
packing house which does not comply with the protocol, until
SENASA conducts an investigation and proper measures for
improvement.
5.1.7 To conduct export inspections and verify the labeling and
packing condition.
5.1.8 To keep records of information related to the exportation
program conducted in the places of production and packing
houses and information related to the export inspection, and
report to MAFF as requested until at least the end of the next
exportation season.
5.1.9 To request MAFF to dispatch a MAFF plant protection officer
who verifies export inspection and other inspections. In that
case, the cost of dispatching the MAFF plant protection officer
shall be borne by the Peruvian side; the working environment of
the MAFF plant protection officer shall be properly prepared;
cooperation with the operations conducted by the MAFF plant
protection officer shall be ensured.

5.2 PLACES OF PRODUCTION AND PACKING HOUSES APPROVED


AND REGISTERED BY SENASA AND EXPORTERS ENGAGED IN
EXPORT TO JAPAN
To comply with the Protocol and the guidance and directions of
SENASA and properly perform the activities related to the
exportation of ‘Hass’ avocados from Peru to Japan. And to keep the
persons engaged in the export operations to Japan informed about
the Protocol.

5.3 MAFF
To verify whether the exportation to Japan of 'Hass' avocados
complies with the Protocol through the report from SENASA,
inspection by the plant protection officer of Japanese side, and
import inspection. If any problem is detected, necessary measures
shall be taken in accordance with Plant Protection Act and relevant
regulations.

6.PHYTOSANITARY MEASURES
6.1 REGISTRATION OF PLACES OF PRODUCTION AND PACKING
HOUSES
6.1.1 Places of production and packing houses should be approved and
registered by SENASA in accordance with MAFF and SENASA
regulations in order to participate in the exportation season of
‘Hass’ avocados to Japan. (The places of production and packing
houses approved and registered by SENASA are hereinafter
referred to as the Certified Places of Production and Certified
Packing Houses.)
6.1.2 For certification of the places of production or packing house,
SENASA shall keep places of production and packing houses
informed about the contents of the Protocol; shall make
preliminary requests to packing houses to submit drawings of
the facility and photographs that show the condition of the
measures taken to prevent the entry of fruit flies.SENASA shall
examine whether the condition meets the conditions in
accordance with ANNEX 1, and inspect the current condition of
the facilities.

[Requirements for Certified Packing Houses]


- Screens with mesh no bigger than 1.6 mm in diameter shall be
taken in the opening areas such as windows, doorways of the
packing house, and doorways of packing operation area in
order to prevent the entry of pests.

The loading dock that loads 'Hass' avocado fruits shall have a
tight system of sealing, screening or any other system that
prevents the entry of pests into the lot during the loading.
Packing houses should be equipped with lights and inspection
tables in order to maximize performance of the export inspections
by SENASA officers.
6.1.3 Places of production and packing houses should be kept in a
condition that meets the Agreement before the certification and

during the season of exportation to Japan.
6.1.4 SENASA shall cancel the certification of the Certified Places of
Production and Certified Packing Houses, if the Certified Places
of Production and Certified Packing Houses do not comply with
the Protocol and SENASA concludes that they are inadequate
for participating in the exportation program of 'Hass' avocados
to Japan.
6.1.5 SENASA shall report the information on the Certified Places of
Production and Certified Packing Houses to MAFF at least a
month before the start of the exportation season. In reporting to
MAFF, SENASA shall submit ANNEX 2, ANNEX 3, ANNEX 1 of
every packing house, and the drawings and other information
submitted by the packing houses for the certification.
6.1.6 If SENASA certifies a new place of production or packing house
after the start of the exportation season, SENASA shall report
the fact to MAFF each time with necessary information in
accordance with Article 6.1.5.
6.1.7 MAFF verifies the contents of the report and reports the result
to SENASA. MAFF could request improvement in the Certified
Packing House on this occasion. In that case, SENASA shall
instruct the packing house to improve the condition, and report
to MAFF after verifying the result. SENASA shall not approve
the use of the Certified Packing House until MAFF responds to
SENASA.

6.2 MEASURES RELATED TO THE CERTIFIED PLACES OF


PRODUCTION
6.2.1 Fruits fallen from the tree should be removed by the producer at
least once a week from at least a week before the exportation to
Japan. The fallen fruits should not be exported to Japan.
6.2.2 ‘Hass’ avocados shall be harvested and managed so as not be
mixed with other varieties.
6.2.3 ‘Hass’ avocados shall be managed so as not to be mixed with
‘Hass’ avocados from other Certificated Places of Production
even though they are produced in a Certificated Place of
Production.

6.2.4 ‘Hass’ avocados from non-certified places of production shall not
be mixed with ‘Hass’ avocados from the Certified Places of
Production. SENASA shall reject such fruits and cancel the
qualification of the place of production that mixed the ‘Hass’
avocados for the exportation for the rest of the season.
6.2.5 The harvested ‘Hass’ avocados shall be placed in trays marked
with the registration code of the place of production, which
ensures the traceability of the products throughout the whole
process from the production to the exportation.
6.2.6 Harvested fruits of ‘Hass’ avocados should be transported to the
Certified Packing Houses within three hours of harvest. If this is
not done, the fruits should be protected with an insect-proof
screen or tarpaulin until transported to the Certified Packing
Houses.
6.2.7 Harvested ‘Hass’ avocados shall be transported in trays or boxes
with the registration code of the place of production and the
Producer Waybill. The starting date and time of the harvest and
the date and time of transportation to the Certified Packing
House shall be clarified.
6.2.8 Harvested ‘Hass’ avocados should be protected with insect-proof
screens or tarpaulins during the transportation from the
Certified Place of Production to the Certified Packing Houses.
6.2.9 The record of the situation of the removal of fallen fruits,
situation of harvest (the date of harvest, starting date of harvest,
and amount of crop), and situation of transportation to the
Certified Packing Houses shall be kept.
6.2.10 SENASA shall examine the Certified Places of Production at
least once a month during the harvest period to verify the
condition of the removal of fallen fruits and the condition of the
record kept by the Certified Place of Production. SENASA shall
record the result of the examination concerning the Certified
Place of Production based on ANNEX 4 and maintain the record.
If any of the requirements are not met, the ‘Hass’ avocado fruits
produced in the Certified Place of Production in question shall
not be exported to Japan.

6.3 MEASURES RELATED TO THE CERTIFIED PACKING HOUSES
6.3.1 Verification Before the Start of the Operations in the Certified
Packing Houses
6.3.1.1 The operations in the Certified Packing Houses (including
the receipt of ‘Hass’ avocados transported from the Certified
Places of Production) should be performed under the
supervision of the SENASA officer.
6.3.1.2 SENASA shall verify in accordance with ANNEX 5 whether
the condition of the transported ‘Hass’ avocados and the
condition of the Certified Packing Houses meet the following
requirements. If SENASA concludes that there is no
problem, SENASA shall approve the start of the operation.

Harvested ‘Hass’ avocados were transported to the Certified
Packing Houses within three hours of harvest. If this is not
done, the fruits were protected with an insect-proof screen or
tarpaulin until transported to the Certified Packing Houses.

[Condition of Packing Houses]


- Measures to prevent the entry of pests shall be taken in
openings such as doorways and windows of packing houses,
e.g. fitting screens with mesh no bigger than 1.6mm in
diameter. The loading dock that loads ‘Hass’ avocados shall
have a tight system of sealing, screening or any other system
that prevents the entry of pests into the container during
loading.
- The packing house shall be cleaned, and shall be sterilized as
required, if any operation related to any other kind of fruits is
conducted before the operations related to ‘Hass’ avocados to
be exported to Japan.
- Any fruit that does not meet the phytosanitary requirements
of Japan shall not be received or processed while the ‘Hass’
avocados to be exported to Japan are processed.

- ‘Hass’ Avocado fruits shall be packed in new boxes made of
materials that prevent the entry of fruit flies.In the case of
opening a vent hole in the box, one of the following measures
should be taken.
· ‘Hass’ Avocado fruits shall be wrapped in the packing
material before the ‘Hass’ avocado fruits are packed. (In
case there are any vent holes in the packing material, it
should be no bigger than 1.6mm in diameter.)
· Screen with mesh no bigger than 1.6mm shall be put on a
vent hole of the box.
· The whole bundled boxes shall be wrapped in screen with
mesh no bigger than 1.6mm.

6.3.2 IMPLEMENTATION OF PACKING


Considering the following items (items mentioned in ANNEX 5),
SENASA shall verify the operations related to the fruits of ‘Hass’
avocados to be exported to Japan conducted in the Certified
Packing House, and ensure there is no avocado fruit other than
the ‘Hass’ variety or avocado fruit suspected to be overripe(turn
black or soften,hereafter the same). If any of the items does not
meet the requirements, any ‘Hass’ avocados packed in the
packing house in question cannot be
exported to Japan.

- Fruits before being packed shall be stored in the place where a


certain measures are taken to prevent contamination by fruit
flies.
- Measures for preventing the entry of fruit flies are maintained in
any opening that leads to the outside while packing operations
are conducted.
- All plant residuals shall be excluded from the 'Hass' avocados
before being packed. And fruits that are suspected to be overripe,
which start to turn black or soften shall also be excluded.
- The fruits shall be packed in packing materials that are verified
before the start of packaging operations.
- ‘Hass’ avocados from other Certified Places of Production shall

not be mixed and processed together.
- The fruits excluded in the packing houses shall be removed daily
at the end of the process. The excluded fruits shall be protected
with items such as insect-proof screens while they are in the
packing house.
- The operations related to ‘Hass’ avocados that transported from
the Certified Place of Production shall be completed within 24
hours after the start of harvest.
- ‘Hass’ avocados packed at the Certified Packing Houses but not
yet inspected shall not be stored in the same chamber with ‘Hass’
avocados inspected by SENASA and revealed to be free from any
pest.

6.3.3 LABELING AND SEALING OF BOXES


6.3.3.1 Properly processed boxes or bundled boxes should be sealed
by SENASA. The boxes or bundled boxes shall bear a label
stating their destination, Japan. In the label, the following
texts shall be written. The label should be made in a
recognizable size and placed where it can be easily seen.

Note: We would like the Peruvian side to propose a label in


accordance with Article 6.3.3.1.
6.3.3.2 The boxes or lots shall bear a label stating the information
including the department (political division) of place of
origin and registration code of the place of production and
packing house, with the aim of facilitating and ensuring the
traceability of the exported ‘Hass’ avocados.

7. EXPORT INSPECTION
7.1 Points to Be Checked Before Export Inspection
In accordance with ANNEX 6, SENASA shall verify that the
condition meets the following requirements before the export
inspection.

- Measures shall be taken to prevent the entry of fruit flies.
- There shall be no fruit other than ‘Hass’ avocados to be exported
to Japan.
- If the export inspection of some lots has been completed, the
inspected lots shall be stored separately from those not yet
inspected in a visible manner.

[Information Related to the inspection lots]


- Based on ANNEX 4 and 5 and other documents related to the lots
targeted for inspection, the lots targeted for inspection shall have
been transported from the Certified Place of Productions and
been packed properly in the Certified Packing Houses.

SENASA shall have exporters submit the following information and


fill in the information of every lot targeted for the export inspection
on ANNEX 6.
- Name of Loading Vessel (craft)
- Export Port
- Date of Export
- Exporter
- Import Port (in Japan)
- Importer (in Japan)
- In case the ‘Hass’ avocados that are harvested in the same day in
a Certificated Place of Production and transported to a Certified
Packing Houses are divided into more than one lot, the
information on other lots is required.

7.2 IMPLEMENTATION OF EXPORT INSPECTION


7.2.1 Inspection Methods
SENASA shall pick out approximately 5% or more of the number
of the boxes in the lots targeted for export inspection (the boxes
shall be picked out according to the following). All fruits in the
picked-out boxes shall be verified visually and the following
items shall be verified: there is no other fruit than ‘Hass’

avocados; no fruit is suspected to be overripe (hardness shall be
verified as necessary, and also verify that no fruit is softened); no
fruit fly is attached; there is no sign of a fruit fly egg. SENASA
shall also cut open the number indicated in the list below of the
fruits to examine internally and verify no fruit fly is parasitic in
the fruits.

SENASA shall, through the microwave drying process, verify


that the percentage of dry matter of the 'Hass' avocados that are
cut open to examine internally is between 21 and 29%.

7.2.2 MEASURES TO BE TAKEN IN CASE FRUIT FLIES ARE


DETECTED AS THE RESULT OF THE INSPECTION
In case a live or dead larva or an egg of fruit flies is detected as
the result of the inspection, SENASA shall report to MAFF that
they detected fruit flies from 'Hass' avocados, shall suspend the
export inspection and the issue of phytosanitary certificate
related to all the lots, and shall conduct an inspection to identify
the detected fruit flies.

7.2.2.1 IN CASE THE DETECTED FRUIT FLIES ARE


CERATITIS CAPITATA OR ANASTREPHA
FRATERCULUS
SENASA shall report the fact that Ceratitis capitata or
Anastrepha fraterculus were detected to MAFF, and shall
examine the reasons why the fruit flies were detected, and
shall discuss the measures to be taken with MAFF. SENASA
shall suspend export inspections and the issue of

phytosanitary certificates related to all 'Hass' avocados to be
exported to Japan until MAFF reache an agreement
regarding the measures to be taken.

7.2.2.2 IN CASE THE DETECTED FRUIT FLIES ARE NOT


CERATITIS CAPITATA OR ANASTREPHA
FRATERCULUS
SENASA shall report the fact that the detected fruit flies
were not Ceratitis capitata or Anastrepha fraterculus to
MAFF, and shall resume export inspections and the issue of
phytosanitary certificates related to all 'Hass' avocados to be
exported to Japan. The lot where the fruit flies regulated by
MAFF were detected cannot be exported to Japan.

7.2.3 IN CASE QUARANTINE PESTS REGULATED BY MAFF


OTHER THAN FRUIT FLIES ARE DETECTED AS THE
RESULT OF THE INSPECTION
In case any quarantine pest other than fruit flies is detected, a
viability assay shall be conducted in an appropriate way
according to its species and stages. In case the quarantine pest is
alive, SENASA should not approve the exportation of the lot in
question to Japan.

7.2.4 MEASURES TO BE TAKEN IN CASE ANY FRUIT OTHER


THAN 'HASS' AVOCADO OR ANY FRUIT SUSPECTED TO BE
OVERRIPE IS DETECTED AS THE RESULT OF THE
INSPECTION
SENASA shall report the fact that any fruits other than 'Hass'
avocados or any fruit suspected to be overripe are detected to
MAFF, and shall examine the reasons why the fruits in question
was detected, and shall discuss the measures to be taken with
MAFF. SENASA shall suspend export inspections and the issue
of phytosanitary certificates related to the 'Hass' avocados to be
exported to Japan until MAFF reach an agreement regarding the
measures to be taken.

7.2.5 LABEL STATING THE COMPLETION OF THE
PHYTOSANITARY INSPECTION
Regarding the lots that went through export inspection, SENASA
shall label the boxes or bundled boxes to state that the export
inspection is completed. (Or, SENASA shall give exporters
permission to label the boxes under the supervision of SENASA.)

In the label, the following texts shall be written. The label should
be made in a recognizable size and placed where it can be easily
seen.

Note: We would like Peruvian side to propose a label in accordance


with Article 7.2.5.

7.2.6 ISSUE OF PHYTOSANITARY CERTIFICATE


7.2.6.1 SENASA shall issue phytosanitary certificate with the
following additional declaration to each lot that is verified,
as the result of the export inspection, to be free from
Ceratitis capitata, Anastrepha fraterculus, and other
quarantine pests regulated by MAFF
"SENASA has verified that the ‘Hass’ avocados contained in
this lot are produced in the Certified Place of Production
(the registration code of the Certified Place of Production)
and sorted and packed at the Certified Packing House (the
registration code of the Certified Packing House). As the
result of the export inspection, SENASA has also verified
that they are free from quarantine pests of Japan, especially
from Ceratitis capitata and Anastrepha fraterculus."
7.2.6.2 If the 'Hass' avocados that were harvested in a Certified
Place of Production and packed in the same process of
operation are divided into more than one lot, SENASA shall
not issue phytosanitary certificate until the export
inspection of all the divided lots is completed.

7.2.7 LOADING INTO CONTAINERS
7.2.7.1 'Hass' avocado fruits shall be loaded into containers verified
by SENASA to be clean and able to be pest-proof. The
amount of the 'Hass' avocado fruits loaded into each
container shall be described in the phytosanitary certificate.
7.2.7.2 The loading shall be conducted in pest-proof controlled areas
(tight sealing, screening and other systems to prevent pest
entry into the containers during the loading) while the
phytosanitary certificate is effective. SENASA shall verify
the situation.
7.2.7.3. The pallets used in the exportation process should comply
with ISPM 15 and the current national regulations.

7.2.8 RECORD KEEPING


SENASA shall prepare ANNEX 6 for each lot and keep them
together with other relevant documents such as ANNEX 4 and
ANNEX 5 at least until the end of the next exportation season.

8. INSPECTION CONDUCTED BY MAFF AT IMPORT PORT


MAFF shall inspect all the lots at the import port based on the Plant
Protection Act and other relevant regulations.
8.1 MEASURES TO BE TAKEN IN CASE FRUIT FLIES ARE
DETECTED AS THE RESULT OF THE INSPECTION
In case a live or dead larva or an egg of fruit flies is detected as the
result of the inspection, MAFF shall report to SENASA that it has
detected fruit flies, and shall suspend import inspection and conduct
inspection to identify the detected fruit flies. SENASA shall
immediately suspend export inspections and the issue of
phytosanitary certificates related to the 'Hass' avocado fruits to be
exported to Japan.
8.1.1 IN CASE THE DETECTED FRUIT FLIES ARE CERATITIS
CAPITATA OR ANASTREPHA FRATERCULUS
MAFF shall report the fact that the detected fruit flies were
Ceratitis capitata or Anastrepha fraterculus to SENASA.
SENASA shall examine the reasons why the fruit flies were

detected, and shall discuss the measures to be taken with MAFF.
SENASA shall suspend export inspections and the issue of
phytosanitary certificates related to all the 'Hass' avocado fruits
to be exported to Japan until MAFF reach an agreement
regarding the measures to be taken.
8.1.2 IN CASE THE DETECTED FRUIT FLIES ARE NOT
CERATITIS CAPITATA OR ANASTREPHA FRATERCULUS
MAFF shall report the fact that the detected fruit flies were not
Ceratitis capitata or Anastrepha fraterculus to SENASA and
resume import inspections related to 'Hass' avocados to be
exported to Japan.

8.2 MEASURES TO BE TAKEN IN CASE ANY FRUIT OTHER THAN


'HASS' AVOCADO OR ANY FRUIT SUSPECTED TO BE
OVERRIPE IS DETECTED AS THE RESULT OF THE
INSPECTION
In case contamination by any fruits other than 'Hass' avocados or any
fruits suspected to be overripe are detected, MAFF shall report the
fact to SENASA and request SENASA to examine the reasons and to
propose the measures to be taken, after suspending the import
inspection related to all the lot. SENASA, in the meantime, shall
suspend export inspections and issue of phytosanitary certificate
related to 'Hass' avocados to be exported to Japan. Suspension shall
be continued until MAFF reach an agreement regarding the
measures to be taken.

8.3 MEASURES TO BE TAKEN BASED ON THE RESULT OF THE


IMPORT INSPECTION
MAFF shall order the person who owns or handles the lot to dispose
of or return the lot, if:

- the phytosanitary certificate is not attached.


- SENASA did not seal the lot.
- no label that states its destination, Japan, and that states export
inspection had been completed.
- the packing of the box is damaged or opened.

- any live or dead Ceratitis capitata or Anastrepha fraterculus is
detected.
- any fruit other than 'Hass' avocados or any fruit suspected to be
overripe is detected.

In case any quarantine pest regulated by MAFF other than Ceratitis


capitata or Anastrepha fraterculus is detected in a lot, the lot shall be
sterilized, disposed of, or returned based on the Plant Protection Act
and other relevant regulations.

9. VERIFICATION BY MAFF PLANT PROTECTION OFFICER


For exporting 'Hass' avocado fruits from Japan to Peru, the MAFF plant
protection officer shall verify that SENASA conducted export inspection
and that defective fruits were sorted out and packing was conducted
properly at the Certified Packing Houses.

Therefore, SENASA shall request MAFF every year for the dispatch of
MAFF plant protection officer, who verifies whether the export inspection
by SENASA and sorting and packing at the Certified Packing Houses are
conducted properly.

9.1 REQUEST FROM SENASA TO MAFF FOR THE DISPATCH OF


MAFF PLANT PROTECTION OFFICER
9.1.1 SENASA shall request MAFF every year for the dispatch of
MAFF plant protection officer in writing at least a month before
the start of the exportation season of ‘Hass’ avocados from Peru.
9.1.2 SENASA shall arrange the tentative schedule of the dispatch of
MAFF plant protection officer in accordance with Article 9.2.2
“Points to be verified and methods of verification by the MAFF
plant protection officer”. SENASA and MAFF decide the term of
the dispatch of the MAFF plant protection officer upon
consultation between both parties.
9.1.3 In principle, the MAFF plant protection officer shall be
dispatched when the first fruits to be exported are harvested
after the start of the exportation season.

9.2 POINTS TO BE VERIFIED BY MAFF PLANT PROTECTION
OFFICER
9.2.1 The MAFF plant protection officer dispatched to Peru shall
verify the relevant documents kept by SENASA. The officer
shall also verify whether the exportation process of ‘Hass’
avocado fruits from Peru to Japan is implemented properly in
accordance with this Protocol through conducting hearings with
the SENASA officers who verified the sorting and packing
operations at the Certified Packing Houses, the SENASA
officers who conducted the export inspection, the SENASA
officers who examined the Certified Place of Production, and the
staff of the Certified Place of Productions and the Certified
Packing Houses.
9.2.2 The MAFF plant protection officer shall visit approximately one
third of the Certified Places of Productions and the Certified
Packing Houses respectively (the officer shall visit three of them,
if the number of the Certified Places of Productions or the
Certified Packing Houses is nine or less) once or more in order to
verify the following items: the condition of cultivation
management and harvest of fruits and transportation in the
Certified Places of Productions; the condition of sorting and
packing of fruits at the Certified Packing Houses. The MAFF
plant protection officer shall also verify the condition of the
export inspection conducted by SENASA.
In case there are any packing houses that were requested to
make improvements by MAFF in accordance with Article 6.1.7,
the MAFF plant protection officer shall visit the packing houses
without fail to verify those conditions.
9.2.3 After the MAFF plant protection officer’s arrival in Peru, the
MAFF plant protection officer and SENASA shall have a
meeting to discuss the details of the schedule and, as required,
arrange the schedule with business operators, exporters and
other participators of the Certified Places of Production and the
Certified Packing Houses.
9.2.4 When the verification is completed, the MAFF plant protection

officer shall explain the result to SENASA before the officer
leaves Peru.
9.2.5 In case MAFF considers the necessity of improvement in the
operations and in the procedures related to the exportation of
the ‘Hass’ avocado fruits from Peru to Japan after receiving the
report, MAFF shall report the fact to SENASA and discuss the
measures to be taken with SENASA.

9.3 MEASURES TO BE TAKEN IF ANY SERIOUS PROBLEMS ARE


DETECTED AS THE RESULT OF THE VERIFICATION BY MAFF
PLANT PROTECTION OFFICER
If the MAFF plant protection officer detects any serious problems in
the exportation of ‘Hass’ avocados from Peru to Japan (e.g. SENASA
does not supervise the operations at the Certified Packing Houses,
SENASA does not examine the Certified Place of Productions), the
MAFF plant protection officer shall immediately report the fact to
SENASA and MAFF.

In such cases, SENASA should immediately suspend the exportation


to Japan, and discuss the measures to be taken with the MAFF,
through MAFF plant protection officer.

9.4 CONSIDERATIONS RELATED TO THE DISPATCH OF THE


MAFF PLANT PROTECTION OFFICER
The Peruvian side shall bear the cost of the dispatch of the MAFF
plant protection officer.

During the MAFF plant protection officer’s stay in Peru, SENASA


shall ensure that it takes responsibility for preparing a proper
working environment, including the officer’s safety and means of
transportation and communication, and that it cooperates with the
officer for the smooth implementation of the operations.

Regarding the dispatch of the MAFF plant protection officer and the
officer’s operations during the stay in Peru, business operators of the
Certified Place of Productions and the Certified Packing Houses shall

follow the instructions of SENASA.

10. ADJUSTMENT OF THE OPERATIONS


10.1 If SENASA detects any problems in the operations of the Certified
Place of Productions and the Certified Packing Houses through the
examination of the Certified Places of Productions, supervision at
the Certified Packing Houses, and implementation of the export
inspections, SENASA shall order the operation to be improved in
question, record the issue, and report to MAFF.

10.2 If SENASA detects any serious problems related to the exportation


of ‘Hass’ avocado fruits from Peru to Japan, SENASA shall
immediately suspend the exportation to Japan and report to MAFF
to discuss the measures to be taken.

11.NON COMPLIANCE WITH THE PROTOCOL


11.1 The registration of any places of productions and packing houses
that do not comply with the Protocol shall be canceled. The
exportation by any exporters that does not comply with the Protocol
shall be suspended immediately.

11.2 A place of production or packing houses that lost registration or an


exporter whose qualification for exportation to Japan is suspended
shall resume their qualification if they are examined by SENASA
and it is verified that the requested corrective measures have been
taken.

12. REVIEWOF THE PROTOCOL


SENASA or MAFF may propose an amendment to this Protocol to the
other party by an official paper if the amendment is considered necessary.
