MINUTES

WILLOW FORK DRAINAGE DISTRICT

December 10, 2009

The Board of Directors (the "Board") of Willow Fork Drainage District (the
"District"), met in regular session, open to the public, on December 10, 2009, at the
Willow Fork Country Club, 21055 Westheimer Parkway, Katy, Texas, inside the
boundaries of the District, and the roll was called of the members of the Board:

and all of the above were present, thus constituting a quorum.

Also present at the meeting were Melony Gay of Uretek ICR; Bill OdIe of TBG
Partners; John Sauter of Severn Trent Services ("ST"); Fran Matuska of F. Matuska, Inc.;
Lou Triche and Dennis Tiff of Champions Hydro-Lawn, Inc. ("Champions"); Melinda
Garza of AECOM, Inc.; and Stephen M. Robinson and Patti Porter Hopper of Allen
Boone Humphries Robinson LLP.

APPROVE MINUTES

The Board first reviewed the minutes of the November 12, 2009, meeting. After
review and discussion, Director Robinson moved to approve the minutes. Director
Renberg seconded the motion, which carried unanimously.

COMMENTS FROM DISTRICT RESIDENTS

There were no comments from residents.

SECURITY SERVICES

Director Lyons reported on security matters. He stated there is a sinkhole near


George Bush Park. Mr. Sauter stated it has been reported to Fort Bend County.

MAINTENANCE OF STORM SEWER LINES

Mr. Sauter distributed the storm sewer maintenance report, a copy of which is
attached. He stated ST employees have been trained on MS-4 issues. Director Robinson
then moved to approve the report and invoice. Director Renberg seconded the motion,
which passed by unanimous vote.

BOOKKEEPER'S REPORT

Ms. Matuska reviewed the bookkeeper's report, a copy of which is attached,


including the checks presented for payment. After review and discussion, Director
Robinson moved to approve the bookkeeper's report, the investment report, and
payment of the bills. Director Kainer seconded the motion, which passed by
unanimous vote.

TAX ASSESSOR'S REPORT

Ms. Matuska distributed the tax report, a copy of which is attached. Director
Robinson moved to approve the tax report. Director Kainer seconded the motion,
which carried unanimously.

OPERATOR'S REPORT, INCLUDING AUTHORIZING DITCH MAINTENANCE

Mr. Triche reviewed the operator's report with the Board, a copy of which is
attached, and reviewed pictures of ditches.

Mr. Tiff then reported on the development of two sinkholes on the Diversion
Channel. He stated the estimated cost to make the repairs is $1,900.00 per repair. After
review and discussion, Director Lyons moved to authorize the repairs. Director
Renberg seconded the motion which carried unanimously.

Mr. Tiff reported on a corroded backslope interceptor pipe on the Diversion


Channel and stated the cost to replace the pipe, stabilize, compact, and re-establish turf
is $8,500.00. Director Lyons then moved to approve the repair. Director Renberg
seconded the motion, which carried unanimously.

Mr. Tiff stated Champions will bring samples of the MS-4 regulatory signs to the
next meeting. He stated the cost for each sign is $490.00, which includes installation.

After review and discussion, Director Lyons moved to approve the operator's
report, the January mowing, and the action items. Director Renberg seconded the
motion, which carried unanimously.

ENGINEER'S REPORT

Ms. Garza submitted to the Board the written engineer's report, a copy of which
is attached.

Ms. Garza updated the Board regarding the status of the Corps permit and
reviewed a letter from the Corps requesting additional information. He stated AECOM
will bring options for consideration at the next meeting. Mr. Robinson stated he will
bring a proposal for an attorney with expertise in this area to the next meeting.

Ms. Garza updated the Board regarding the small tract in Harris-Fort Bend
Counties MUD No.1 where storm drainage from the property will flow into a ditch
which ultimately flows into the District's channel. Ms. Garza stated she has not yet
heard from him or received evidence of the previous property owner's construction of a
ditch to receive the flows.

Ms. Garza stated AECOM received plans from the YMCA for a parking lot
expansion on Westheimer Parkway and presented the MS-4 checklist for the project.

Ms. Garza updated the Board on the Grand Lakes development and stated she
had no items for the Board's approval.

Ms. Garza updated the Board on Meadowbrook Farms and stated she had no
items for the Board's approval.

Ms. Garza next updated the Board regarding MS-4 year three action items and
stated the Texas Commission on Environmental Quality issued its administratively
complete letter for the year two report.

Ms. Garza updated the Board on the status of the new drainage model.

Mr. Robinson reported on a conversation with Mark Vogler of the Fort Bend
County Drainage District regarding additional excavation on the Diversion Channel in
connection with recreational amenities which would also increase capacity in the
channel. He stated that Mr. Vogler said the Drainage District would be open to
considering the possibility of additional excavation if the District can prove additional
capacity for upstream developments would also be achieved.

After review and discussion, Director Kainer moved to approve the engineer's
report, MS-4 items listed in the engineer's report, including the year three checklist,
authorize AECOM to study upstream benefits of additional excavation of the diversion
channel, authorize AECOM to prepare options for Corps permitting issues, and the
action items. Director Renberg seconded the motion, which passed by unanimous vote.

BUFFALO BAYOU PARK AND TRAIL SYSTEM

The parks committee updated the Board regarding the tour held December 3,
2009. Mr. Robinson updated the Board concerning potential sites for community
improvements. The parks committee concurred to next meet on the first Thursday in
February.

Mr. Robinson stated that Cinco MUD No.1 owns a small piece of property along
the Diversion Channel which it would like to transfer to the District. Director Lyons
moved to accept the property. Director Kainer seconded the motion, which carried
unanimously.

The Board of Directors of Willow Fork Drainage District will hold a regular meeting on
Thursday, December 10, 2009 at 11:30 a.m., at the Willow Fork Country Club, 21055 Westheimer
Parkway, Katy, Texas, to discuss and, if appropriate, act upon the following items:

1. Approve minutes.
2. Comments from District residents, including requests for consents to
encroachment or temporary use of District facilities.
3. Security services, fines and penalties for damages to District facilities and violation
of District regulations.
4. Maintenance of storm sewer lines, including repair of sinkholes and televising of
outfalls and repair options for outfalls.
5. Financial and bookkeeping matters, including payment of the bills and review of
investments.
6. Tax assessment and collections matters, including delinquent tax collections,
installment agreements, and payment of tax bills.
7. Operation of District facilities, repairs and maintenance, including ditch
maintenance and desilting projects.
8. Engineering matters, including:
(a) Grand Lakes development;
(b) Meadowbrook Farms development;
(c) new drainage model and floodplain administrator duties;
(d) report on outfall inspections and rehabilitation plan;
(e) deeds, easements, offsite drainage agreements, requests to transfer drainage
capacity and requests to reserve drainage capacity;
(f) design of District facilities;
(g) update on status of Corps permit and cleaning out gabions;
(h) status of ongoing repairs to facilities; and
(i) MS-4 matters, including permit year 2 action items, installation of inlet
markers, budget, and implementation of matrix/ timeline.
9. Receive update on study of use of District rights of way for recreation and parks and
recreation needs in the District, and adopt Resolution Establishing Park Rules.

We have received the annual report for the Willow Fork Drainage District / Cinco MUD Coalition MS4
that was submitted on November 12, 2009 for the Year 2 reporting period for the above-referenced
permit. We have performed an administrative review of this report and offer the following comments.

The annual report appears to include all of the required information and is considered administratively
complete. We have attached a copy of the review checklist we utilized for this review for your reference.
Additional information may be requested in the future as part of technical review, an inspection, or an
audit. We did not perf01111 a comprehensive technical review of this report.

If there are any differences between the approved Storm Water Management Program (SWMP) and the
information provided in this report or futme reports, you must submit a notice of change (NOC) as
required by the general permit.

The annual report for the third permit year (August 13, 2009 through August 12, 2010) is due on
November 12, 2010. The Texas Commission on Environmental Quality (TCEQ) has an updated report
form available, and we strongly encourage MS4 operators to continue to use the template in preparing and
submiuing subs(;qul:nt reports. This will greatly assist us in revie~;\'ing the reports, and will help to insure
that we provide a timely response to permittees. Please make sure to also forward a copy of yom annual
report to the TCEQ regional office.

Finally, please be aware that discharges of the constituent(s) of concern to impaired water bodies for
which there is a total maximum daily load (TMDL) implementation plan are not eligible for this general
permit unless they are consistent with the approved TMDL and the implementation plan. Permitted MS4
operators must incorporate the limitations, conditions and requirements applicable to their discharges,
including monitoring frequency and reporting required by TCEQ niles, into their SWMP in order to
continue to be eligible for coverage under the general permit. I r the discharge is no longer eligible for
coverage under the general permit, then the MS4 operator would be required to apply for and receive an
individual Texas Pollution Discharge Elimination System (TPDES) permit.

Household Hazardous Waste (HHW) Collection Information

Definitions
HHW Household Hazardous Waste
Examples of HHW are certain paints, stains and varnishes; cleaners, polishes; automotive products,
pesticides and fertilizers. Even certain electronics such as televisions and computer monitors
contain hazardous components. Household hazardous waste
includes items that have the words "warning," "danger," "toxic,·
"corrosive," "irritant," "flammable" or "caution" on their labels.

Harris County HHW Program


Harris County holds approximately ten (10) one-day dropoff
events for Household Hazardous Waste throughout Harris
County each year. The events are typically held during the
spring and fall season, and are free to all residents of Harris
County.

Residents may bring household quantities of paint products,


pesticides, fertilizers, motor oil, gasoline, pool chemicals,
household cleaners, aerosols, batteries and automotive tires (5
per household).

Used electronics such as televisions, computers, word


processors, printers, scanners, fax machines, cellular phones, VCRs, stereos and other small
personal electronics are also accepted. Residents may bring up to five (5) of each of these items.

City of Houston residents do not need a Harris County voucher an use these facilities free of
charge by presenting a current water bill and mat' . lcanse.

We have received the annual report for the Willow Fork Drainage District I Cinco MUD Coalition MS4
that was submitted on November 12, 2009 for the Year 2 reporting period for the above-referenced
permit. We have performed an administrative review of this report and offer the following comments.

The annual report appears to include all of the required information and is considered administratively
complete. We have attached a copy of the review checklist we utilized for this review for your reference.
Additional information may be requested in the future as part of technical review, an inspection, or an
audit. We did not perf01111 a comprehensive technical review of this report.

If there are any differences between the approved Storm Water Mallagement Program (SWMP) and the
information provided in this report or future reports, you must submit a notice of change (NOC) as
required by the general permit.

The annual report for the third permit year (August 13, 2009 through August 12, 20 10) is due on
November 12, 2010. The Texas Commission on Environmental Quality (TCEQ) has an updated report
form available, and we strongly encourage MS4 operators to continue to lise the template in preparing and
slIbmiuing :.ubsl:qu\,;nl reports. This wilt greatly assist us in reviewing the r~port&, and will help to insure
that we provide a timely response to permittees. Please make sure to also fOlward a copy of your annual
report to the TCEQ regional office.

Finally, please be aware that discharges of the constituent(s) of concern to impaired water bodies for
which there is a total maximum daily load (TMDL) implementation plan are not eligible for this general
permit unless they are consistent with the approved TMDL and the implementation plan. Permitted MS4
operators must incorporate the limitations, conditions and requirements applicable to their discharges,
including monitoring frequency and reporting required by TCEQ mles, into their SWMP in order to
continue to be eligible for coverage under the general permit. If the discharge is no longer eligible for
coverage under the general permit, then the MS4 operator would be required to apply for and receive an
individual Texas Pollution Discharge Elimination System (TPDES) permit.

The TPDES Phase II MS4 Permit requires small MS4 operators to implement public education and
outreach measures for the following groups:

A review of the Public Education materials for the Willow Fork Drainage District and Cinco MUDs has
been conducted. Recommended revisions to existing materials are attached. A listing of the

Household Hazardous Waste (HHW) Collection Information

Definitions
HHW Household Hazardous Waste
Examples of HHW are certain paints, stains and varnishes; cleaners, polishes; automotive products,
pesticides and fertilizers. Even certain electronics such as televisions and computer monitors
contain hazardous components. Household hazardous waste
includes items that have the words "warning "danger, "toxic.

Harris County HHW Program


Harris County holds approximately ten (10) one-day dropoff
events for Household Hazardous Waste throughout Harris
County each year. The events are typically held during the
spring and fall season, and are free to all residents of Harris
County.

Residents may bring household quantities of paint products,


pesticides, fertilizers, motor oil, gasoline, pool chemicals,
household cleaners, aerosols, batteries and automotive tires (5
per household).

Used electronics such as televisions, computers, word


processors, printers, scanners, fax machines, cellular phones, VCRs, stereos and other small
personal electronics are also accepted. Residents may bring up to five (5) of each of these items.

City of Houston residents do not need a Harris County voucher an use these facilities free of
charge by presenting a current water bill and mat' . lcense.
