Leland Public Safety Committee Bylaws

The Leland Public Safety Committee (PSC) is hereby created by the Town Council to work alongside
the Town’s fire and police departments and its surrounding communities, based upon
jurisdictional boundaries and memorandum of understandings, to provide for community input
into the citizens vision of the performance of public safety within the town.

Duties and Goals


 Make formal recommendations to the department heads on public safety services
applicable to those departments covered under the purview of the Town.
 Review and make recommendations on capital improvement plan budget requests and
the vision of meeting citizen demands of needed services.
 Review and make recommendations for improvements of the fire protection system;
reviewing North Carolina Rating Response System; and consultants' reports; and
recommending action for improvement as deemed consistent with those reports.
 Provide citizen input into the development of service district operational guidelines for
the Town of Leland Public Safety departments.
 To work with area local governments and public and private organizations to promote
public safety for the Town of Leland.
 To present, review, advise or recommend any other matter related to public safety as
the Mayor and Town Council may direct.

Membership Terms and Vacancies


The Leland Public Safety Committee shall consist of seven (7) regular members. One Town
Council member shall serve on the Committee as a Council liaison without voting rights.

The Town Council shall appoint Committee members with three members having two-year
terms and four members having three-year terms. No member may serve more than two (2)
consecutive terms. At the expiration of one (1) year from a former Public Safety Committee
member’s second term, such member shall be eligible for reappointment to the Public Safety
Committee. Any person appointed to fill an unexpired term shall be deemed to have served one
of the two (2) consecutive terms that such member may serve if the unexpired term is for two
(2) years or more. No later than ninety (90) days preceding the expiration of a member’s term,
members who have served only one (1) term may apply in writing to the Town Council to be
reappointed for a second term. The terms of four (4) members of the Public Safety Committee
shall expire on June 30 of odd numbered years or until their successors are appointed. The
terms of three (3) members shall expire on June 30 of even numbered years or until their
successors are appointed. The Town Council shall appoint members of the Public Safety
Committee at the regular Town Council meeting in June of each year and new Committee
members shall take office at the next regularly scheduled Committee meeting.

Terms shall be staggered with initial appointments as follows: Four (4) members for a term of
two (2) years; three (3) members for a term of three (3) years.

All vacancies shall be filled by the Town Council. All appointments are at will. Appointment to
an unexpired term does not extend the period of the term to which a Committee member is
appointed.

Officers
Chairman: The chairman shall be elected by the members of the Committee at the first
scheduled meeting and the first meeting after June 30 in consecutive years. The chairman is
eligible for reelection, shall preside at each meeting, and shall decide on all points of order and
procedure. The chairman shall vote on all matters before the board. The chairman will work
with staff to establish an agenda for each meeting. Upon resignation or some incapacity visited
upon the chairman, the board shall elect a new chairman within 90 days to complete the
existing term of office. In addition, the chairman shall provide an annual report by June 30 of
each year to the Town Council in reference to the activities of the Committee for the previous
year.

Vice-Chairman: A vice-chairman shall be elected by the Committee from its members in the
same manner as the chairman and shall be eligible for reelection. The vice-chairman shall serve
as acting chairman in the absence of the chairman, and at such times shall hold all powers and
duties of the chairman.

Voting
All members of the Committee shall vote on every issue except in a situation where a member
of the Committee shall be excused from voting by the chairman on matters involving direct
personal or financial interest. In the event that a member abstains from voting for reasons
other than direct personal or financial interest, the abstention shall be ruled by the chairman as
an affirmative vote.

Meetings
Regular meetings of the Committee shall be held at Town Hall at a set time agreed upon by the
members of the Committee.

Special meetings of the Committee shall be held at a time and place designated by the
chairman subject to compliance with requirements of the North Carolina Open Meetings Law.

When there is no business for the Committee, regular meetings may be cancelled. Notice will
be given to all members of such cancellation.
