CHAPTER – 7

LAND ACQUISITION
The fundamental pre-requisite for housing is land. Land procurement is therefore
the major activity of MHADA. Land procured from different sources are as under
1) Land acquired under Chapter V, MHAD Act 1976, ( Section 41 to 50 )
2) Purchased of Land under Chapter V, MHAD Act 1976, ( Section 52 ).
3) Under Maharashtra Regional Town Planning Act (MRTP).
4) Transfer of Government Land.
5) Land from Government agencies
6) Surplus Government land declared under urban land ceiling (ULC)
7) Land acquired under Land Acquisition Act 1894.
8) Other sources.
The source wise information till November 2010 in respect of Mumbai Board &
till September 2011 in respect of Pune Board & till March 2012 of other Boards is as
under :-
1) LAND ACQUISITION UNDER CHAPTER V OF MHAD ACT 1976
( SECTION 41 TO 50) : -
Where, on any representation from the Authority or any Board, it appears to the State
Government that, in order to enable the Authority to discharge any of its functions or to
exercise any of it’s powers or to carry out any of it’s proposals plans, or projects, it is
necessary that any land should be acquired, the State Government may acquire the land by
publishing in the Official Gazette, a notification to the effect that the State Government has
decided to acquire the land in pursuance of this section.
Provided that, before publishing such notification, the State Government shall by
notice published in the Official Gazette, and served in the prescribed manner, call upon the
owner of, or any other person who, in the opinion of that Government may be interested
in, such land to show cause, why it should not be acquired and after considering the cause,
if any, shown by the owner any other person interested in the land, the State Government
may pass such order as it thinks fit.
(2) The acquisition of land for any purpose mentioned in sub-section (1) should be
deemed to be a public purpose.
(3) Where notification aforesaid is published in the official Gazette, the land shall,
on and from the date on which the notification is so published, vest absolutely in the State
Government free from all encumbrances.
Upto the end of March 2012, MHADA had acquired land admeasuring 519.215
hectare out of which 439.049 hectare land is utilized under various housing schemes and
80.166 hectare land is balance. The land admeasuring 637.565 hectare area is under
acquisition procedure.
(2) PURCHASE OF LAND UNDER CHAPTER V OF MHAD ACT – 1976
( SECTION 52 ) : -
The Authority may also enter into an agreement with any person for the acquisition from
him by purchase, lease or exchange of any land which is needed for the purpose of any
proposal, plan or project of the Authority or any interest in such land or for compensating
the owners of any such right in property in respect of any deprivation thereof or
interference therewith.
Up to the end of March 2012, MHADA has purchased 60.042 hectare land, under
above section. Out of which 26.780 hectare land is utilized in housing scheme and 33.262
hectare land is balance with MHADA, the planning of Housing project on balance land is
under process. Also 66.600 hectare land is proposed to be purchased under this section.
(3) LAND ACQUIRED UNDER MRTP ACT :-
Nashik Board (A Regional unit of MHADA) has acquired land admeasuring 4.24 hectare
under this act at Nashik. Out of which 4.160 hectare land is utilized in housing schemes
and 0.080 hectare land is balance. The land area admeasuring 14.66 hectare is proposed
to be acquired under MRTP Act in Nasik, Amaravati & Nagpur Board.
(4) GOVERNMENT LAND :-
The land admeasuring 1449.553 hectare has been acquired at the end of March 2012 from
Government. Out of this. 1212.488 hectare land is utilized for various housing scheme and
237.065 hectare land is balance. Government has requested at the level of Authority and
Regional Boards for 769.100 hectare is to be given to MHADA for housing activities in
the State.
(5) LAND ACQUIRED FROM GOVERNMENT AGENCIES :-
The land admeasuring 221.756 hectare has been acquired from various government
agencies at the end of March 2012. Out of said land, 176.990 hectare land is utilized in
various housing schemes, 44.766 hectare land is yet balance and efforts are being made to
acquire 19.25 hectare land, the proposals are under process.
(6) URBAN LAND CEILING ( U.L.C.) :-
The land under ULC Act can be acquired and utilized by MHADA for residential purpose
in the towns/cities where the ULC Act is exist or is in force. MHADA can submit the
appropriate proposals to Government for acquisition of land.
At the end of March 2012 MHADA had acquired 482.234 hectare land under
this act, out of this 344.439 hectare land is utilized for housing purpose. The land
admeasuring 137.795 hectare is balance for future planning. The proposal for acquisition
of land under this act admeasuring 163.526 hectare is under pipeline.
(7) LAND ACQUIRED UNDER LAND ACQUISITION ACT 1894 :-
MHADA had acquired 906.326 hectare of land under this Act, out of this 883.656 hectare
land is utilized for housing purpose and 22.670 hectare land is balance with MHADA.
(8) ACQUISITION OF LAND FROM OTHER SOURCES :-
MHADA can acquire the land for residential purpose from landowner by negotiation. By
negotiation from landowner MHADA had acquired land admeasuring 282.53 hectare out of
which 274.890 hectare is utilized and 7.64 hectare land is balance for future planning and
35.037 H. land under pipe line at the end of March 2012.
MHADA had acquired land from different sources as mentioned above. The
progress of lands acquired till November 2010 in respect of Mumbai Board and till
September 2011 in respect of Pune Board and till March 2012 of other Boards, is 3925.896
hectare, out of which 3362.452 hectare land is utilized for housing scheme and 563.444
hectare is balance for future planning. Also the proposals for land acquisition for 1705.738
hectare are under process. The detail information pertaining to land is given in separate
table.
