Whoever, having devised or intending to devise any scheme or artifice to
defraud, or for obtaining money or property by means of false or fraudulent
pretenses, representations, or promises, or to sell, dispose of, loan,
exchange, alter, give away, distribute, supply, or furnish or procure for
unlawful use any counterfeit or spurious coin, obligation, security, or other
article, or anything represented to be or intimated or held out to be such
counterfeit or spurious article, for the purpose of executing such scheme or
artifice or attempting so to do, places in any post office or authorized
depository for mail matter, any matter or thing whatever to be sent or
delivered by the Postal Service, or deposits or causes to be deposited any
matter or thing whatever to be sent or delivered by any private or
commercial interstate carrier, or takes or receives therefrom, any such
matter or thing, or knowingly causes to be delivered by mail or such carrier
according to the direction thereon, or at the place at which it is directed to
be delivered by the person to whom it is addressed, any such matter or
thing, shall be fined under this title or imprisoned not more than 20 years, or
both. If the violation occurs in relation to, or involving any benefit
authorized, transported, transmitted, transferred, disbursed, or paid in
connection with, a presidentially declared major disaster or emergency (as
those terms are defined in section 102 of the Robert T. Stafford Disaster
Relief and Emergency Assistance Act (42 U.S.C. 5122)), or affects a financial
institution, such person shall be fined not more than $1,000,000 or
imprisoned not more than 30 years, or both.

Whoever, owing allegiance to the United States, levies war against them
or adheres to their enemies, giving them aid and comfort within the United
States or elsewhere, is guilty of treason and shall suffer death, or shall be

(a)Whoever knowingly and willfully communicates, furnishes, transmits, or
otherwise makes available to an unauthorized person, or publishes, or uses
in any manner prejudicial to the safety or interest of the United States or for
the benefit of any foreign government to the detriment of the United States
any classified information—
(1)
concerning the nature, preparation, or use of any code, cipher,
or cryptographic system of the United States or any foreign government; or
(2)
concerning the design, construction, use, maintenance, or repair of any
device, apparatus, or appliance used or prepared or planned for use by
the United States or any foreign governmentfor cryptographic
or communication intelligence purposes; or
(3)
concerning the communication intelligence activities of the United States or
any foreign government; or
(4)
obtained by the processes of communication intelligencefrom the
communications of any foreign government, knowing the same to have been
obtained by such processes—
Shall be fined under this title or imprisoned not more than ten years, or
both.
(b)
As used in subsection (a) of this section—
The term “classified information” means information which, at the time
of a violation of this section, is, for reasons of national security,
specifically designated by a United States Government Agency for
limited or restricted dissemination or distribution;

(a)
Any person shown by evidence satisfactory to the Secretary to be guilty of
mutiny, treason, sabotage, or rendering assistance to an enemy of the
United States or of its allies shall forfeit all accrued or future gratuitous
benefits under laws administered by the Secretary.
(b)
The Secretary, in the Secretary’s discretion, may apportion and pay any part
of benefits forfeited under subsection (a) to the dependents of the person
forfeiting such benefits. No dependent of any person shall receive benefits
by reason of this subsection in excess of the amount to which the dependent
would be entitled if such person were dead.
(c)
In the case of any forfeiture under this section there shall be no authority
after September 1, 1959 (1) to make an apportionment award pursuant to
subsection (b) or (2) to make an award to any person of gratuitous benefits
based on any period of military, naval, or air service commencing before the
date of commission of the offense.

Whoever—
(1)
having taken an oath before a competent tribunal, officer, or person, in any
case in which a law of the United States authorizes an oath to be
administered, that he will testify, declare, depose, or certify truly, or that
any written testimony, declaration, deposition, or certificate by him
subscribed, is true, willfully and contrary to such oath states or subscribes
any material matter which he does not believe to be true; or
(2)
in any declaration, certificate, verification, or statement under penalty of
perjury as permitted under section 1746 of title 28, United States Code,
willfully subscribes as true any material matter which he does not believe to
be true;
is guilty of perjury and shall, except as otherwise expressly provided by law,
be fined under this title or imprisoned not more than five years, or both. This
section is applicable whether the statement or subscription is made within or
without the United States.

(a)
Whoever under oath (or in any declaration, certificate, verification,
or statement under penalty of perjury as permitted under section 1746 of
title 28, United States Code) in any proceeding before or ancillary to any
court or grand jury of the United States knowingly makes any false material
declaration or makes or uses any other information, including any book,
paper, document, record, recording, or other material, knowing the same to
contain any false material declaration, shall be fined under this title or
imprisoned not more than five years, or both.
(b)
This section is applicable whether the conduct occurred within or without
the United States.
(c)An indictment or information for violation of this section alleging that, in
any proceedings before or ancillary to any court or grand jury of the United
States, the defendant under oath has knowingly made two or more
declarations, which are inconsistent to the degree that one of them is
necessarily false, need not specify which declaration is false if—
(1)
each declaration was material to the point in question, and
(2)
each declaration was made within the period of the statute of limitations for
the offense charged under this section.

(a)
Murder is the unlawful killing of a human being with malice aforethought.
Every murder perpetrated by poison, lying in wait, or any other kind of
willful, deliberate, malicious, and premeditated killing; or committed in the
perpetration of, or attempt to perpetrate, any arson, escape,
murder, kidnapping, treason, espionage, sabotage, aggravated sexual abuse
or sexual abuse, child abuse, burglary, or robbery; or perpetrated as part of
a pattern or practice of assault or torture against a child or children; or
perpetrated from a premeditated design unlawfully and maliciously to effect
the death of any human being other than him who is killed, is murder in the
first degree.
Any other murder is murder in the second degree.
(b)
Within the special maritime and territorial jurisdiction of the United States,
Whoever is guilty of murder in the first degree shall be punished by death or
by imprisonment for life;
Whoever is guilty of murder in the second degree, shall be imprisoned for
any term of years or for life.

(a)RAPE.—Any person subject to this chapter who commits a sexual
act upon another person by—
(1)
using unlawful force against that other person;
(2)
using force causing or likely to cause death or grievous bodily harm to any
person;
(3)
threatening or placing that other person in fear that any person will be
subjected to death, grievous bodily harm, or kidnapping;
(4)
first rendering that other person unconscious; or
(5)
administering to that other person by force or threat of force, or without the
knowledge or consent of that person, a drug, intoxicant, or other similar
substance and thereby substantially impairing the ability of that other
person to appraise or control conduct;
is guilty of rape and shall be punished as a court-martial may direct.
(b)SEXUAL ASSAULT.—Any person subject to this chapter who—
(1)commits a sexual act upon another person by—
(A)
threatening or placing that other person in fear;
(B)
causing bodily harm to that other person;
(C)
making a fraudulent representation that the sexual actserves a professional
purpose; or
(D)
inducing a belief by any artifice, pretense, or concealment that the person is
another person;
