“AN ORDINANCE REQUIRING THE REGISTRATION OF TENANTS, BOARDERS,


LESSEES AND SUB LESSEES OF APARTMENTS, HOUSES, BOARDING HOUSES
AND WAREHOUSES OPERATING WITHIN VALENZUELA CITY OTHERWISE
KNOWN AS THE TENANT REGISTRATION ORDINANCE OF 2017”

WHEREAS, Section 16 of the Local Government Code states that every local
government unit shall exercise the powers expressly granted, those necessarily
implied therefrom, as well as powers necessary, appropriate, or incidental of its
efficient and effective governance, and those which are essential to the promotion
of the general welfare. Within their respective territorial jurisdictions, local
government units shall ensure and support among other things, the preservation
and enrichment of culture, promote health and safety, enhance the right of the
people to a balanced ecology, encourage and support the development of
appropriate and self-reliant scientific and technological capabilities, improve public
morals, enhance economic prosperity and social justice, promote full employment
among residents, maintain peace and order, and preserve the comfort and
convenience of their inhabitants;

WHEREAS, the proliferation of crimes nowadays has been considered one of


the pressing problems in our community, the registration of new lessees, whether
as a lessee of a warehouse, a tenant or boarder of apartment within Valenzuela City
is an effective mechanism to know the identity of these individuals in order for the
City and Barangay to have a comprehensive list of individuals living in their
respective territory, imperative in the formulation and implementation of peace and
order program;

WHEREAS, in line with the massive anti-drug campaign by the national and
local government, the registration of new occupants as a lessee of a warehouses, a
tenant or boarder of apartment residing within is an effective tool to monitor any
possible illegal activities in their respective community. It is a fact that apartments
are being used as placed this illegal drugs is administered, delivered, distributed,
sold or used and warehouses are often times use as clandestine laboratory for the
manufacturing of illegal drugs.

WHEREAS, the registration of lessee residing within the barangay shall


provide the latter a comprehensive and accurate data records which shall be useful
in determining legitimate and bona fide residents of the community, as well as a
preventive measure in its battle against crime;

NOW, THEREFORE, be it ORDAINED as it is hereby ORDAINED by the


Sangguniang Panlungsod of Valenzuela in session assembled, the following:

Section 1. SHORT TITLE. This Ordinance shall be known as “Lessee Basic


Information Ordinance of 2017”

Section 2. SCOPE. – The provision of this ordinance shall apply within the
territorial jurisdiction of the City of Valenzuela.

Section 3. DEFINITION OF TERMS. – The following terms are hereby defined


for purposes of this Ordinance.

a. LEASE – A contract wherein one of the parties binds himself to give to
another the enjoyment or use of a thing for a price certain, and for a
period which may be definite or indefinite.

b. LESSOR –An owner or possessor of an estate in land or a rental property,


who, in an exchange for rent, leases it to another individual known as the
lessee. It may also refer to an owner and landlord.

c. LESSEE – A person who leases a property from its owner. This shall also
refer to boarders, tenants, renter and sub-lessee.

d. WAREHOUSES – A building mainly used for deposit or manufacturing of


goods and wares.

e. APARTMENT – For the purposes of this ordinance it refers to any


structure which is usually rented room or a set of rooms that part of a
building, used as a place to live and as but not limited to houses,
condominiums, boarding houses and dormitories.

f. BASIC INFORMATION – means the name, home address, sex, picture,


signature, date of birth, place of birth, employment and marital status
and picture.

Section 4. REGISTRATION – Within 45 days from the approval of this


ordinance, all lessors of apartments, houses, boarding houses and warehouses for
rent shall furnish the barangay of list of basic information of their existing tenants,
boarders, lessees and sub lessees. The following are the basic information to be
provided in the master list of the barangay secretary, to wit:

a. Name and nick name of the said tenants, boarders, lessees and sub
lessees;

b. Age;

c. Place and date of birth;

d. Occupation;

e. Intention/purpose of renting and/or leasing; and

f. Permanent address.

In cases of new contract of lease entered into by a lessor and lessee, the
lessor shall submit the basic information of the lessee within three (3) days after the
execution of the contract of lease. In the same manner, in case of termination of the
contract of lease, the lessor shall inform the barangay within three (3) days after
the lessee vacate the premises.

Provided further, this ordinance shall apply to all individuals engage in the
leasing and renting of apartment and warehouses and those who are engaged in the
similar manner. Furthermore, the apartment and warehouse herein shall refer to
those with or without business permit.

Section 5. OBLIGATIONS OF THE LESSOR – it shall be the obligation of the


lessor:

a.) To submit a written report of the basic information of their respective lessee
within three (3) days after the execution of the contract of lessee;

b.) It shall be their obligation to regularly update the Barangay in cases of
renewal of contract, termination of lease agreement and occupation of
lessee.

Section 6. DUTIES OF THE BARANGAY – The Barangay through its


Barangay Secretary shall keep all the files or records submitted by every lessor of
apartment and warehouse for lease operating within the jurisdiction of the
barangay. Further, the Barangay Secretary shall encode and record the information
submitted in the Tenant Masterlist. It is the duty of the Barangay Secretary to
ensure that Tenant Masterlist is always updated.

Section 7. ADMINISTRATIVE PENALTIES – Lessor of an apartment and


warehouse who shall not submit the basic information of their lessee within the
given period of time or who shall give false information about the true identity of his
lessee shall be subject to the following administrative penalties:

First offense A fine of Two Thousand Pesos (Php


2,000)
Second Offense A fine of Three Thousand Pesos (Php
3,000)
Third Offense A fine of Five Thousand Pesos (Php
5,000)

Section 8. PENAL SANCTIONS - Lessor of an apartment and warehouse who


shall not submit the basic information of their lessee within the given period of time
or who shall give false information about the true identity of his lessee shall upon
conviction be penalized as follows:

First offense A fine of Two Thousand Pesos (Php


2,000) or imprisonment of One (1) month
but not more than Three 3 months, or
both, at the discretion of the court

Second Offense A fine of Three Thousand Pesos (Php


3,000) or imprisonment of Three (3)
months but not more than Six (6)
months, or both, at the discretion of the
court
Third Offense A fine of Five Thousand Pesos (Php
5,000) or imprisonment of Six (6) months
but not more than One (1) year, or both,
at the discretion of the court

Section 9. IMPLEMENTING AGENCIES -The City Mayor and Barangay


Council are mandated to implement this ordinance. The Public Information Office
shall assist in the information dissemination of this ordinance.

Section 10. IMPLEMENTING RULES – While this Ordinance and the


provisions hereof are already operative upon the Ordinance’s effectivity, the City
Mayor may issue the additional, appropriate and relevant rules and regulation for
the proper implementation of this Ordinance or its provisions.

Section 11. REPEALING CLAUSE – All other ordinance, executive orders,


issuances, rules and regulations which are inconsistent with the provisions of this
Ordinance are hereby repealed, amended or modified accordingly.

Section 12. SEPARABILITY CLAUSE – If for any reason or reasons, any part
or provision of this ordinance shall be held to be unconstitutional or invalid, other

parts or provisions thereof which are not affected thereby shall constitute to be in
full force and effect.

Section 13. EFFECTIVITY – This ordinance shall take effect upon approval
and in accordance with existing rules and regulations regarding posting and
publication.
