Subject: Melvin Creek Resort

Dear Sir/Madam;

Could you please advise me of the status of this certificate. It was

granted in Aug. 2000 and given the five year extension on Aug 14, 2005,

even though no work whatsoever had been done. I understand the extension

for such projects is a one time 5 year extension, after which, if

nothing has been done, the certificate is voided. I also understand that

the certificate cannot be sold or the like. Clarification and

disposition of this case is greatly appreciated.

Thank you for your email received August 28, 2010 regarding the Melvin Creek/Cayoosh Resort
Project (Project).

The Project

The Proponent, NGR Resort Consultants Inc., received an EA certificate in August 2000, to
construct and operate an all-season destination mountain resort in the Melvin Creek/Cayoosh
area, approximately 35 kilometres southwest of Lillooet. The proposed project was reviewable
under the Reviewable Projects Regulation to the BC Environmental Assessment Act (Act) because
the number of bed units associated with the proposed ski resort exceeds 2000 units.

Request to Extend the EA Certificate

Under Section 18 of the Act, the Minister of Environment or Executive Director may extend the
deadline on the certificate, on one occasion only, for not more than five years. After the period of
the extension, if the project has not been substantially started, in the reasonable opinion of the
Minister, the EA certificate expires.

In June 2005, the Proponent applied for an EA certificate extension for the Project. As you know,
the Provincial Crown has a legal duty to consult with First Nations prior to land use decisions
which may affect their asserted rights. The EAO determined that additional time was required for
the Crown to fulfill its consultation requirements with First Nations respecting the Proponent’s
application for an EA certificate extension.

The Minister of Environment issued an Order under Section 31 of the Act on August 11, 2005
that suspended the expiry of the existing EA certificate to allow time for the Crown to conduct
additional consultations with First Nations. The suspension will remain in place by Order of the
Minister until the date the Minister causes notification of his/her decision on the application to be
electronically mailed to the Proponent. During this period, no construction activity by the
Proponent under the certificate of this order can take place.

The Proponent confirmed in February 2009 its intension to pursue the EA certificate extension.

Currently, the EAO is undertaking a review of the project and plans to initiate engagement with
First Nations in the Fall/Winter of 2010.

Disposition of the Project

In response to your question regarding the impact of disposing of the Project, EAO has no record
of any plans of the Proponent to dispose the Project. However, EAO current policy states that the
Proponent, except in connection with granting security to Project lenders or other financing
entities or financing facilities, must obtain the written consent of the Minister of Environment,
such consent not to be unreasonably withheld, prior to disposing, whether legally, beneficially or
otherwise, of:

interest conferred by the Certificate; or,
<!--[if !supportLists]-->b) <!--[endif]-->the Project.

The EAO may be required to consult with First Nations regarding deposition of the certificate or
the Project prior to the Minister’s decision.
