Introduction
The basic object of the Right of Information Act,2005 is to
empower the citizens, promote transparency and accountabil-
ity in the working of the Government, contain corruption, and
make our democracy work for the people in real sense. It goes
without saying that an informed citizen is better equipped to
keep necessary vigil on the instrument of governance and make
the government more accountable to the governed. The Act is
a big step towards making the citizens informed about the ac-
tivities of the Government.
NIC as a Public Authority designated Public Information Office
(PIO) and Appellate Authority (AA) for citizens to secure access
to information and published the Proactive Disclosures in ac-
cordance with the provisions of the Act in October 2005.
What is Right to Information
RTI stand for Right to Information. Right to Information Act
2005 mandates timely response to citizen requests for govern-
ment information. Right to Information empowers every citizen
to seek any information from the Government, inspect any
Government documents and seek certified photocopies there-
of. Right to Information also empowers citizens to official in-
spect any Government work or to take the sample of material
used in any work.
Right to Information is a part of fundamental right under Article
19(1) of the Constitution. Article 19 (1) says that every citizen
has freedom of speech and expression.
Even though RTI is a fundamental right, still we need RTI Act to
give us this right. This is because if you went to any Govern-
ment Department and told the officer there, “RTI is my funda-
mental right and that I am the master of this country. There-
fore, please show me all your files”, he would not do that. In all
probability, he would throw you out of his room. Therefore, we
need a machinery or a process through which we can exercise
this fundamental right. Right to Information Act 2005, which
became effective on 13th October 2005, provides that machin-
ery. Therefore, Right to Information Act does not give us any
new right. It simply lays down the process on how to apply for
information, where to apply, how much fees etc.
The Act was passed on June 15, 2005 and implemented with effect
from October 12, 2005.
Conclusion
The right to Information Act of 2005 signals a radical shift in our
government culture and permanently impacts all agencies of
state. The effective implementation of this law depends on
three fundamental shifts:
From the prevailing culture of secrecy to a new culture of
openness;
From personalized despotism to authority couple with account-
ability; and
From unilateral decision-making to participative governance.
