The PED
What Is It?
• Council Directive 97/23/EC of European Parliament.
Known as the Pressure Equipment Directive (PED).
• It is intended to remove all Technical Barriers to Trade
within the EEC by assessing the Safety of the
Equipment for its intended use.
• It applies to “complete” Pressure Equipment eg.
Completed Fire Extinguishers.
• For Luxfer it applies to FE, Scuba & Scba Cylinders
ONLY & to the valves that go into them in the event we
fit them.
• ALL other types of Cylinders come under the TPED
(see later).

When does it come into force?


• Came into force on 29th November 1999 with a
transition period up to & including 29th may 2002.
• After 29th May 2002, the PED is MANDATORY for all
new pressure equipment put on The Market in the EEC.
• After 29th May 2002 it will be ILLEGAL to place any
new pressure equipment on to The Market….for us that
means Cylinders & valves that we might fit.
• This means we cannot sell any non-PED conforming
Cylinders ( FE, Scuba & Scba) after this date, with in
the EEC.
• This applies to our Customers as well !!!

What do Luxfer have to do to comply with the PED?
• We comply by selecting Conformity Assessment
Modules contained in the PED & by the appointment of
a Notified Body.
• We have selected Module B1 ( Design Approval for
each Design ) & Module D (Production Quality
Assurance, with regular Audits by Lloyds).
• We have appointed Lloyds Register as our Notified
Body.
• Lloyds Register then Licence us to stamp our
Cylinders with the “CE” Mark.
• The use of the “CE” Mark is not a right, it can be
withdrawn at any time.

What Inspection Requirements are there ?
• Under Module D, there are no Third Party, including
Customer, Inspection requirements.Normal Luxfer
inspection are of course carried out.
• A Customer does not have the right to carry out an
Inspection. If a Customer wants to carry out an Inspection
it must be a Commercial Decision to allow him & at his
cost.
What Certification Requirements are there ?
• LGC Legally have to produce a “Declaration of
Conformity”.
• LGC Legally have to supply a “Customer Information
Sheet”.

Valves & The PED.
i All Valves to be fitted to a PED “CE” Marked Cylinder

MUST also be PED Compliant.


i This applies to Customer Free Issued Valves as well

as Luxfer purchased valves.


Customer Orders.
i Customers, before they can use “CE” Marked

Cylinders, must also have selected appropriate


Conformity Assessment Modules & have appointed
a Notified Body.
i They also must produce their own “Declaration of

Conformity” & “Customer Information”.


i The overall Legal responsibility for PED Compliance

rests with the Customer.

Summary:
• PED applies only to FE, Scuba, Scba Cylinders & their
valves (if fitted).
• LGC have Chosen Conformity Assessment Modules B1
(Design) & D (Production QA).
• LGC has appointed Lloyds Register as our Notified
Body.
• Under Module D there is no requirement for Third Party
Inspections…including by Customers.
• Customers must have chosen appropriate Conformity
assessment Modules & have appointed a Notified Body.
• Ultimate Legal responsibility for PED Compliance rests
with the Customer.

The TPED
What is it ?
• Council Directive 99/36/EC for the European Parliament.
Known as the Transportable Pressure Equipment
Directive (TPED).
• It, like the PED, is intended to remove all Technical
Barriers to Trade within the EEC.
• It is linked to the ADR/RID which are European
Agreements for the transportation of Dangerous Goods.
• Unlike the PED, the TPED is essentially Component
based as opposed to “complete” pressure equipment.
• For Luxfer it applies to all cylinders of 0.5 Litres
capacity & above except for FE, Scuba & Scba.
• It applies to all valves for the above & where applicable
also to Cages.

When does it come into force ?
• Came into force on 1st July 2001 with a transition
period up to & including 1st July 2003.
• After 1st July 2003 the TPED is MANDATORY for all
new Transportable pressure equipment placed on
The Market in the EEC.
• After 1st July 2002 it will be ILLEGAL to place any
new Transportable pressure equipment on to The
Market….for us that means Cylinders, Valves &
Cages.
• This applies to us & our Customers.

What Inspection Requirements are there ?
• Under Module D, there are no Third Party, including
Customer, Inspection requirements.Normal Luxfer
inspection are of course carried out.
• Module D should be offered where ever possible.
• Under Module F, there is Direct Inspection by the
Notified Body.This has additional cost implications
• A Customer does not have the right, under either
Module D or F, to carry out an Inspection. If a Customer
wants to carry out an Inspection it must be a
Commercial Decision to allow this..

Valves, Cages & The TPED.
i All Valves & Cages to be fitted to a TPED “Π”

Marked Cylinder after 1st July 2002 MUST also be


TPED Compliant.
i Prior to 1st July 2003, the valve need not be “Π” &

the cage need not be to EN962.


i This applies to Customer Free Issued Valves as well

as Luxfer purchased valves.

Customer Orders.
i Customers generally do not need to have to under

go a Conformity Assessment procedure nor appoint


a Notified Body, unlike the PED.
i Customers for TPED “Π” products only have to buy

the “Π” bits & put them together as the TPED is


essentially a component based standard.
i For an assembly of “Π” components they do not

have to produce their own “Declaration of


Conformity” & “Customer Information”.
