ABSTRACT

In the communities of Mukomuko any problems that occur resolved by consensus to avoid

violence. The problems completed in stages starting from the core (the family), ninik

mamak, and the village leader as a indigenous functionaries, they found the best solution by

peaceful way. as well as any disputes in inheritance then solved by custom. This study aimed

(1) to determined the norms of inheritance law in Mukomuko district and disputes in

inheritance. (2) to knew the settlement of disputes in inheritance under customary law in the

Mukomuko district. This study used a qualitative approach, which leads directly to the

condition without reducing the elements in it. The population in this study were of

Indigenous People in Mukomuko District. Collecting data through interviewed and

secondary data collection. Data were analyzed using qualitative analysis and presented

descriptively. The results of this study indicated that (1) Indigenous peoples in the district

town of Mukomuko still adhere to the norms of customary law in the society. (2) The

occurrence of disputes in inheritance under customary law in Mukomuko due to lack of

understanding of the estate. (3) The process for resolving disputes in the division of

inheritance in the district of Kota Mukomuko customarily resolved by consensus. It was

concluded that the inheritance disputes in indigenous communities in the district of Kota

Mukomuko Mukomuko due to lack of understanding of the heirs of the estate, and the

settlement of disputes in the division of inheritance is done by custom that through

deliberation or consensus.
