Background of the Katarungang Pambarangay Law

- The original law was actually under PD 1508, enacted in 1978, however, this was
repealed by the enactment of the Local Government Code of 1991.
- The provisions on the Katarungang Pambarangay are now found under Chapter
VII, Title I, Book III, RA 7160 (Local Government Code of 1991)
- The LGC introduced substantial changes not only in the authority granted to the
Lupong Tagapamayapa but also in the procedure to be observed in the
settlement of disputes within the authority of the Lupon

Katarungang Pambarangay under the Local Government Code of 1991

Lupong Tagapamayapa [Section 399, LGC]

Composition [Section 399(a), LGC]

- Composed of the punong barangay, as chairman and ten (10) to twenty (20)
members, which shall be constituted every 3 years

Qualifications [Section 399(b), LGC]

- Any person actually residing or working in the barangay


- Not expressly disqualified by law
- Possessing integrity, impartiality, independence of mind, sense of fairness, and
reputation for probity

How Formed [Section 399(c)(d)(e), LGC]

- Notice to constitute the lupon shall be prepared by the punong barangay within
the first fifteen (15) days from the start of his term of office
o Then notice shall include the names of proposed members who have
expressed their willingness to serve
- Such notice shall be posted in three (3) conspicuous places in the barangay
continuously for a period of not less than three (3) weeks
o During the posting period, opposition to the proposed appointment may be
made
- Within 10 days after posting, the punong barangay shall appoint the members,
taking into consideration any opposition that may be made
o Appointment shall be made in writing
o It should be signed by the punong barangay
o Attested to by the barangay secretary
- The list of appointed members shall be posted in 3 conspicuous places in the
barangay for the entire duration of their term of office
- The appointed members should take an oath before the punong barangay
[Section 400, LGC]

Term of Office

- he shall hold office until a new lupon is constituted on the third year following his
appointment unless sooner terminated by resignation, transfer of residence or
place of work, or withdrawal of appointment by the punong barangay with the
concurrence of the majority of all the members of the lupon [Section 400, LGC]

How Vacancies are Filled

- the punong barangay shall immediately appoint a qualified person who shall hold
office only for the unexpired portion of the term [Section 401, LGC]
